RUSSELL — The final performances of Ad Astra Music Festival’s 2020 virtual season take place this weekend. 

The festival continues to bring outstanding music to its audience by streaming performances free of charge on its Facebook page (@adastramusicfestival).
Music lovers from across the globe can enjoy these final concerts without ever having to leave their homes.&nbsp;

First,
on Friday at 7:30 p.m. CDT, Ad Astra presents a performance by the High School and Community Virtual Choirs. Ad Astra is proud to have given high school students from around the world the opportunity to perform a
cappella pop and jazz arrangements in small groups. Over
the course of two weeks, the students were led by industry professionals to explore the styles, trends, and approaches to this genre. When asked about her experience with this program, Caitlin Leiker, a senior at Hays High School, said “The A
Cappella Intensive was such a fun and engaging learning experience!
I feel like Ad Astra is really rising above the odds by finding new ways to overcome our world’s circumstances through collaborative projects such as this. I know I can speak for the other participants by saying how much we appreciate the time and effort that
went into it. After participating in other virtual attempts to recreate the choir experience, Ad Astra provided something the others didn’t—connection.” Following the High School Virtual Choir, the Russell Community Choir will sing the finale to the night’s
performance. Tune in to be inspired by the next generation of musicians.

Finishing
off the 2020 virtual season on Saturday at 7:30 p.m. CDT, Ad Astra presents “Trudy Furney Opera: A Sneak Peak.” We commissioned composer Anna Pidgorna and librettist Maria Reva to create an opera about the life of beloved Russell High School art teacher
Trudy Furney. The opera will be premiered in full next year at Prairiesta, but this year Ad Astra is giving its audience a sneak peak that provides a look at their creative process, complete with interviews and sketches, and culminating with a workshop performance
of scenes from the opera. Katelyn Mattson-Levy, set to play Trudy herself, said, “The more I learn about the life of Trudy, the more I learn to love the woman behind the stories. Her legacy is still fresh in the minds and hearts of students and her community,
and this opera is a portrait of those memories.”&nbsp; Don’t forget to watch the exciting finale to our 2020 season!

Ad Astra: Virtual Choirs and a Sneak Peek of the Trudy Furney Opera

Well, it finally happened…or will shortly.

The State Board of Education will decide this week whether Gov. Laura Kelly’s executive order to delay until after Labor Day the reopening of Kansas K-12 public schools will stand. It can vote yes or no. It may be the most memorable decision that the board has taken in years.

Yes, there’s been an exhaustive study by about 1,000 school officials, employees, professional associations, unions and such about the best and safest way to open schools for hundreds of thousands of public school students and the administrators, teachers, para-professionals, maintenance staff, bus drivers and volunteers who make the state’s education industry work.

That new “Navigating Change 2020” plan for just how to reopen schools as safely and possible has been approved. It creates new cadres of students: full-time at school buildings, part-time at school buildings and purely off-site students who will learn through the Internet and dropped-off at home study materials.

COVID-19 has made everything complicated: spacing of desks, masks, hourly handwashing, and more temperature-taking than anyone ever expected. Oh, and making sure that those at-home students actually spend time studying. That’s 465 hours a year for kindergarten students and more than 1,000 hours of actual school work for older students.

But the issue that will put the State Board in the headlights is simply “when.”

The 10-member board, eight Republicans, two Democrats, will have five seats up for election this year. Three of those five seats up for election are uncontested. Two will have primary elections and then general elections in November.

The issue of allowing the Democrat governor to say when schools can reopen isn’t just political, though parts of it are. If the governor’s executive order is accepted, then she has either protected Kansans’ lives and futures or just meddled in decisions that should be made by locally elected school boards. If the governor’s executive order is rejected, then presumably every COVID-19 illness related to schools is the State Board’s responsibility.

No, of course not, it’s not nearly that simple, but it’s how the politics of the after-Labor Day reopening will be cast, probably not heavily in the low-budget State Board campaigns, but by legislators who are seeking re-election, or election for the first time.

