Saline County Jail Bookings, Feb. 22

On Feb. 22, 1980, the “Miracle on Ice” took place in Lake Placid, New York, as the United States Olympic hockey team upset the Soviets, 4-3. (The U.S. team went on to win the gold medal.)

In 1630, English colonists in the Massachusetts Bay Colony first sampled popcorn brought to them by a Native American named Quadequina for their Thanksgiving celebration.

In 1732 (New Style date), the first president of the United States, George Washington, was born in Westmoreland County in the Virginia Colony.

In 1784, a U.S. merchant ship, the Empress of China, left New York for the Far East to trade goods with China.

In 1935, it became illegal for airplanes to fly over the White House.

In 1959, the inaugural Daytona 500 race was held; although Johnny Beauchamp was initially declared the winner, the victory was later awarded to Lee Petty.

In 1967, more than 25,000 U.S. and South Vietnamese troops launched Operation Junction City, aimed at smashing a Vietcong stronghold near the Cambodian border. (Although the communists were driven out, they later returned.)

In 1987, pop artist Andy Warhol died at a New York City hospital at age 58.

In 1997, scientists in Scotland announced they had succeeded in cloning an adult mammal, producing a lamb named “Dolly.” (Dolly, however, was later put down after a short life marred by premature aging and disease.)

In 2016, the City Council of Charlotte, North Carolina, voted 7-4 to pass a new law allowing transgender people to choose public bathrooms that corresponded to their gender identity.

What does the law actually say when it comes to a young person’s right to privately decide what gender they identify with, and to their parents’ right to engage in or even direct the decisions they make? As usual, the law is a lot more ambiguous and contentious than many might wish.

Recently Dion Lefler--arguably the best-known journalist in Wichita, Kansas’s largest city-- picked a fight with Kansas’s Attorney General Kris Kobach--arguably the best-known politician in the whole state--over essentially this issue, and Kobach picked back. Let’s focus on the heart of their argument, and see what we can clarify.

Last December Kobach sent a letter to six Kansas school districts regarding policies which allegedly require teachers of students who identify as trans or non-binary to avoid revealing information about the students’ self-identification to their parents unless the students give consent. In his letter, Kobach cited multiple Supreme Court cases defending “parents' right to direct the care, upbringing, and education of their children,” and implied that he would treat these policies as a violation of those constitutional rights.

With the news of this letter became public, Lefler called Kobach a “bully,” and said that seeking to intimidate school districts into abandoning these policies was “endanger[ing] transgender kids without legal grounds.” His claim about the absence of any specific legal ground is correct: while a bill was proposed in the Kansas legislature last year that would have extended parental rights in this exact context, it died in committee, and so these policies do not violate any current state law.

But Kobach responded that his job was to “protect the constitutional rights of Kansans in court, regardless of whether the Kansas Legislature has passed any statute on the subject,” and this is also correct: Kansas officials swear to uphold the U.S. Constitution as well as our state one, after all. So the real question is: what is the merit to Kobach’s conviction that the U.S. Constitution, as presumably reflected in the multiple Supreme Court cases which he cites, is on his side?

It is true that federal cases stretching back a century establish that parents have a fundamental right to make decisions about the education of their children. However, none of them are directly applicable to the present debate over names, pronouns, and privacy. Moreover, other cases insist that parents have to demonstrate a harm which “strike[s] at the heart of parental decision-making” before public schools, which are required by federal law to consider the needs of all students equally, can be forced to change policies which had been legally decided upon.

In his response to Lefler, Kobach did mention one Kansas case that was directly on point—a 2022 federal district court decision which forbade Geary County’s USD 475 from enforcing a policy to not share private information regarding a student’s gender identification because it violated how the student’s teacher understood her religious faith. Why didn’t he mention that case in his original letter? Likely because he knows there are other federal district court decisions (like Massachusetts’s Foote v. Town of Ludlow) which have taken up nearly identical cases and found for the school district instead. In the end, the Supreme Court will have to decide.

