Recent obituaries

Americans sometimes assume they are equipped with everything they need — laws, policies and cultural norms — to exercise their right to religious freedom. But is that true? What circumstances need to exist for religious freedom to be possible? What conditions must already be in place if Americans are to exercise their right to believe and act in accordance with their religious identities?

Corey D. B. Walker, a religious studies scholar at the University of Richmond, recently raised these questions at a&nbsp;<a href="https://www.freedomforuminstitute.org/2020/02/13/lifting-every-voice-in-religious-freedom/" target="_blank">course</a>&nbsp;exploring African-American perspectives about religious freedom. Drawing on the work of Enlightenment philosopher&nbsp;Immanuel Kant, Walker asked students to consider the “conditions of possibility” for religious freedom. So, what are the conditions necessary for enabling religious freedom in the first place?

Consider the Trump administration’s&nbsp;<a href="https://www.christianpost.com/news/trump-announces-school-prayer-guidance-9-agencies-draft-religious-freedom-rules.html" target="_blank">proposed changes</a>&nbsp;to rules in nine federal agencies. The changes are complex and differ somewhat across agencies, but one common theme is the elimination of certain religious liberty protections for social service beneficiaries. These rules were implemented pursuant to an executive order signed by&nbsp;President Obama&nbsp;in 2010 (<a href="https://www.govinfo.gov/content/pkg/FR-2010-11-22/pdf/2010-29579.pdf" target="_blank">Executive Order 13559</a>). With this order, President Obama embraced recommendations made by his inaugural Advisory Council on Faith-based and Neighborhood Partnerships, which was comprised of both progressive and conservative religious and community leaders. The order states in part:

If a beneficiary or prospective beneficiary of a social service program supported by federal financial assistance objects to the religious character of an organization that provides services under the program, that organization shall, within a reasonable time after the date of the objection, refer the beneficiary to an alternative provider.

In other words, a religiously affiliated group — like a Christian, Jewish, Islamic, Hindu, Buddhist or Sikh ministry or aid society — can receive a federal grant or contract to provide a social service such as emergency shelter, food supplement or job training programs, addiction treatment services and more. If a religiously affiliated group does so, then the group must refer beneficiaries (those who receive the service) to other groups if the beneficiary objects to the religious affiliation or character of the service provider.

Furthermore, the rules require social service providers to notify beneficiaries that they can request such a referral. The task force that made these recommendations asserted that beneficiaries cannot be expected to know about these protections — social service providers are responsible for informing them.

The Trump administration would eliminate the alternative provider requirement. It would also no longer obligate social service providers to notify beneficiaries that they could request an alternative provider. Beneficiaries could still seek a referral to such a provider, but they would not be told about that option. But under the proposed rule, providers would not be required to try to find an alternative provider.

Do the proposed rules create the “conditions of possibility” for religious freedom? The Trump administration argues the rules would put religious social service providers on a level playing field with non-religious providers, thereby promoting one possible condition for freedom: equality. The administration contends that the alternative provider requirement and beneficiary notice are discriminatory for placing special obligations on religious social service providers. They say those rules are in tension with recent U.S. Supreme Court decisions. Others assert that these requirements are consistent with the Establishment&nbsp;and&nbsp;Free Exercise Clauses in the First Amendment. And the Supreme Court cases that the Trump administration cites involve governmental policies that refuse to allow religious bodies to compete for state funding or religious individuals to run for certain public offices, not reasonable conditions that apply to government grants religious bodies do receive.

In either case, the Trump administration’s proposed rules would eliminate another condition for freedom: knowledge. If social service beneficiaries are not notified about these religious liberty protections, they may not know that they can request a different religious or non-religious provider. Our judicial system has long acknowledged the link between knowledge of rights and the ability to exercise those rights. Anyone who has watched a crime show knows that the police need to read suspects their&nbsp;<a href="https://constitutioncenter.org/blog/the-miranda-warning-is-born-47-years-ago-today" target="_blank">Miranda rights</a>, for example.