Of course, nothing in the Statehouse is non-political, but up to now, it’s been pretty non-political on the State Board of Education (maybe that “creation” issue earlier this century, but not much since then). And, of course, those State Board candidates are down toward the bottom of the ballot, where many voters aren’t even going to recognize the candidate names.

What’s the board likely to do? Well, lawmakers have found that it is rarely politically damaging to point to the governor and her executive orders when things go wrong or grow inconvenient, like closing tattoo parlors and beauty shops. And, when those orders go right – like those drive-through drink pickups – well, it’s something that lawmakers will follow up on next session for the publicity it will create.

The talk: that members of the board are being inundated in constituent calls and appear to be breaking about even between affirming the governor’s order and rejecting it, largely over the conservatives’ favorite argument – local control.

But it’s different on the State Board, where you are talking about children and their health and the health of their families, not just property taxes or fence law.

Curious how this one’s going to come out, and who calls it a victory and who calls it a defeat whichever way the State Board goes…

At the Rail: Who will be responsible?

The Salina Kanvas Project has released additional information about its planned mural in downtown Salina. 

The organization late last week announced on its <a href="https://www.facebook.com/Salina-Kanvas-Project-107258741011335/">Facebook page</a> the commissioning of a large-scale mural on the southern side of the HD Lee Flour Mill at&nbsp;343 North Santa Fe Avenue. The work is to be completed by world-renowned Australian artist Guido Van Helten and is planned to be finished by summer of 2021.&nbsp;The project was made possible through private donations. &nbsp;

“We are excited to have this work commissioned here in Salina”, commented Salina Kanvas Project member Travis Young. “Guido is an extremely talented artist that will help us continue to transform Downtown Salina and celebrate the spirit of this community.”

Born in Canberra, Australia, and growing up in inner city Melbourne, Van Helten was influenced at a young age by traditional urban graffiti movements. After graduating with a Bachelor of Visual Arts majoring in printmaking at Southern Cross University, he began the development of his contemporary work now closely aligned with the movement of large-scale muralism across the world.

Van Helten’s work has developed out of a strong interest in travel, photography, architecture and learning about cultures. These interests and his ability to work on large-scale projects have spurred commissions around the world, throughout Europe, Scandinavia, Asia, the United States, and Australia.

“Since 2013, my practice has evolved into an exploration of identity in connection with our urban environment inspired by an interest in architectural sociology,” Van Helten explained. “Through this, I approach mural projects using photography and community engagement to uncover the human stories that are site-specific in nature and connections to place.”

In the coming months, Van Helten will spend time in the area to engage with the citizens and culture of the city in order to develop a design that reflects the spirit of Salina.

“Salina is a great community, but we never had a ‘monument’ like this that attracts visitors to our city and is available for citizens to enjoy,” said Eric Montoy. “As a member of the Salina Kanvas Project, our hope is to have this work be a catalyst for future world-class murals and street art in the downtown area.”

“We want Salina to be a destination versus a spot to fill up with gas along the interstate,” added Young. “This will help bolster business opportunities and support the amazing institutions we already have here in Salina.”

Starting this week, the U.S. Census Bureau will begin following up with households in Kansas that have not yet responded to the 2020 Census. The current self-response rate in the state is 65.8%. The Census Bureau will need to visit the remaining addresses to collect responses in person.

Non response follow up operations begin in the Wichita Area Census Office this week. This office serves 91 counties in Kansas (see below), which includes southern, western and north-central Kansas. The remaining counties in the state are served by the office in Overland Park, where non response follow up operations will begin in August.

Census takers will be wearing masks and are trained in social distancing protocols and other health and safety guidance. The Census takers are hired from their local communities. All census takers speak English, and many are bilingual. If a census taker does not speak the householder’s language, the household may request a return visit from a census taker who does.

Census takers will record the household’s responses on a Census Bureau-issued device. If no one is home, they will leave notice of their visit and instructions on how to self-respond. Census takers can be identified by a valid government ID badge. To confirm a census taker’s identity, the public may contact the Denver/Dallas Regional Census center at (800) 852-6159.

