A multi-million dollar senior living facility is under construction in south Salina.

With construction underway, a ceremonial groundbreaking was conducted last week for Cedarhurst of Salina at 2601 S. Ohio Street.

"We are excited to bring a brand new, state of the art senior living community to Salina," said Nick Dwyer, director of development for Dover Development.

Cedarhurst of Salina is a single-story facility that is to offer 76 units, including 54 assisted living and 22 memory care apartments. The facility is expected to be open in early 2024, according to information from the company.

Cedarhurst of Salina is scheduled to have the following services and amenities, according to information from Dover Development.

●On-site occupational, physical and speech therapy

●Causal, formal, and private dining options

●Crafted by Cedarhurst dining (fresh, made to order, and highlighting all-important antioxidants and brain foods that are critical for seniors’ mental health)

●An assisted living Courtyard featuring a fireplace, plenty of seating, and a walking path

●A memory care secured courtyard featuring plenty of seating and a walking path

Two hospitalized in Salina after SUV rollover accident

A year ago last Thursday, Saline County officials broke ground on the new Saline County Jail and sheriff's office.

"With construction slated for substantial completion in 11 more months, construction is at the halfway point," Saline County Administrator Phillip Smith-Hanes noted in an announcement.

To mark the occasion, the county commissioners' meeting on Tuesday "will consist of a study session held onsite at the construction trailer just west of the job site (parking lot entrance off of Front Street between Woodland and Pacific Avenues). The meeting, which will begin at 9:00 am, is a public meeting like all meetings of the Commission and members of the public will be able to join Commissioners along with construction team members for a review of progress," Smith-Hanes noted.

Following the study session, commissioners will be offered individual site tours, however those tours will not be available to the public, nor will a quorum of commissioners be present due to safety concerns on the work site.

The next regular monthly jail update is scheduled for the county commission meeting on Nov. 8, Smith-Hanes noted.

TOPEKA&nbsp;– The Cold Weather Rule, designed to help Kansans who are behind on their utility payments avoid disconnection during the winter months, will begin on Tuesday and remain in effect through March 31.&nbsp;

With energy costs expected to rise this winter, the protections offered by the Cold Weather Rule could be more critical than ever in keeping individuals and families safe and connected. According to the U.S. Energy Information Administration (EIA), Midwest households heating with natural gas could see their bills increase by 33%. Those using electric heat could pay 8% more. If the weather is colder than expected, those numbers could be higher.

While the Cold Weather Rule is in effect, utility companies cannot disconnect a customer's service when local temperatures are forecast to drop below 35 degrees within the following 48-hour period. The Kansas Corporation Commission, the agency that regulates public utilities in the state, implemented the rule in 1983 to prevent utility companies from disconnecting a customer's natural gas or electric service during periods of extreme cold.

The Cold Weather Rule also requires utility companies to offer a 12-month payment plan to allow consumers to maintain or re-establish service. Any residential customer with a past due balance will qualify for payment arrangements; however, it is the customer's responsibility to contact their gas or electric company to make those arrangements.

Payment plan terms to maintain or restore service require that customers agree to pay 1/12th of the total amount owed, 1/12th of the current bill, the full amount of any disconnection or reconnection fee, plus any applicable deposit to the utility. The remaining balance must be paid in equal payments over the next 11 months, in addition to the current monthly bill.

Kansas Cold Weather Rule takes effect Tuesday

MANHATTAN – They’re creepy and they’re kooky, mysterious and spooky. And all together ooky…

But unlike the Addams Family of 1960s television fame, spiders are likely to be gone by Halloween.

Kansas State University entomologist Jeff Whitworth says four spider species common to Kansas are likely to be in hiding within the next few weeks.

Two species commonly found in the home that are of most concern to humans because of their venom – the brown recluse and black widow – are ready to go into winter hibernation. Whitworth said those two species are rarely seen from mid-October to mid-March.

The&nbsp;<a href="https://bookstore.ksre.ksu.edu/pubs/mf3133.pdf">brown recluse</a>&nbsp;is identified by a signature black line that resembles a violin on its back, with the neck of the violin pointing to the rear of the spider. The bite of a brown recluse releases a hemotoxin that affects a person’s blood cells. A bite from a brown recluse may require medical attention.

The&nbsp;<a href="https://bookstore.ksre.ksu.edu/pubs/MF3346.pdf" target="_blank">adult black widow</a>&nbsp;is more elegant looking, typically black with a colorful, hourglass shaped mark on their abdomen. The bite of a black widow releases a neurotoxin that affects the nervous systems of humans and animals.

Two less-venomous spiders more common in farm fields or open areas include the orb spider and the garden spider.

The orb spider is typically a big, brown, round spider that weaves intricate webs.

