Museum celebrates Cable Car Day with look at Salina's cable cars

City and county offices and facilities will be closed Monday in observance of the Dr. Martin Luther King, Jr. Day holiday.

All offices and facilities are scheduled to resume regular hours on Tuesday.

Additionally, there will not be a city commission meeting Monday.

The city's General Services Department reminds Salinans that landfill and sanitation collection crews will maintain their regular schedules, however, the Household Hazardous Waste, Salina Drive-thru Recycling Center (SDRC), and general services facilities will be closed on Monday.

Another round of free COVID-19 testing is scheduled for Saturday.

The testing will be administered at the Salvation Army, 1137 North Santa Fe Avenue from 11 a.m. to 3 p.m. Saturday.

This will be a self-administered spit test. Participants must not drink, eat, smoke, or chew gum for up to 30 minutes prior to taking the test.

The testing event is sponsored by the Salvation Army, Salina Family Health Center, NAACP of Salina, and North Salina Community Development.

Persons planning to participate in the testing are asked to enter the Salvation Army parking lot at the North Santa Fe Avenue entrance. Parking space is reserved for persons who are able to register their tests on their cellphones and for those who do not have cellphones.

Free COVID-19 testing event Saturday at Salvation Army

Customer service. That was the role which began one young woman’s career in telecommunications. Now she is leading that same company which is serving customers’ technology needs in new and innovative ways.&nbsp;

Catherine Moyer is chief executive officer of Pioneer Communications, a rural telecommunications company headquartered in Ulysses. She grew up in Ulysses and went to college in Vermont. Her first job was at Pioneer Communications, where she worked as a frontline customer service representative.&nbsp;

Pioneer is one of many local telephone companies formed across rural America in the 1940s and ’50s. Some say the rural telephone business began with a farmer stringing a copper wire from one fencepost to the next. Cooperatives and local companies were formed to offer and expand service. Pioneer Communications was founded in 1950 as the Pioneer Telephone Company.&nbsp;

Catherine went to law school at Washburn University and worked at a firm in Topeka. In 2002, the Pioneer Communications Board of Directors offered her the position of director of legal and regulatory affairs. “I promised them five years, but here I am,” Catherine said. She and her husband live in Ulysses. In 2012, she was promoted to CEO. “Great people work here at Pioneer,” she said.&nbsp;

“We’ve changed dramatically through the years,” Catherine said. “In the old days, the phone company waited for the customers to come to us. Now we have to go earn their business.”&nbsp;

In response, Pioneer Communications has expanded and modernized its network while serving its customers’ growing and varied needs. The company’s website says it’s committed to being the best internet-, TV- and phone provider in southwest Kansas.&nbsp;

Today, in addition to traditional landline telephone service, Pioneer Communications offers high-speed internet access and streaming television. “Our bread and butter used to be voice (transmission),” Catherine said. “Now it’s broadband. We are deploying a state-of-the-art network, focusing on broadband and data services.”&nbsp;

In 2019, the company made the transition from traditional cable television delivery to streaming services.&nbsp;

In addition to Ulysses, Pioneer Communications has office locations in Hugoton, Johnson, Lakin, Satanta, and Syracuse. The company serves a 5,000-square-mile region of southwest Kansas. In addition to the larger towns, that territory includes such rural communities as Coolidge, population 95; Horace, population 70; and Richfield, population 43 people. Now, that’s rural.&nbsp;

Catherine has been a strong voice for rural Internet access. She is vice chair of the national Precision Agriculture Task Force established by USDA and the Federal Communications Commission. She served on the Kansas Broadband Task Force in 2019. “We proposed legislation which didn’t get enacted due to the pandemic, but one of our key ideas is being implemented through the state highway plan,” Catherine said. “If KDOT is going to rebuild a highway, now (telecom) providers can have an opportunity to put in conduit during construction,” she said. This makes it much more practical to string fiber optic cable, for example.&nbsp;

Catherine also serves on the Board of Directors of CoBank, part of the Farm Credit System. “The Farm Credit System supports every aspect of the rural economy,” Catherine said.&nbsp;

Broadband is a vital element of that economy. “Internet access evens the playing field for rural opportunities,” Catherine said. “It makes it possible for families and businesses in rural Kansas to market products or work from home,” she said.&nbsp;

This has caused Pioneer to make an investment in providing high-speed access to families and businesses, even though it is costly. “If a business is being recruited to our region, we have pledged that broadband access will not be a problem,” she said.&nbsp;

“Rural Kansas deserves that,” Catherine said. “I’m going to the mat every day for the rural people of our region and the people of Pioneer.”&nbsp;

MANHATTAN — Kansas Farm Bureau (KFB) earned a New Horizon award for the planning and implementation of Kansas Farm Bureau Health Plans at the American Farm Bureau Federation (AFBF) virtual convention this week. 