Even though census takers will begin field work, its not too late to self-respond to the 2020 Census and limit the chances of a census taker visiting your home. You can respond online at 2020census.gov, by phone at 844-330-2020 (English) or by mailing back the paper form that was delivered to the household.

HELPING HOUSEHOLDS TO SELF-RESPOND

In order to assist people with self-responding, the Census Bureau is beginning a Mobile Questionnaire Assistance (MQA) program. This is separate from our non response follow up operation. MQA representatives will encourage people to self-respond to the 2020 Census in places where people naturally visit. Locations will include grocery stores and markets, food banks, laundromats, restaurants and grab-and-go eateries, unemployment offices, back to school drives, places of worship and libraries.

The local census response representatives will help people complete the census on a 2020 Census tablet or on their own device, while practicing state and local social distancing protocols. The Census Bureau is selecting where to provide MQAs based on local response rates and public health conditions. The MQA program will run through mid-September.

ADDITIONAL REMINDER COMING IN THE MAIL

An additional reminder postcard will be sent to households that haven’t yet responded to the Census. It is scheduled to arrive between July 22 and July 28. The start of census taker visits was delayed from mid-May to mid-August, giving the Census Bureau the opportunity to send one more reminder to households to encourage them to respond online, by phone or by mail. Responding now minimizes the need for census takers to visit homes to collect responses in person.

Saline County Commissioners are scheduled to consider extending the county's declaration of a state of local public health emergency during their meeting Tuesday.

The meeting is scheduled to begin at 9 a.m. Tuesday in room 107 of the City-County Building, 300 West Ash Street.

During last week's meeting, Emergency Management Director Michelle Barkley reminded commissioners that the county's emergency declaration is set to expire this week. Barkley told commissioners that she would be requesting an extension of that declaration on Tuesday because of the uptick in COVID-19 cases to ensure Saline County remains eligible to continue to receive resources from state and national sources.

Other items on the county commission agenda for Tuesday include the following.

•Consider Central Kansas Mental Health Center's request to seek local govemment approval to apply for and receive the 2020 Emergency Solutions Grant. According to information in the county commission meeting packet, the organization is applying for funds to assist persons to rapidly re-house individuals experiencing homelessness especially if they do not qualify for housing authority programs. "The purpose is to support these individuals until self-suffciency or until mainstream vouchers are available to qualify for housing through the Housing Authority," the meeting packet information noted.

County to consider extending emergency declaration

WICHITA – Travelers yearning for adventure, yet not ready or able to travel due to COVID-19 issues, can get a taste of what it would be like to be on an African safari via a LIVE one-time virtual event, hosted by AAA and Africa Travel. 

The event will feature a live “Safari Sundowner” experience, an African tradition of enjoying food and drinks at sunset, this one showcasing elephants from Jabulani Safari Lodge in South Africa.

Amy Short, Director of Strategic Partnerships at AAA and a co-host of the event, recognized the need for travelers to make meaningful connections with their dream destinations and created a series of events to provide a way for the exploration of exotic destinations from the comfort of home.

AAA to host live virtual safari at sunset with SA elephants

MCPHERSON -- The McPherson County Health Department today reported three additional confirmed cases of COVID-19, bringing the count total to 112.

The most recent cases are as follows, according to the health department.

Positive case No. 110 is a symptomatic female in her 50s with unknown exposure and is recovering at home.

Positive case No. 111 is a symptomatic female in her 60s with known exposure and is recovering at home.

Positive case No. 112 is a symptomatic male in his 20s with known exposure and is recovering at home.

Of the 112 confirmed cases, 98 have met Kansas Department of Health and Environment recovery guidelines, according to the health department. Currently no active cases in McPherson County are hospitalized and the county has reported no COVID-19 related deaths, the health department noted.