“You will often see webbing, but not the spider,” Whitworth said. “The webbing catches insects, and then the spider comes out in the evening to feed on what they’ve caught” and repair the web, if needed.

Another common field spider, the garden spider, also is very large, and typically dark green or black and yellow with long legs. Farmers often run into garden spiders when walking between fields because they’ll use corn or sorghum or large weeds to build their webs.

But like the brown recluse and black widow, orb spiders and garden spiders are likely to be out of sight by the time the scariest holiday of the year rolls around.

“We are just about to run out of being scared by spiders, and just before Halloween,” Whitworth said, “because the adult field spiders are going to lay their eggs and then go away. The brown recluse and black widow are going into hibernation and won’t be back until March or April.”

Whitworth said that even though the brown recluse and black widow are better known to be dangerous, “all spiders are venomous.”

“Most spiders don’t affect humans, but you just never know,” he said. “I always caution people not to play with spiders.”

This fall I will mark my ballot to retain all six Kansas Supreme Court justices. Yes, I know that everyone is entitled to their own opinion. So, as judges often demand, here’s the evidence supporting mine.

I served on the Supreme Court from 2002 through 2019, the last ten years as chief justice. During that time, my fellow justices included Marla Luckert (since 2003), Dan Biles (since 2009), and Caleb Stegall (since 2014). I witnessed firsthand how hard these justices worked to reach the right answers, regardless of how much time that demanded. I also saw firsthand their willingness to make tough decisions that they knew would be unpopular with the public—and sometimes different from the results they personally wanted. That is because they concluded those results were required by the particular case’s facts and the law. This process is often called “the rule of law.” As the renowned conservative, U.S. Supreme Court Justice Antonin Scalia, declared:

“If you’re going to be a good and faithful judge, you have to resign yourself to the fact that you’re not always going to like the conclusions you reach. If you like them all the time, you’re probably doing something wrong.”

This judicial decision-making process is, by design, very different from the approach of the other two branches of Kansas government. In short, the legislative and executive branches are purposefully constructed to be political. They do—correctly—seek the public’s views. So they often produce particular results simply because their voters want them.

While I never served on the court with the three other justices on the ballot, I can personally attest that they understand and employ the judicial decision-making process I have described. I can also attest to their strong work ethic. During many of my years on the Supreme Court, Evelyn Wilson was serving as a district court judge and Melissa Standridge as a Court of Appeals judge. So I read their judicial decisions and knew of their fine reputations among their fellow judges. Similarly, K.J. Wahl worked for years on difficult issues as a Supreme Court attorney directly under my supervision.

So, why exactly do these justices make decisions that are sometimes unpopular—and sometimes that they don’t personally even want to make? There are several reasons.

First, since 1868, Kansas law has required “all officers elected or appointed under any law of the state” to solemnly swear (or affirm) to support both the United States and Kansas constitutions and faithfully discharge the duties of their office. This law obviously applies to officers in our legislative, executive, and judicial branches of government. But unlike the other branches’ officers, the Supreme Court justices work with these constitutions on a regular, sometimes daily, basis. And consistent with their oath to support these constitutions, the justices must ensure they protect our rights enshrined there. These include the right to be free from unreasonable searches and seizures, to effective assistance of legal counsel, to receive a fair trial, and other vital rights. It is inevitable that fulfilling their judicial obligations to protect individual rights sometimes produces results unpopular with the majority of Kansans. Because as Justice Scalia explains, this is what happens with “good and faithful” judges.

Second, the justices are bound not only by their solemn oaths to support the constitutions. They are also bound by the Kansas Code of Judicial Conduct. Canon 2 of the Code clearly requires that, “A Judge Shall Perform the Duties of Judicial Office Impartially, Competently, and Diligently.” Taking the Canon together with its explanatory Rule and official Comment, to be impartial a judge “shall uphold and apply the law”—and “must interpret and apply the law,” even if the judge personally “disapproves of the law in question.”

Based on my long personal experience with these six justices, I know they take very seriously their Judicial Conduct obligations and their solemn oaths of faithfulness to our constitutions. Please join me in voting to retain them so they can continue their crucial work for us. For as our fellow Kansan President Dwight Eisenhower said some sixty years ago, “If civilization is to survive, it must choose the rule of law.”

UPDATE: Salina, area Halloween happenings

Safe trick or treating was abundant this past weekend as a number of locations throughout Salina offered options for youngsters.

Hundreds of trick or treaters turned out at the various locations in colorful, cute, and sometimes scary costumes. In many cases, the lines were long as youngsters awaited their turns at the goodies.

Among the locations offering safe trick or treating were the Salina Police Department on Saturday and Trinity United Methodist Church, First Southern Baptist Church, Revolution Church, and the United Methodist Church of the Cross on Sunday. (See photos below.)

Safe trick or treating is scheduled to continue Monday at several locations.