In short, what is being fought about is unsettled law. I think there’s a good chance the Supreme Court will end up agreeing with Kobach’s particular application of these constitutional precedents—but for now, his letter reflects cultural assumptions rather than controlling principles. Round one, therefore, goes to Lefler.

What the Constitution Says, and What it Doesn’t (Yet)

The City of Salina has been notified that it has been
named as a defendant in a federal district court civil lawsuit
challenging the constitutionality of certain aspects of the City’s
sign code and its application to a partially installed painted wall
sign at The Cozy Inn. Although the City believes its current sign
code enforcement is legally justified, there have been ongoing
conversations about The Cozy Inn sign as well as possible policy
changes the community may wish to undertake while providing
for the administration of any proposed exceptions or policy
changes in a fair and impartial manner community-wide.


In establishing sign regulations, communities are
attempting to set up a set of standards that can be equally and
fairly applied across all property owners, businesses, tenants,
etc. that are within the same zoning district. Nationwide, this has
frequently resulted in regulations similar to what Salina has in
place that establish a ratio of signage numbers and size based
on building or street frontage to maintain a level of proportionality
to the building.


The City of Salina has been very deliberate and
consistent in its regulation of signs in the community in light of
the applicable case law regarding the standards by which signs
and commercial speech may be regulated. The City believes its
sign code and administration of the sign code are compliant with
the volume of court cases that exist on this topic. Over the last
decade, the regulation of signage and public art has become an
increasingly challenging discussion for communities across the
United States because of differing opinions on what is art and
what is commercial signage.


The City previously committed to enlisting the services of
a sign code consultant as a subject matter expert to assist with
conducting community listening sessions and drafting possible
policy-based amendments for further consideration in response
to community input that is received. Wendy Moeller,
Principal/Owner of Compass Point Planning, has been retained
by the City and 5 stakeholder meetings were held on February
15th &amp; 16th including a public listening session for the public at
large.


There will be additional public meetings conducted as part
of this project. Interested parties can email questions and
comments to signs@salina.org. They may also receive project

City of Salina issues statement regarding lawsuit on Cozy Inn

A violent offender led Salina Police Department officers through downtown during a police pursuit on Tuesday.

The Kansas Department of Corrections notified SPD officers that it needed assistance in arresting 40-year-old Jason Michael Lynn, whom KDOC special agents described as a violent offender.

According to SPD Capt. James Feldman, KDOC contacted the department at 12:30 p.m. Tuesday, Feb. 20, about Lynn and said he had violated his parole orders. 

"Special agents observed him leaving a residence in the 400 block of West Ash Street," Feldman said. "Officers arrived in the area, and the subject was leaving in a 2012 Toyota Prius. Officers attempted to stop him, but he failed to stop, and we had a pursuit."

Officers attempted to stop the vehicle on Ash Street, but Lynn drove away and led officers throughout downtown before crashing into a house on East Iron Avenue.

Feldman said the pursuit did not reach high speeds through most of its duration, remaining around the posted speed limits, but when Lynn traveled eastbound on Iron Avenue, he reached 50 to 55 mph.

After the Prius struck the home, SPD officers arrested Lynn and requested charges for felony flee and elude, felony damage to property, reckless driving and driving while suspended.

The crash did not seriously injure Lynn; no one was home when he wrecked the Prius. Feldman said the house did not sustain any severe damage.

Salina Police Department officers reported to Central Mall yesterday evening for a report of a battery at the AMC Theatres. When officers arrived, they found another crime unfolding in the parking lot in front of Dunham's Sports.

According to SPD Capt. James Feldman, officers dispatched to the Central Mall at 6:20 p.m., and once they arrived, they communicated with a 14-year-old boy and his parents about a possible criminal threat.

"It was reported that the male [the 14-year-old boy] had been on the other side of the mall when he and several friends began being chased around the mall by three other subjects," Feldman said. "While running, he ended up calling his mother saying he's being chased and then he went into Dunham's."