The Trump administration should not eliminate the alternative referral requirement and beneficiary notice if they want to safeguard the conditions that make religious freedom possible. Even if one accepts their claim that the alternative provider and beneficiary notice requirements present a possibly unconstitutional burden on religious social service providers — a claim vigorously disputed by some church-state lawyers, including&nbsp;Melissa Rogers&nbsp;— the administration could maintain these religious liberty protections for beneficiaries in other ways. The administration could require&nbsp;both&nbsp;religious and non-religious social service providers to make referrals to alternative providers and notify beneficiaries about religious liberty protections for them. Or governmental bodies, not providers, could notify beneficiaries of existing protections. (As Melissa Rogers notes, “[t]he only indefensible approach would be to end such religious freedom requirements”).

Too often those in power present religious freedom as a zero-sum game. In this case, the Trump administration argues that the government can extend religious liberty protections to social service providers or beneficiaries, but not both. But the administration can maintain protections for both and thereby affirm conditions that both conservatives and progressives argue are necessary for religious freedom to exist at all.

A British Council&nbsp;<a href="https://www.britishcouncil.us/sites/default/files/usukreligionbeliefreport_1.pdf" target="_blank">survey</a>&nbsp;released to the public earlier this year found that 89 percent of people in the United States agree that freedom of religion or belief is a fundamental right. As Americans, we should urge the government to do everything it can to create the conditions that make it possible for Americans of all religions and none to exercise that fundamental right.

First Five: Conditions of possibility for religious freedom

McPHERSON – A gallery exhibit at McPherson College titled, “Who Does She Think She Is?” brings together women artists, poets, and writers from across Kansas to celebrate women and commemorate the 100th&nbsp;anniversary of the passage of the 19th&nbsp;Amendment, guaranteeing and protecting women’s constitutional right to vote.

The exhibition features works from both young and old, traditional and contemporary. The works cover a wide range of media including, drawing, painting, graphic design, sculpture, assemblage, textiles, jewelry, photography, ceramics, and more. Poems and writings by women writers from the college also accompany the artwork.

“I was inspired by this year’s celebration of 100 years of women’s suffrage and by the under-representation of women in the arts,” Gallery Director Michaela Valli Groeblacher said. “The genesis of this show is rather organic and spontaneous. I invited women from all over Kansas to exhibit their art, poetry, and prose, focusing on works that many might not have seen before.”

Women artists have been marginalized for centuries, according to Groeblacher. The exhibition cites information from the National Museum of Women in the Arts that says until the 1970s it was nearly impossible to find information about women artists referenced in art history books. Women artists still face obstacles and disparities today and are persistently underrepresented in museum collections and exhibitions.

The exhibition is open now through April 18 in Friendship Hall on the college campus. It is open to the public during regular business hours, Monday through Friday. An artists’ reception will be held on April 18 from 5-7 p.m.

A red flag warning means that critical fire weather conditions are either occurring now, or will shortly. A combination of strong winds, low relative humidity and warm temperatures can contribute to extreme fire behavior.

The National Weather Service (NWS) in Wichita has issued a red flag warning for extreme grassland fire danger in effect from noon to 7 p.m. Saturday for the following counties in our area.

Winds: South 20 to 30 mph with gusts up to 40 mph.

Impacts: Any fires that develop will likely spread rapidly and   become very difficult to control. Outdoor burning is not   recommended. Please be mindful of anything that may cause a spark.

NWS in Topeka has issued a red flag warning in effect from noon to 7 p.m. Saturday for the following counties in our area.

WIND: South to southwest winds of 25 to 30 mph with gusts up to 40 mph.

HUMIDITY: Afternoon humidity values will fall from 15 to 20 percent.

IMPACTS: Any fires that develop will spread rapidly. Outdoor burning is not recommended.

NWS in Hastings, Neb., has issued a red flag warning in effect from noon to 6 p.m. Saturday for the following counties in our area.

WINDS: South 15 to 25 mph with gusts up to 40 to 45 mph.

IMPACTS: Any fires that develop will likely spread rapidly. Outdoor burning is not recommended.

