U.S. Secretary of State John Kerry broke his leg in a bicycle crash near Geneva, forcing him to return to the U.S. for treatment and to scrap the rest of a four-nation trip. Jim Bailey, 77, a singer-actor who transformed himself into such show biz legends as Judy Garland, Barbra Streisand and Peggy Lee during a career that spanned decades, died in Los Angeles. Harriette Thompson of Charlotte, North Carolina, a 92-year-old cancer survivor, became the oldest woman to finish a marathon as she completed the Rock 'n' Roll Marathon in San Diego in 7:24:36.

In 1879, a tornado outbreak struck Kansas and Western Missouri. 

In North Central Kansas, tornadoes killed 18 in Delphos, and 30 in Irving. 

Two tornadoes struck Irving within a few minutes of each other, virtually wiping the small Kansas community off the map. The second tornado was huge, around 2 miles wide, and had multiple vortices.

The government should not be in the business of telling religious communities who to hire or fire as religious leaders.

That seems straightforward, right? Imagine if a court ordered a Catholic church to hire an Episcopal priest. That is a clear violation of the Establishment Clause. Americans should affirm the rights of religious communities to choose their priests, pastors, rabbis or imams — even if discriminating on the basis of religious belief is forbidden in other types of employment.

In 2012, the U.S. Supreme Court affirmed unanimously in&nbsp;<a href="https://www.oyez.org/cases/2011/10-553" target="_blank">Hosanna-Tabor Evangelical Lutheran Church and School v. EEOC</a>&nbsp;that religious employers have a “ministerial exception” to non-discrimination laws, which allows them to hire or fire ministers for any reason. In a new case before the U.S. Supreme Court, the nine justices now have to decide who qualifies as a “minister.” But is the court competent to make that decision?

This month, the court heard&nbsp;<a href="https://www.supremecourt.gov/oral_arguments/argument_transcripts/2019/19-267_4g25.pdf" target="_blank">oral arguments</a>&nbsp;in Our Lady of Guadalupe School v. Morrissey-Berru and St. James School v. Biel. In those cases, the justices were asked whether the ministerial exception applied to fifth-grade teachers in Catholic elementary schools who taught classes about religion. Morrissey-Berru alleges that she was fired because of her age. Biel’s school did not renew her contract after Biel was diagnosed with breast cancer and she requested time off. The schools assert the government cannot interfere with their termination decisions because Biel and Morrissey-Berru qualify as ministers. But are they?

Given the court’s determination in Hosanna-Tabor that the ministerial exception protects religious employers from lawsuits brought by minister-employees terminated for reasons of age, disability, race, sexual orientation or any other factor, the government is faced with a challenge: defining “minister” broadly enough to safeguard religious freedom but narrowly enough to protect the integrity of antidiscrimination laws such as the Americans with Disabilities Act, the Civil Rights Act of 1964, the Fair Labor Standards Act and the Equal Pay Act.

Should the definition of “minister” be determined by the title of the employee? Justices&nbsp;Samuel Alito&nbsp;and&nbsp;Neil Gorsuch&nbsp;pointed out that some “minority religions” do not use the “Christian/Protestant” term. Religious liberty advocates&nbsp;Asma Uddin&nbsp;and&nbsp;Howard Slugh&nbsp;made a similar point in their&nbsp;<a href="https://www.newsweek.com/supreme-court-has-new-chance-stand-strong-religious-liberty-opinion-1502865" target="_blank">recent article</a>&nbsp;in&nbsp;Newsweek.

Should the definition of “minister” be determined by the function of the employee? For example, the U.S. government representative arguing in support of Our Lady said that certain functions like “preaching, teaching, worship, leadership and rituals” signal that an employee functions as a minister, whatever their title. But the justices questioned this approach too. Justices&nbsp;Ruth Bader Ginsburg, Gorsuch and&nbsp;Brett Kavanaugh&nbsp;all invoked a hypothetical coach who prays with students before a game. Does that person count as a minister just because they engage in religious activity?