There are 33 new positive COVID-19 cases in Saline County that have been identified since the Friday, July 17 report. The total for the county is now 301, with 153 cases that are actively being monitored by the Health Department, 145 that have recovered, and 3 deaths. The last update we received from Salina Regional Health Center reported 5 patients are admitted to their hospital with COVID-19.

Saline County has launched a new dashboard that outlines demographic information regarding the COVID-19 health emergency. This dashboard is available on both desktop and mobile platforms. The dashboard will be updated on Mondays, Wednesdays, and Fridays by 5 pm. There are links to each dashboard on our website as well.

Saline County: 33 new COVID-19 cases; total at 301

A pickup stolen from just west of north Salina was found burning west of the city Friday night.

Saline County Sheriff Roger Soldan said this morning that deputies and firefighters from Rural Fire District No. 3 were sent to the 400 block of South Muir Road at 10:25 p.m. Friday for the report of a vehicle on fire. A resident who lived nearby noticed the fire while he was on his way home and notified authorities, he said.

When emergency personnel arrived, they found a 2012 Dodge pickup fully engulfed in flames, he said. The pickup belonging to William Davis, of Salina, was valued at $25,000, Soldan added.

According to Soldan, the pickup was last seen at 7 a.m. Friday when it was parked in a lot in the 1500 block of West North Street.

 </figure>A pickup stolen from just west of north Salina was found burning west of the city Friday night.Saline County Sheriff Roger Soldan said this morning that deputies and firefighters from Rural Fire District No. 3 were sent to the 400 block of South Muir Road at 10:25 p.m. Friday for the report of a vehicle on fire. A resident who lived nearby noticed the fire while he was on his way home and notified authorities, he said.<figure>

My university colleagues in China, except for three localities, have gone back to full regular classes. They usually have two months of summer vacation, but this year it will only be three weeks. They extended the spring semester into July and will begin fall semester a week early in order to catch up. &nbsp;

Face-to-face schools are also resuming in Taiwan, South Korea, Japan, Vietnam, New Zealand and Germany. Why is the rest of the world still tackling COVID-19?

A combination of three reasons has allowed them to return to some normalcy.

Nearly everyone in Asia carries a smartphone. This allowed them to use a smartphone app that everyone downloaded. It is used for instantaneous contact tracing. Each person’s phone detects and keeps the phone ID of any other person’s phone that comes within six feet. When a person is diagnosed with COVID-19, their phone can immediately notify all those who had been in that close proximity in the last five days to quarantine. It also color-codes those person’s phone with red (positive = strict quarantine), yellow (came near an infected person so go home and self isolate) and green (healthy).

This was most strictly enforced in Taiwan but works well in the other Confucian-heritage Asian countries. That is because the second factor is their strong feelings of responsibility that each person feels for others around them and especially for family and classmates.&nbsp; The golden rule proclaiming that “you should act towards others as you would want them to act toward you” was first stated over 500 years BC by Confucius and continues as a cultural value despite the various political systems involved. This also includes greater respect for the elderly and respect for teachers. Therefore we see Asian languages interpreting what we call “rights” as what their languages call “responsibilities.” They are also crowded countries with three to five times more people per area than in the U.S.&nbsp;&nbsp; They are “interdependent.”

Does that mean that on average, Asian cultures care more about others than Western cultures do. Well, yes. That is proven by how willing their populations are to shelter-in-place once a danger was understood. This was particularly true in the first two months when there were not yet tests and the smartphone app was not yet available. When our Western press interviews in Asia, they fail to comprehend the replies they receive from medical personnel about how Asians are more concerned about others and more willing to quarantine. They have been wearing face masks for decades out of concern for others around them.

But New Zealand and Germany are different. There is a larger Asian population in New Zealand than in North America or Europe, but it is not the majority. Yet, being a relatively small nation, it did succeed in a strict lockdown that eliminated cases. Now their problem is preventing the import of new cases, a problem China still faces.&nbsp;&nbsp;&nbsp; &nbsp;

However, Germany lacks the Confucian ethic and yet has done very well controlling this pandemic. Here the third critical factor is science education. For generations, Germans have received the most advanced education on human anatomy and physiology, plus disease microbiology, in public school. Therefore, the average citizen can self-refer themselves to a medical specialist when they feel ill. Germany has a scientist at the head of their government and a population that knows three times more science than Americans.