The award recognizes states with the most innovative new programs. “It’s an honor to receive recognition for the work we do on behalf of our members,” KFB President Rich Felts says. “For too long, affordable healthcare was an obstacle for Kansas farmers and ranchers. Kansas Farm Bureau Health Plans is now covering more than 7,300 Kansans with plans that fit their lifestyles and budgets.” KFB also received Awards of Excellence in all four program areas of Advocacy; Engagement and Outreach; Leadership and Business Development; and Membership Value. Dickinson County Farm Bureau’s Ag Story Walk was one of 12 county Farm Bureau programs to receive AFBF recognition as part of the County Activities of Excellence. Jackie Mundt, Pratt County, won the Young Farmers and Ranchers (YF&amp;R) Excellence in Agriculture Award. Mundt will receive a new Ford truck and paid registration to the AFBF Fusion Conference, which will be held virtually in March. Garrett Love, Gray County, placed third in the YF&amp;R Discussion Meet; John Buttenhoff, Lincoln County, competed in the YF&amp;R Achievement Award; and Kansas-based Row Shaver Systems was a semi-finalist in the Ag Innovation Challenge. The awards are made each year to recognize agencies, organizations and individuals who provide exemplary service to victims of crime in Kansas.

Nominations are open in the following award categories:

Criminal Justice (Law Enforcement Officer, Prosecutor, Judge, Probation/Parole)&nbsp;– Individuals who made a positive contribution regarding the needs of victims or offender accountability within the criminal justice response should be nominated for this award.

Bradbury</a>&nbsp;said. The FAA's Center of Excellence for UAS is advancing the administration's transportation and economic goals that air travel provides to the nation. The&nbsp;<a href="https://www.faa.gov/about/office_org/headquarters_offices/ang/grants/coe/facts/">Center of Excellence UAS universities</a>&nbsp;received a total of $5,822,990 to advance specific goals and projects. "These universities are making great strides in advancing our efforts to safely and efficiently integrate UAS into our nation's airspace system," said&nbsp;<a href="https://www.faa.gov/about/key_officials/dickson/">FAA Administrator Steve Dickson.</a>&nbsp;"Each grant is designed to explore the questions that will lead to greater UAS and unmanned air carrier integration, which will ultimately deliver new transportation solutions and economic benefits for the American people."

More than&nbsp;<a href="https://www.faa.gov/uas/">1.7 million recreational and commercial drones</a>&nbsp;are in the active UAS fleet. That number is expected to grow to as high as&nbsp;<a href="https://www.faa.gov/uas/resources/by_the_numbers/">2.31 million by 2024</a>. The ASSURE grants are aimed at continuing and enhancing the safe and successful integration of drones into the nation's airspace system (NAS). The FAA has established 13 Centers of Excellence in critical topic areas focusing on: unmanned aircraft systems; alternative jet fuels and environment; general aviation safety; commercial space transportation; airliner cabin environment and intermodal transportation research; aircraft noise and aviation emissions mitigation; advanced materials; general aviation research; airworthiness assurance; operations research; airport pavement and technology; computational modeling of aircraft structures; and technical training and human performance. The first round of ASSURE grants for Fiscal Year (FY) 2021 were awarded for the following eight (8) research areas. Air Carrier Operations&nbsp;- Investigate and Identify the Key Differences Between Commercial Air Carrier Operations and Unmanned Transport Operations This research will provide findings, recommendations and lessons learned that will enhance the FAA's understanding of the requirements for certifying large UAS for air carrier operations. Specific focus of this evaluation will analyze projected demand by location (e.g. rural, exurb, suburb, or urban) and the feasibility of commercial UAS air carrier operations. It will also explore the role of autonomy in UAS vehicles beginning with operations in less risky areas such as rural locations to exurbs (areas beyond the suburbs), and then on to more populated areas of suburban and metro areas. This exploration will focus on the passenger transportation environment, and investigate the workforce impact of this new capability.