Feldman said shortly after the boy called his mother, she arrived and told her son to exit the store and meet her in the parking lot. Once he left Dunham's, one of the three subjects, a 17-year-old boy, confronted him.

The mother and stepfather of the boy then stepped between the two children to de-escalate the confrontation when the 17-year-old began threatening the family.

"He began making threats toward them, including that he knows where they live and he will get them," Feldman said. "At the time, he was wearing a backpack and reached in like he had a gun."

As the 17-year-old subject heard sirens, he ran from the scene north into a residential area. Feldman said an off-duty detective who heard the sirens nearby eventually apprehended the suspect and found no gun in the backpack on his person.

"No gun was located, and it is believed that no gun was involved," Feldman said. 

The boy did not resist arrest, and officers requested charges of aggravated assault, criminal threat, battery and possession of marijuana and drug paraphernalia.

After his arrest, officers transported the boy to juvenile detention in Junction City. Feldman said there may be future arrests related to this case.

SPD arrests teen at Central Mall for criminal threat and battery

On Tuesday, February 20, Smoky Hill, LLC of Salina began replacing the medians on Broadway at the Crawford, South, and State Street intersections.

According to a release from the City of Salina existing asphalt curbs and medians will be replaced with concrete curbs and stamped and colored concrete medians. The medians between South and State will also be shortened to increase access. 

The work begins at the Crawford intersection and proceeds north.

The work will be completed with lane closures on each side of the median where work is occurring. Motorists should expect minor delays; through traffic is encouraged to utilize alternate routes during construction.

Weather permitting, the work is expected to last three months.

While continually building his musical legacy, Nash is also an internationally renowned photographer and visual artist whose work has been shown in galleries and museums worldwide. The Salina Senior Theatre Project will be holding auditions for their upcoming production,&nbsp;MERNIE'S LITTLE HOAX, a&nbsp;comedy by Carol A. Nimmons.

Mernie Mayhem is a mischievous millionaire. With only one possible heir whom she’s never met, she concocts a plan to determine which of her friends might be worthy of inheriting her wealth. She unexpectedly winds up the victim after her fake demise backfires through crazy shenanigans plotted by a network of unpredictable retirees.

There are eight female and two male roles available. Auditions will be held Monday, Feb. 26, and Tuesday, Feb. 27, at 7 p.m. at the Hawthrone Clubhouse, 715 North 9th, for anyone 55+ or older. Salina Senior Theatre Project calls for auditions for Mernie's Little Hoax

Last week, a local realtor contacted the Saline County Sheriff's Office after discovering a break-in and burglary at one of the homes listed with their company.

According to County Sheriff Roger Soldan, sometime between Thursday, Nov. 23 and Monday, Feb. 12, an unknown suspect entered an unoccupied residence at 4109 E. North Street just east of Salina.

"This house has been for sale for some time," Soldan said. "Someone got in the house and stole a brand new Kenmore 50-gallon water heater that had been put in the residence, trying to sell it — valued at $800."

Soldan said the realtor contacted deputies after finding drag marks in the kitchen after they went to check on the home.

The burglar also ransacked the basement for copper pipe and electrical wiring, totaling the estimated damages to the home around $5,000.

Saline County Sheriff's deputies continue investigating the crime but have not named any suspect in connection with the burglary.

Today in History, Feb. 21

Sometime between 3 and 9:30 p.m. on Sunday, Feb. 18, an unknown suspect stole $600 worth of Barbie dolls from a residence in Salina.

According to Salina Police Department Capt. James Feldman, the suspect, only stole a collection of Barbie dolls placed on a shelf in the home.

"No forced entry was observed," Feldman said. "[The suspect stole] 20 to 25 Barbies... valued at $600 total."

Feldman said the report did not include if the Barbie dolls were on display but that most were dolls from the Barbie Holiday Collection.

The home did not have surveillance cameras, so no video footage of the crime was available for evidence. SPD officers continue to investigate the burglary.