Therefore we now have Asian countries watching the international news, observing the disasters in America and Brazil and asking “Don’t they care about their fellow citizens, and especially their medical workers?”&nbsp; And we have Germany watching our news and asking “Don’t they understand science?”

By our group actions, we show that indeed a critical mass of Americans are science illiterate. We will await a vaccine as our cure-all. Except there is a problem there also. Second only to the Taliban, Americans have the highest level of anti-vaxxers, perhaps 50 percent. And that falls far short of achieving herd immunity.&nbsp;&nbsp;

An active pattern of showers and thunderstorms is in store for the first half of the work week. 

Although some strong to marginally severe storms are possible throughout the period, widespread severe weather appears low at this time, according to the National Weather Service (NWS) in Wichita. However, very heavy rain and flooding could become a concern for some areas. 

Temperatures will be cooler than in recent days, topping out near 90 each day, NWS noted.

NWS: A wet start to the work week

A South Salina manufacturing company is missing a welder after someone stole it late last week.

Salina Police Captain Paul Forrester reported this morning that sometime between 2:30 p.m. Thursday and 5 a.m. Friday someone entered the welding shop of Eldorado National, 1655 Wall B, and removed a blue Miller Motic 211 welder valued at $1,700. The welder had "296" printed in white on a sticker on the top edge of the welder, he noted.

It appeared that someone had possibly climbed the fence on the property to gain access to the building, Forrester explained. There are no suspects at this time, he added.

Three people were injured in a two-vehicle accident in west Salina Saturday afternoon.

Gary Gorrell, 68, of Salina, was eastbound on West Crawford Street in a 2018 Honda CRV when he turned left onto South Broadway Boulevard and into the path of and was struck by a westbound 1994 Ford Crown Victoria driven by Garson Stanley-Boyles, 19, of Salina, according to Salina Police Captain Paul Forrester. The accident occurred at approximately 2:45 p.m. Saturday.

Gorrell and his passenger, a 69-year-old Salina woman, complained of injuries and sought treatment at Urgent Care, while Stanley-Boyles complained of facial injuries and sought treatment at Salina Regional Health Center, Forrester reported.

Both vehicles had heavy front-end damage and had to be towed from the scene, he added.

Forrester noted that Gorrell was cited for failure to yield when turning left and Stanley-Boyles was cited for an illegal tag, no insurance, and no seatbelt.

MCPHERSON -- The McPherson County Health Department late Sunday night reported five additional cases of COVID-19 that were confirmed over the weekend, bringing the county total to 109.

Positive case No. 105 is a symptomatic female in her 60s with known exposure and is recovering at home.

Positive case No. 106 is a symptomatic male in his 30s with unknown exposure and is recovering at home.

Positive case No. 107 is a symptomatic male in his 50s with unknown exposure and is recovering at home.

Positive case No. 108 is a symptomatic male in his 70s with unknown exposure and is currently hospitalized.

Positive case No. 109 is a symptomatic male in his 20s with known exposure and is recovering at home.

Of the 109 cases, 92 have met Kansas Department of Health and Environment recovery guidelines, the health department noted. No COVID-19 related deaths have been reported in the county, the health department added.

McPherson County reports five new cases of COVID-19

Various thankful signs have appeared around town, but none had thanked postal and federal employees, so Salinan Linda Ourada had one made that did just that!

"Since the pandemic started there has been other thankful signs displayed in our community but I have not seen a thankful sign to our postal and federal employees," Ourada told Salina Post.

She said she proudly displays the sign in her front yard for all to see.

With less than a month before most Kansas school districts were expecting to welcome back teachers and students for the fall semester, students, families and educators are asking when schools will actually open, what that will really look like and who will decide.