Additionally, a wind advisory remains in effect from noon to 7 p.m. Saturday for the following counties in our area.

Strong wind gusts could blow around unsecured objects. High profile vehicles will be susceptible to strong and sudden wind gusts, especially on east-west oriented roads and highways.

NWS issues red flag warnings for Saturday

On March 7, 1965, a march by civil rights demonstrators was violently broken up at the Edmund Pettus Bridge in Selma, Alabama, by state troopers and a sheriff's posse in what came to be known as "Bloody Sunday."

In 1793, during the French Revolutionary Wars, France declared war on Spain.

In 1876, Alexander Graham Bell received a U.S. patent for his telephone.

In 1911, President William Howard Taft ordered 20,000 troops to patrol the U.S.-Mexico border in response to the Mexican Revolution.

Five years ago: President Barack Obama joined tens of thousands of people in Selma, Alabama, to commemorate the 50th anniversary of the "Bloody Sunday" march of 1965, saying that America's racial history "still casts its long shadow upon us." Nigeria's home-grown Boko Haram Islamic extremists pledged formal allegiance to the Islamic State group as they battled a multinational force that had dislodged them from a number of towns in the north. Izola Ware Curry, who had stabbed the Rev. Martin Luther King Jr. in the chest with a letter opener at a Harlem book signing in 1958, died at a nursing home in Queens, New York, at age 98.

One year ago: Longtime Colombo crime family boss Carmine "The Snake" Persico died at the age of 85 at the Duke University Medical Center; he'd been serving what was effectively a life sentence at a federal prison in Butner, North Carolina. Today in History -- March 7

Twenty-three new law enforcement officers graduated from the Kansas Law Enforcement Training Center (KLETC) on Friday. 

Derrick Crisenbery of the Hays Police Department was the graduating class president and Winfield Chief of Police Robbie DeLong was the speaker for the ceremony in KLETC’s Integrity Auditorium.

The new officers were members of the 263rd basic training class. The graduates, who began their training in November 2019, represented 18 municipal, county and state law enforcement agencies from across Kansas.

Graduates receive certificates of course completion from KLETC and Kansas law enforcement certification from the Kansas Commission on Peace Officers’ Standards and Training, the state’s law enforcement licensing authority. The training course fulfills the state requirement for law enforcement training. Classroom lectures and hands-on applications help train officers to solve the increasingly complex problems they face in the line of duty.

During the ceremony class president Crisenbery presented KLETC Executive Director Darin Beck with a check for $800 that will go towards projects like the maintenance and upkeep of the KLETC Wall of Honor, which is a memorial to KLETC graduates that have fallen in the line of duty.

“KLETC uses its Endowment funds to support important initiatives such as the Wall of Honor or The Protector statue,” said Beck. “We even hope at some point to be able to offer scholarships through these funds.”

Established by the Kansas Legislature in 1968, KLETC trains the majority of municipal, county and state law enforcement officers in Kansas and oversees the training of the remaining officers at seven authorized and certified academy programs operated by local law enforcement agencies and the Kansas Highway Patrol.

About 300 officers enroll annually in KLETC 14-week basic training programs. KLETC offers continuing education and specialized training to over 10,000 Kansas officers each year. KLETC is located one mile west and one mile south of Yoder, near Hutchinson, and is a division of University of Kansas Professional &amp; Continuing Education.

City closing Barkley Dog Park multiple days

Fire weather watches and a wind advisory have been issued for counties in our area.

A fire weather watch means that critical fire weather conditions are forecast to occur.

The National Weather Service (NWS) in Wichita has issued a fire weather watch for extreme grassland fire danger, which is in effect Saturday afternoon for the following counties in our area.

Winds: South 20 to 30 mph with gusts to around 40 mph.

Relative Humidity: As low as 20 to 25 percent.

Impacts: Any fires that develop will likely spread rapidly and become very difficult to control. Outdoor burning is not recommended.

Additionally, NWS in Hastings, Neb., has issued a fire weather watch in effect Saturday afternoon for the following counties in our area.