To determine whether an employee’s function qualified for the ministerial exception, some of the justices asked the lawyers about the rules they should use to determine if a job is “primarily religious in any way” or if their religious function is just a “de minimis” factor that is not a “meaningful” part of their job.

Here the oral arguments illuminate one way the government’s commitment to religious freedom — and justices’ interest in avoiding the excessive entanglement of religion and government — paradoxically result in government officials carefully defining what counts as religious. By pursuing lines of questioning that seek to determine whether a job is primarily or meaningfully religious, the justices get in the business of judging the relative importance of religious practices to religious identity.

Justice Gorsuch suggested an alternative. The Religious Freedom Restoration Act recognizes “any sincerely held religious belief” when considering free exercise claims and judges do not make determinations about the relative importance or centrality of a belief or practice. This line of thinking is relatively sound from an academic perspective. Among religious studies scholars, it is common to accept the self-designation of a person or community as religious or not.

To wit: when I was in divinity school, I successfully applied for a grant from my school for which I argued that interning at the U.S. State Department was part of my “call to ministry.”

But if judges accept employers’ decisions about who counts as a minister, can the government robustly enforce non-discrimination laws? What would stop an employer from saying that everyone functions as a minister,&nbsp;Justice Sonia Sotomayor&nbsp;asked. In fact, amicus briefs from major Jewish and Christian groups argue that every teacher performs an important religious function.

In a surprising moment,&nbsp;Justice Elena Kagan&nbsp;asked whether even a nurse at a Catholic hospital “who prays with sick patients and is told otherwise to tend to their religious needs” counts as a minister. Maybe yes, said the lawyer representing Our Lady.

As a religious studies scholar, I do not disagree with the assertion that all teachers in a school might perform an important religious function, nor do I deny that nursing can function as a form of ministry. Religion is embedded in every aspect of the human experience. All actions, no matter how mundane they may seem, can have sacred significance. Job titles — and even job functions — do not determine whether an act is religious or whether a job is ministerial.

But, as noted above, the government has a compelling interest to uphold non-discrimination laws. Allowing religious employers to determine unilaterally who counts as a minister could remove non-discrimination protections from hundreds of thousands of teachers, nurses and others who are employed by religious institutions. Should the court allow religious communities to self-designate ministers — a sound choice from the perspective of some religious studies scholars — if doing so would eviscerate non-discrimination protections?

It might be more intellectually honest for courts to recognize that some employees who perform ministerial roles, no matter how meaningful or central they are to an individual or community’s religious identity, do not qualify for the ministerial exception because non-discrimination laws take precedent. The challenge, of course, will be in identifying the standard used to make that determination. We will see what the court decides later this year.

Maybe yes, said the lawyer representing Our Lady.As a religious studies scholar, I do not disagree with the assertion that all teachers in a school might perform an important religious function, nor do I deny that nursing can function as a form of ministry. Religion is embedded in every aspect of the human experience. All actions, no matter how mundane they may seem, can have sacred significance. Job titles — and even job functions — do not determine whether an act is religious or whether a job is ministerial.But, as noted above, the government has a compelling interest to uphold non-discrimination laws. Allowing religious employers to determine unilaterally who counts as a minister could remove non-discrimination protections from hundreds of thousands of teachers, nurses and others who are employed by religious institutions. Should the court allow religious communities to self-designate ministers — a sound choice from the perspective of some religious studies scholars — if doing so would eviscerate non-discrimination protections?It might be more intellectually honest for courts to recognize that some employees who perform ministerial roles, no matter how meaningful or central they are to an individual or community’s religious identity, do not qualify for the ministerial exception because non-discrimination laws take precedent. Concordia Residents Encouraged to Learn the Signs, Seek Help This Better Hearing &amp; Speech Month

CONCORDIA -- With speech, language, and swallowing disorders common following stroke, head and neck cancer, and a variety of other illnesses and injuries in adults, Cloud County Health Center’s (CCHC) speech-language pathologist, Tori Ehlers, encourages residents to learn the signs—and seek an evaluation—if they have concerns about themselves or a loved one. 