Since sUAS are not similar to any other foreign body (e.g. bird, ice, volcanic ash) that the FAA currently regulates, understanding the severity of an ingestion is critical to being able to estimate the extent of potential damage.

Area students receive academic honors from MidAmerica Nazarene

4-H and FFA youth encouraged to join the virtual series&nbsp;

MANHATTAN – Kansas State University officials have announced they will offer two junior producer weeks virtually this year.&nbsp;

The Junior Swine Producer Week is scheduled for Feb. 15-20, and the Junior Meat Goat Producer Week is set for March 15-20. Both events are hosted by the K-State Youth Livestock Program, K-State Research and Extension, and the Department of Animal Sciences and Industry.&nbsp;

The sessions will be led by K-State faculty members, graduate students, veterinarians, extension agents, guest speakers and specialists.&nbsp;

All ages are welcome, but attendees – youth and adults -- must register online by Feb. 8 or March 8, depending on which event they plan to attend. Participants will be required to provide an email address that is checked routinely, so that organizers can share links and other details.&nbsp;

Organizers say the events are free this year due to support by sponsors. These are biennial events; swine and meat goat days are held in odd years, while sheep and beef days are held in even years.&nbsp;

The Salina Art Center is seeking submissions from visual artists for the juried exhibition Small Gestures of Repair.&nbsp;&nbsp;

"How has 2020 changed you? How are you processing all of this? How can we find commonality, and what small gestures will help us heal?&nbsp;&nbsp;2020 has been a year that has challenged us: A global pandemic, forest fires, racial unrest, economic crisis, a contentious election, and murder hornets. As 2020 comes to a close and we reflect on all that has happened it becomes apparent that these small gestures of repair are needed now more than ever," the art center noted in a news release.

Small Gestures of Repair will be on display at Salina Art Center April 21-May 30.

We often use our free speech rights at the top of our lungs and in public spaces to protest loudly, proudly and prominently.

When we do that, the First Amendment protects us from government punishment or censorship for what we say or write, particularly on matters of politics and public affairs — generally. Still, not everything we say or do because of such speech is protected.

Over decades, legal guardrails have been set up that indicate where our free speech rights end and where government may be able to step in to penalize speakers or prevent protests and demonstrations. Those guardrails are deliberately limited.

Let’s start by noting the First Amendment offers no legal shield from criminal prosecution for violent acts, individually or as part of a mob, regardless of the cause we might promote or a political position we take. Violence is a crime.

Our free speech rights also do not protect incitement to imminent violence. The key here is a connection to an immediate threat to public safety. In a&nbsp;<a href="https://caselaw.findlaw.com/us-supreme-court/395/444.html" target="_blank">1969 decision</a>, the U.S. Supreme Court said there is no First Amendment protection for speech that is “directed to inciting or producing imminent lawless action and is likely to produce such action.”

A speaker who demeans a group of people to a crowd, and then points to someone and shouts “There’s one now, go get ’em!” steps outside of free speech protection. But when the violence takes place sometime later, or elsewhere, or the words are not so direct, prosecutors may find it difficult to establish such a direct link.

That task of linking words to actions will confront those who favor criminal charges for incitement against&nbsp;President Donald J. Trump&nbsp;for his Jan. 6 speech to supporters, who then moved the 16 blocks from his rally near the White House to Capitol Hill, where some then violently invaded the U.S. Capitol.

“After this, we’re going to walk down and I’ll be there with you,” Trump said. “We’re going walk down to the Capitol, and we’re going to cheer on our brave senators, and congressmen and women. We’re probably not going to be cheering so much for some of them because you’ll never take back our country with weakness. You have to show strength, and you have to be strong.”

Before Trump spoke, his attorney,&nbsp;Rudy Giuliani,&nbsp;called for “trial by combat.” The courts also have debated whether criminal charges around incitement can be brought for what is called “instructional speech” — for example, producing written materials advising on plans or offering tips to a group planning violent acts. In deciding not to review a lower court decision in 2002, justices offered differing views on whether such instruction could meet the “imminent lawlessness” requirement.