WIND: South 20 to 25 mph with gusts up to 35 mph.

NWS in Topeka has issued a fire weather watch in effect Saturday afternoon for the following counties in our area.

HUMIDITY: Afternoon humidity values will fall to around 20 to 25 percent.

In addition to the fire weather watches, NWS in Wichita has issued a wind advisory in effect from noon to 6 p.m. Saturday for the following counties in our area.

NWS: Fire weather watches, wind advisory issued

Two Salina men were arrested after an incident late Thursday night at a local gentlemen's club.

Saline County Sheriff Roger Soldan said this morning that deputies were dispatched at 11:35 p.m. to the Shady Lady, 1540 West Old Highway 40, for the report of two subjects inside with guns. Two patrons of the club allegedly had been causing problems and when club staff tried to resolve the issue, they discovered that the men were armed, which is not allowed in the club, Soldan said.

When deputies arrived, they found Robert Houston, 26, of Salina, and Antoine Cooper, 44, of Salina, in a black Chrysler 300 on the north side of the building, Soldan said. They had tossed the guns into a nearby field, however, deputies were able to locate the weapons, he added. During the course of the investigation, it was determined that the gun that had been in Houston's possession had been reported stolen, Soldan said.

Houston was arrested on suspicion of the following, Soldan said.

Defacing a firearm (Soldan said part of the serial number on the gun had been destroyed.)

Cooper was arrested on suspicion of the following, Soldan said.

Interference with a law enforcement officer (Soldan said Cooper was the one who had thrown the two guns into the field.)

Two Salina men arrested at Shady Lady Thursday night

The Saline County Sheriff's Office is investigating a burglary northwest of Salina in which more than $1,800 worth of cash and items were stolen.

Saline County Sheriff Roger Soldan said this morning that the couple who live in the residence in the 3400 block of North Muir Road returned home Wednesday afternoon after being away for several days and discovered that someone had stolen the following.

A wedding ring with a solitaire diamond valued at $850

An anniversary band with four to five small diamonds valued at $450

A Republic Arms 25 caliber semi-automatic pistol valued at $175

Soldan said there was no damage to the residence.

Vehicle stolen in Plainville may have been in Salina

A known suspect was apprehended Thursday after he returned to the scene of a crime in far northeast Saline County.

According to Saline County Sheriff Roger Soldan, deputies were dispatched to the 9900 block of East Riordan Road at 5:48 a.m. for the report of two masked subjects who had broken into a residence. He said that a 19-year-old man and his 18-year-old girlfriend were awakened by a noise, and found two male subjects wearing ski masks in the residence. One of the subjects was carrying a Highpoint 495 40 caliber rifle, he added.

The man's 83-year-old grandmother also was in the residence at the time, Soldan said.

The 19-year-old confronted the two subjects and got into an altercation with the rifle-toting subject, Soldan explained. During the altercation, the 19-year-old was able to take the rifle from the suspect, he said. He also pulled the mask from the suspect's face and recognized him as an acquaintance, Soldan said. The 19-year-old also grabbed his own Ruger SR22 rifle with a scope -- valued at $1,000 -- which the suspect then took from him, Soldan said.

During the altercation, the two crashed through a glass door and the 19-year old was cut, Soldan said. The known suspect fled the scene, he said. By then the other suspect had also fled the scene, Soldan added.

Prior to waking up the residents, the two suspects had placed a 20-inch Apple computer (valued at $700, a 43-inch Vizio television (valued at $400, and a black nylon purse outside the residence, Soldan said.

As sheriff's office investigators went to the house shortly after 11 a.m. Thursday to interview the victims, they were made aware by surveillance that the known suspect, Dvonte Johnson, 19, of New Cambria, was back in the area of the residence, Soldan said. They located Johnson and the victim's rifle nearby in a black Nissan Altima, Soldan explained.

Johnson was arrested on suspicion of the following, Soldan said.

The second suspect remains at large and the investigation continues, Soldan said.