Variety of safe trick or treating options in Salina over the weekend

A Salina man who had an active warrant was arrested Sunday night on multiple drug and firearm charges as well.

Salina Police Captain Paul Forrester said this morning that an officer saw David Boeschling, 24, of Salina, standing in the parking lot of the Airliner Motel, 781 N. Broadway Boulevard, at approximately 9:20 p.m. Sunday, and knew that he had an active failure to appear warrant from Salina Municipal Court.

When the officer advised Boeschling of his warrant and that he was under arrest, Boeschling attempted to hand a backpack to a woman standing in the doorway of one of the motel rooms, Forrester said. Boeschling then allegedly moved his hands toward his waistband and attempted to remove a handgun, however he was taken into custody before he could do so, Forrester said.

The gun, a 9mm Canik, was fully loaded. Additionally, another fully loaded magazine allegedly was found in Boeschling's possession, Forrester said. Officers also allegedly found methamphetamine, marijuana, and drug paraphernalia in the backpack, Forrester said.

Boeschling was arrested on the following requested charges, Forrester said.

A Salina man was arrested Sunday morning after he was found to have a blood alcohol level that was more than four times the legal limit.

Officers were dispatched to the 200 block of N. College Avenue at approximately 10 a.m. Sunday for the report of a possible intoxicated driver in a white Mini Cooper swerving and hitting the curb multiple times. When they arrived, the found the car running in the middle of the street. The driver, identified as Korey Steinle, 24, of Salina, appeared to be passed out in the car, Salina Police Captain Paul Forrester said this morning.

Steinle was found to have a blood alcohol level that was more than four times the legal limit, Forrester said. According to Kansas law, it is against the law to drive or attempt to operate a motor vehicle while having a blood or breath alcohol concentration (BAC) of .08 or above.

Steinle was arrested on requested charges of driving under the influence of alcohol or drugs and transporting an open container, Forrester said.

The U.S. Supreme Court heard arguments concerning affirmative action on Monday, October 31 and will rule before the end of June, 2023. Most news outlets are portraying the arguments for and against affirmative action to be a liberal-conservative issue focused on providing equity in educational access across various racial groups. This is not correct.

According to a poll by The Washington Post and George Mason University’s Schar School of Public Policy and Government, over 60 percent of respondents support eliminating race as a factor in college admissions. However, a similar percent also support programs that would increase racial diversity among college students, and recognize that having a diverse population on campuses is a good way for college students to understand others. And yet, 60 percent also did not consider it important that the student body of a state university match the state’s racial and ethnic proportions.

California would be considered a liberal state today, and it did have an affirmative action policy to maintain relatively proportional representation of various races and ethnic groups on state university campuses until 1996. Then Proposition 209 ended affirmative action in college admissions. Affirmative action had severely suppressed Asian-American enrollments and the result of removing it resulted in Asians being “over-represented” at universities in California, with nearly triple their share of high school graduates. A more recent Proposition 16 would have reinstated affirmative action in California college admissions—it failed to pass.

A recent Chronicle of Higher Education article included myriad graphs comparing the academic factors affecting white versus “under-represented minority” student groups, but failing to mention that there was one minority, the Asian-American students, who were over-represented in our state schools nationwide. &nbsp;&nbsp; &nbsp;

Today’s Education Schools refuse to admit that there is cultural variation in the extent various sub-groups value education. Asian-American students, despite being here for many generations, maintain a very high regard for education, called an educational “success frame.” Not 100 percent feel this parental expectation—where an “A-minus” is an Asian “F”—but it is well-documented and classroom teachers recognize it as well in most of their Asian-heritage students.&nbsp; Jennifer Lee and Min Zhou detail this “success frame” in “The Asian American Achievement Paradox.” &nbsp;

Lee and Zhou also interviewed Hispanic, African-American, and working class white Americans in addition to Asian-Americans and found wide variations in cultural expectations of education. White working class families mostly have very low educational expectations for their children.

Recent arguments for affirmative action have been put forth in several books and articles asserting that the use of tests promotes a “myth of meritocracy,” and for the most part, it is merely helping the rich get their children into college by way of extra test-prep tutoring.

There is an irony in this argument, because the early Western world was ruled by a bureaucracy based on “patronage” where the rich became governmental functionaries without much education. That changed when the West adopted civil service examinations based on—you might guess it—a much older system of governmental exams established in China under the Sui Dynasty in AD 605. Such testing offered a route for children of the poor to have social mobility through education.

However, it would not be until the British Northcote–Trevelyan Report of 1854 that Her Majesty's Civil Service would be established, based on civil service exams, in part motivated by the chaos that occurred due to bureaucratic management of the Crimean War at that time!