May is recognized nationally as Better Hearing &amp; Speech Month.

“Many people may not appreciate their ability to communicate until it’s lost,” said Ehlers. “From having your basic needs met to nurturing relationships and earning a living, communication is at the core.”

Speech and language problems in adults can result from various causes. They include brain injury, stroke, and diseases that affect the brain such as Alzheimer’s disease, multiple sclerosis, and Parkinson’s disease. They can also stem from breathing problems, cancers in the head and/or neck region, and voice damage.

Speech and language disorders that may be acquired in adulthood include the following:

•Aphasia. This involves problems speaking, understanding, reading, writing, telling time, and/or using numbers. Often misunderstood, aphasia does not affect a person’s intelligence.

The most common cause of aphasia is stroke.

•Cognitive-communication disorders. Problems with thinking and communication can affect each other. Some examples are difficulty paying attention, remembering, organizing thoughts, and solving problems.

•Apraxia of speech. Speech difficulties arise from problems planning motor movements. It is caused by damage to the parts of the brain that are involved in speaking.

•Dysarthria. Speech difficulties (e.g., slurred speech) due to weakness of muscles involved in breathing and/or speaking.

•Voice disorders. Changes in pitch, loudness, and vocal quality that negatively impact communication. These may result from nodules on the vocal cord, overuse/misuse of voice (e.g., yelling, diseases such as Parkinson’s or multiple sclerosis, and other causes.

Speech-language pathologists can help adults with these and other communication problems.

“May is also a time to spotlight swallowing disorders, called dysphagia, which too are treated by speech-language pathologists,” Ehlers added. “Dysphagia is another common side effect of numerous diseases in adults. A person’s ability to eat and drink is critical to maintaining good health and promoting recovery from illness. Food is also a central part of many social experiences -- contributing to an enjoyable and fulfilling life. Treatment can be truly transformative to a person’s quality of life and overall health.”

Speech-language pathologists treat dysphagia in various ways, including these:

•Helping people use their muscles to chew and swallow

•Finding better positions for people to sit or hold their head while eating

•Identifying strategies to make swallowing better and safer

•Advising people on their dietary choices, including softer foods or thicker drinks

All students in traditional programs carrying 12 semester hours or more with a term GPA from 3.2 to 4.0 may qualify for one of these academic honors. Neutral credit hours are excluded from the calculation and reduce the course load used to figure the honor. The President's List requires a 4.0 grade point average for the semester; Dean's List ranges from 3.5 to 3.99; and the Honor Roll is 3.2 to 3.49.

Local, area students receive academic honors at MNU



HAYS – Fort Hays State University has selected third-generation alumna Tammy Wellbrock, who is also a university instructor and a current member of the FHSU Foundation Board of Trustees, as its interim alumni association director.

Wellbrock will succeed retiring Director DeBra Prideaux, who served as director of alumni and government relations for 23 years. Wellbrock will assume her duties on June 8.

FHSU President Tisa Mason said she believes the university has found the right person to guide the Alumni Association.

“Tammy Wellbrock is well known and highly respected among FHSU alumni, donors, and the Hays community,” said Mason. “She has served our university in a variety of roles over the years and has a very keen understanding of the value of Fort Hays State University to the people we serve. I am very grateful Tammy agreed to lead our Alumni Association during this important period of transition.”

“When President Mason reached out to me, I was so honored and humbled by her request to serve,” Wellbrock said. “To return to the Alumni Association at this point in my career is an opportunity I could not refuse. I basically bleed black and gold.”

The former president of the Hays Area Chamber of Commerce, Wellbrock’s leadership garnered the Hays Chamber national recognition as one of three finalists for the National Chamber of the Year award from the American Chamber of Commerce Executives. She plans to spend much of this upcoming year listening and learning from alumni, donors, and the Alumni Association staff.

“If my experience and education has taught me anything, many challenges can be overcome and most strategic directions can be identified through thoughtful listening and healthy dialogue,” Wellbrock said. “Whatever direction the Alumni Association takes after this year, it won’t be solely dictated by me.”