New Cambria man arrested, 2nd suspect sought in burglary

On Feb. 10, 2020, approximately 3:47 p.m., officers were sent to the 2300 block of Georgetown in regard to a theft. 

Neighbors reported that two men were seen stealing a Hauck Thunder II Go-Cart from a residence. A neighbor confronted the men, and the two fled, abandoning the Go-Cart in the street. 

One of the neighbors snapped a photograph of one of the persons. He was described as a white male, late-teens to early-20s, wearing a red baseball cap, red Adidas hooded sweatshirt,&nbsp;and black pants. The person had a red beard. 

His companion has already been identified. 

The persons ran away from the scene to the area of Marymount/Crawford and later boarded a City-Go bus. Video from the bus is being analyzed.

Police are seeking to identify the person shown in the photograph.

First Friday offers fun, variety

TOPEKA -– One of the most anticipated “signs of spring” arrives this weekend when the clocks “spring forward” (Daylight Saving Time officially begins at 2 a.m. Sunday, causing us to lose an hour of our day in exchange for extended daylight hours throughout the summer. However, come Monday morning, the commute will look very different for school students waiting for buses and motorists driving to work – in the dark.

“Most people will see a dramatic difference during their morning commute starting on Monday, as roadways remain darker later into the morning, causing concern for drivers and pedestrians,” said Shawn Steward, spokesman for AAA Kansas.  “Motorists and pedestrians, including school students waiting at bus stops, need to be aware of these dangers, remain alert, and minimize distractions to reduce the risk of vehicle crashes.”

Drowsy driving is big traffic safety issue. The National Highway Transportation Administration (NHTSA) estimates that in 2017, 91,000 police-reported crashes involved drowsy drivers. These crashes led to an estimated 50,000 people injured and nearly 800 deaths nationwide. But there is broad agreement across the traffic safety, sleep science, and public health communities that this is an underestimate of the impact of drowsy driving. 

Kansas Department of Transportation data from 2018 revealed that drivers being fatigued or falling asleep was cited as a contributing factor in nearly 1,000 traffic crashes in the state. Kansans “springing forward” by moving their clocks ahead one hour need to remember to also adjust their sleep schedule to prevent drowsiness on the road. 

“A change in time can mean that drivers are more tired than they realize,” Steward noted.  “Drivers who miss one to two hours of the recommended seven hours of sleep in a 24-hour period nearly double their risk for a crash.”

Drivers who have slept for less than 5 hours have a crash risk comparable to someone driving drunk.

 </figure>AAA recommends that drivers:Should not rely on their bodies to provide warning signs for drowsiness and should instead prioritize getting at least seven hours of sleep before hitting the road.Travel at times of the day when they are normally awake.Avoid heavy foods.Avoid medications that cause drowsiness or other impairment.Use night setting on rear-view mirrors (if equipped) to reduce glare from headlights approaching from the rear.Improve visibility in the dark by cleaning headlights, tail lights, signal lights, and windows (inside and out); and ensuring headlights are properly aimed and kept on low beams, so as to not blind other drivers.Reduce speed and increase following distances, as it is more difficult to judge other vehicles’ speeds and distances at in the dark.Be mindful of pedestrians and crosswalks, yield the right of way to pedestrians in crosswalks and do not pass vehicles stopped at crosswalks. Never pass a school bus with its lights flashing and stop sign extended.School SafetyMoving clocks ahead one hour means it will be darker in the mornings for the next few weeks. It is important to remember that children will be on their way to school during this time, so drivers must remain vigilant. AAA recommends the following:Slow Down. Speed limits in school zones are reduced for a reason. A pedestrian struck by a vehicle traveling at 25 mph is nearly two-thirds less likely to be killed compared to a pedestrian struck by a vehicle traveling just 10 mph faster.Stay Alert. Drivers should always avoid distractions – especially using cell phones – while driving, but it’s particularly important in school zones and residential neighborhoods.Headlights. Turn on the vehicle’s daytime running lights or headlights—even during the day—so children and other drivers can see you more easily.