In November, the U.S. Supreme Court ordered a lower court to again hear a case involving&nbsp;DeRay Mckesson, a Black Lives Matter organizer who was sued by a Baton Rouge, La., police officer injured at a protest Mckesson organized in 2016. The lawsuit ultimately could have dramatic dampening impact on public protest if the courts decide organizers can be held personally liable for violence by anyone at an event, under the theory that organizers should have known it was a likely outcome.

What other legal issues swirl around protests and demonstrations?

Courts ruled during the anti-war protests in the 1960s and later that authorities cannot block or disperse protesters just because authorities have an unspecified concern about potential disorder, or because demonstrators are loud or offensive, or even if they temporarily disrupt traffic.

In 2011, the Supreme Court upheld&nbsp;<a href="https://www.uscourts.gov/educational-resources/educational-activities/facts-and-case-summary-snyder-v-phelps" target="_blank">the right to public protest on matters of public interest</a>&nbsp;in a case involving a family-based Kansas church known for its controversial — many say repugnant — anti-gay protests at military funerals. The Westboro Baptist Church was sued by the parents of a U.S. Marine who died in Iraq, claiming intentional infliction of emotional distress.

Chief Justice John Roberts&nbsp;wrote that such protest was protected by the First Amendment: “Speech is powerful. It can stir people to action, move them to tears of both joy and sorrow, and — as it did here — inflict great pain … we cannot react to that pain by punishing the speaker. As a nation we have chosen a different course — to protect even hurtful speech on public issues to ensure that we do not stifle public debate.”

At times, authorities seek to simply ban all public events. Washington D.C.&nbsp;Mayor Muriel Bowser&nbsp;has asked the U.S. Interior Department to cancel all permits for “public gatherings” in the city, citing both the Capitol riot and COVID-19 health concerns. In dealing with the pandemic, local and state officials nationwide have placed limits or banned a variety of group events, protests and religious services. Health officials cite a 1905 Supreme Court ruling that&nbsp;<a href="https://www.law.cornell.edu/supremecourt/text/197/11" target="_blank">upheld the government’s quarantine (and vaccination) powers.</a>

A guiding principle in the nation’s history is that government at any level can only infringe on our First Amendments rights by showing an overriding need, such as an immediate threat to public safety, and then only in ways that are the least possible intrusion for the shortest time required to meet the need.

We need to be alert and demand that authorities balance public safety and First Amendment rights in the upcoming days and weeks. The core freedoms that protect us cannot be left unprotected by us.

FIRST FIVE: The First Amendment right to protest has limits

Today is Saturday, Jan. 16, the 16th day of 2021. There are 349 days left in the year. 

On Jan. 16, 2020, the impeachment trial of President Donald Trump opened in the Senate, with senators standing and swearing an oath of "impartial justice." Trump again denounced the proceedings as a "hoax," while House Speaker Nancy Pelosi said new evidence reinforced the need to call additional witnesses. 

In 1865, Union Maj. Gen. William T. Sherman decreed that 400,000 acres of land in the South would be divided into 40-acre lots and given to former slaves. (The order, later revoked by President Andrew Johnson, is believed to have inspired the expression, "Forty acres and a mule.") 

In 1912, a day before reaching the South Pole, British explorer Robert Scott and his expedition found evidence that Roald Amundsen of Norway and his team had gotten there ahead of them. 

In 1919, pianist and statesman Ignacy Jan Paderewski became the first premier of the newly created Republic of Poland.

In 1920, Prohibition began in the United States as the 18th Amendment to the U.S. Constitution took effect, one year to the day after its ratification. (It was later repealed by the 21st Amendment.)

JEWELL COUNTY —One person was injured in an accident just before 1p.m. Friday in Jewell County.

The Kansas State Highway Patrol reported a 2020 International semi driven by Gary George Langley, 60, Rye, CO., was eastbound on U.S. 36 just east of 260 Road approaching the crest of an overpass.

Due to high wind, the trailer of vehicle began to overturn. The whole unit overturned and came to a rest on the passenger side.EMS transported&nbsp;Langley to the Jewell County Hospital. He was properly restrained at the time of the accident, according to the KHP.