After leaving her post as chamber president, she started her own professional training and coaching business, Girl Twin Solutions, LLC, and last fall she was elected to the USD 489 Board of Education for a four-year term.

Wellbrock holds two communicationsdegrees from FHSU, a B.A. in 1994 and an M.S. in 2002. In 1994, she received the university’s Torch Award as the outstanding graduating senior, an award sponsored by the Alumni Association.

She served as the assistant alumni director at FHSU from 1997 to 2001. Since 2008, Wellbrock has served as an adjunct instructor, teaching both on-campus and online classes. She also serves on the provost’s Adjunct Faculty Advisory Committee.

Wellbrock’s husband, Gerard Wellbrock, is also an FHSU alum (B.A., 1990). He currently serves as the “Voice of the Tigers” calling FHSU games on the radio. Their son, Garrett, is a junior at Hays High School.

The Saline County Health Department does not have any additional cases of COVID-19 to report today.

The Health Department continues to actively monitor two cases who are isolated at home. The rest have met the criteria necessary to be considered recovered and have been released from daily monitoring and isolation.

KDHE reported the following in their release and can be found at <a href="http://www.kdheks.gov/coronavirus">www.kdheks.gov/coronavirus</a>:

•A total of 9,719 cases with 208 deaths reported.

•There have been 85,230 negative tests conducted at KDHE and private labs.

•The age range is 0 years to 100 years (median 41 years).

•The Saline County Health Officer issued a press release today outlining the reopening plan and phases moving forward. This plan will be presented to the Board of Health (County Commissioners) at their meeting on Tuesday, June 2nd at 9am for further discussion.

Progression to the next phase will be measured by monitoring our testing rates, COVID-19 hospitalizations, ability to contact trace, and availability of personal protective equipment. Here is what you can do to help reach reopening milestones:

•Continue to follow the county restrictions in place

•Maximize physical distance (6 feet or more) in public settings

•Avoid socializing with large groups

•High-risk individuals should only leave the house for essential needs

•Check-in (via phone/letter/text/email) with friends and family who are isolated

Police investigating aggravated assault Thursday

As restrictions begin to be lifted for the COVID-19 pandemic throughout the community, Salina Regional Health Center will make changes to its policies as warranted. Beginning Monday, inpatients at the hospital will be allowed to designate one consistent visitor to see them in their rooms.

Exceptions would be that no visitors will be permitted for patients in isolation or those who have a positive COVID-19 diagnosis.

• Visitors will be screened for COVID-19 infection risk along with all others who enter the facility.

• Visitors will be given a Visitor Identification Bracelet, which will be replaced daily.

• Visitors will be asked to wear a mask throughout the visit including in hallways, public areas and the&nbsp;patient’s room.

• Visitors should remain in the patient’s room as much as possible.

• Visitors will be able to access the hospital cafeteria, with the use of a mask, to pick up food and take it back to the patient’s room. Visitor meals also can be delivered to patient rooms for the cost of the meal.

• Visitors are encouraged to bring their own mask to wear to preserve the hospital’s supply for healthcare needs.

Family members, friends and loved ones are encouraged to continue to utilize electronic means to keep in touch with patients including the use of Zoom, Skype, FaceTime and other social media. Guest WiFi is available throughout the hospital.

SRHC: Limited visitors for inpatients begins Monday

A No Justice No Peace protest march is scheduled for Sunday in the downtown Salina.

Organizer Miranda Bachman told Salina Post that the protest march is scheduled to begin at noon Sunday in the parking lot of The Temple, 336 South Santa Fe Avenue. Those participating will then walk to the City-County Building, 300 West Ash Street, and on to the Salina Police Department, 255 North 10th Street, before returning to The Temple parking lot.

“In light of recent events involving the murders of Ahmaud Arbery in Georgia and George Floyd in Minneapolis, Minn., people are just down right mad,” Bachman said. “White people have to check their white privilege and stand united against injustice in this world. Bachman said the protest is open to the public and will be a peaceful demonstration.