This current U.S. Supreme Court will closely examine in detail the prior 2013 ruling on affirmative action in Fisher v. University of Texas. Yes, the court allowed affirmative action to stand, but it placed a burden on universities to prove that no viable race-neutral alternatives are available when the university uses racial preferences in admissions to increase diversity.

This is not a left-versus-right battle, but a return to rewarding those students, who study hard and demonstrate their knowledge and skills, the opportunity to move ahead in education and not be replaced by students with less study ethic. The future of a country depends on advancing its very best students.&nbsp;&nbsp;

If you are planning on dressing up a pet, Nelson suggested trying the costume on your pet in advance. This allows the time to get used to it and to ensure your pet can see, hear, smell and breathe when in costume. Make sure to avoid costumes that have any loose or small parts that can be pulled off and ingested. "If your pet seems distressed, allergic or shows abnormal behavior with a costume, consider having it wear a Halloween-themed bandana instead, as many pets prefer to dress up as themselves," Nelson said. Family members in costumes can be just as scary for pets. Nelson said to be mindful that your pet may be frightened by one of its own familiar family members when that person is disguised in a costume. "A severe fright can make the pet wary of that person for some time to come, even after the costume has been removed," Nelson said. "Get your pet used to the costume well in advance of the holiday by giving it treats while wearing part of the costume, and then later, all of the costume to help the pet become more familiar with it." Unknown visitors in scary costumes and loud noises can cause even the most social and/or calm animal to be frightened or show unexpected aggression. Nelson offers these tips if your pet is one that becomes anxious from noise and activity: ●Keep animal kenneled away from the activity or make a comfy spot in a back room. ●Turn on a radio or TV to help drown out noise caused by ringing doorbells and excited children. ●Greet visitors and hand out treats at the end of the driveway.&nbsp;

If your pet is one that gets severely distressed during this time, Nelson advised owners to speak with their veterinarian to determine if sedatives are an option and can be prescribed. Nelson said to also be aware of these other possible Halloween hazards for your pet: ●Keep pets inside to protect them from tricksters. Cats, especially black ones, are often sought after with cruel intentions during Halloween and caution needs to be exercised during this time to keep them safe. ●Ensure your pet has proper forms of identification, such as a microchip, collar or tags, should they run off. A reflective collar may also help others to spot your pet should it go missing at night. ●Keep pets away from electrical cords and decorations. Chewing on electrical cords can lead to life-threatening electrocution and burns. Decorations using corncobs, strings or tassels can be ingested and cause obstructions in the gastrointestinal tract. ●Keep lit pumpkins and candles out of reach, as they can burn your pet. A frightened or curious pet also can tip over a candle, which could lead to a house fire. Consider using battery-operated lights instead. Pumpkins can be a source of toxic mold if ingested. ●Keep glow sticks away from pets. While not poisonous, glow sticks have a very bitter taste and can cause irritation to the mouth. Pets, especially cats, may drool uncontrollably and become very agitated. Some glow sticks contain a small glass vial that when broken, activates the glow stick. The glass can be harmful if ingested. If you suspect your pet has ingested something toxic, Nelson said to call your veterinarian, the ASPCA Poison Control Center at 888-426-4435 or the Pet Poison Helpline at 855-764-7661 immediately for advice.

When He Comes to Reign will be the theme for this year's musical holiday event, which is scheduled for 5 p.m. Dec. 4 in Sams Chapel. Christmas by Candlelight is open to the public at no charge and no ticketing process is required.

“Christmas by Candlelight is always a highlight of Salina’s Christmas season,” said James McAllister, Music Department chair. “We look forward to seeing friends, family, alumni and community members at the performance. Working with high schools from throughout the area is a tremendous opportunity to open the Christmas season.”

The Dec. 4 performance will include high school musicians from Hutchinson, Sacred Heart, Salina Central, Salina South, and Southeast of Saline.

This year’s Christmas by Candlelight marks 40 years since the KWU Christmas concert took on that name, according to information from the university.

The work will take place generally between the hours of 8 a.m. and 5 p.m. Access to properties within work zones will be maintained at all times. “Road Work Ahead” signs will be placed in advance of work zones, and temporary single-lane closures are to be expected. Motorists are asked to proceed with caution when approaching work zones for the safety of the crews performing the work.

The annual crack and joint sealing program is an important and cost-effective preventive maintenance component of the City of Salina’s annual street repair program. Crack sealing the pavement helps prevent water from penetrating into the pavement structure or sub-base material and aids in reducing a number of pavement problems which include: crack spreading; formation of voids under pavement; swelling and shrinking of sub-base materials; freeze-thaw action; alligator cracking; potholing; and complete failure. Because of its importance and cost- effectiveness, the Department of Public Works strives to seal each asphalt street in Salina no less often than every seven years.

This $288,000 project is part of the city's $4.7 million 2022 street maintenance program.