Public schools are working to address safety, reflect community needs, ensure quality learning, and help students dealing with additional challenges. Here is what we know – and don’t know – now.

Ordinarily, most decisions about school operations are made by local school boards. They make decisions about the school calendar, hiring staff, what courses will be taught and what programs operated, when and where. However, boards must follow certain state laws, such as offering at least 1,116 hours or 186 days of instruction; federal laws, like the Individuals with Disabilities Education Act; and they must negotiate certain terms of employment with teachers if there is a teacher organization.

That changed last March, when after declaring a state of emergency due to the COVID-19 pandemic, Governor Laura Kelly used her authority under state law to order all schools closed to any more than 10 people until May 29. As part of her order, the Kansas State Board of Education developed a process that allowed districts to waive the minimum days and hours requirements if they adopted “continuous learning plans” for students to receive instruction and learn either online or through lessons sent home. Districts also continued to deliver certain services like serving meals and counseling, but not onsite.

Although these efforts helped meet nutritional and other basic needs and some students continued academic progress through remote learning, there were widespread concerns. Some children lost regular contact and engagement with teachers. Some families lack internet, devices or even physical space for all children to learn online. Some teachers and families did not have the training for effective remote learning.

With the likelihood that the COVID-19 pandemic would continue into the new school year, the Kansas State Department of Education appointed a wide range of educators, parents, state and local officials and health experts to draft guidelines for school reopening. Called “Navigating Change: Kansas’ Guide to Learning and Safe School Operations,” the guidelines envisioned schools operating this year under three learning environments:

On-site&nbsp;– students and teachers will be in school with or without social distancing practices put into place.

Hybrid&nbsp;– students would be spending part of their time in the classroom and part of their time learning virtually from home.

Remote&nbsp;– students would be doing all their learning from home and not entering the school building at all.

The guide has two parts. First, it identifies the “essential” competencies or knowledge and skills students should learn at four “grade bands:” PreK- Grade 2; Grade 3-5; Grades 6-8; and Grades 9-12. The goal is to provide much clearer expectations for teachers, students and parents over what is to be taught at each level, regardless of where a child was learning. It also sets stronger accountability requirements for remote learning, including teacher check-in and daily student logs.

Second, it provides recommendations or suggestions for how to reduce the risk for COVID-19 spread when students and teachers are physically in school buildings. The document was aimed at helping students and staff be safe if learning was taking place&nbsp;at&nbsp;school; and making learning more effective if taking place&nbsp;away&nbsp;from school.

The guidelines were “accepted” by the State Board of Education last week, but it is important to stress that, with a few exceptions, such as remote learning requirements, everything in the document was recommendations or options for local school boards, not&nbsp;requirements. The State Board action does not require local districts to do, or not do, anything not already required by state or federal law, or by state or local health restrictions.

However, on Wednesday, the same day the State Board accepted the plan, Governor Kelly, citing rising numbers of COVID cases in the state, said she would issue an executive order this Monday, July 20, that will require local districts to delay the opening of school until after Labor Day, likely Sept 9. She also said she would issue another order making parts of the Board’s guidelines mandatory, such as masks, social distancing, proper hygiene and daily temperature checks.

The details of these orders – exactly what is required or prohibited – will not be known until they are published, presumably Monday, but that will not be the end of the story.

First, due to changes in state law approved during the special session of the Legislature, any order by the Governor to close schools must be approved by the State Board of Education, so five of the 10 members could block the delay.

Second, the Legislature also approved changes that allow each county’s board of commissioners to adopt less restrictive public health orders than statewide provisions adopted by the Governor. For example, most Kansas counties opted out of the Governor’s order requiring masks to be worn in public. These provisions are new and have not been tested in court, but it appears counties could “opt out” of the Governor’s order to delay schools until September, or the proposed order on health and safety requirements for schools.

Third, if this isn’t complicated enough, the Governor’s authority to issue these orders is based on her COVID-19 disaster declaration last spring, which was approved by the Legislature only until September 15. That is past the proposed school start date, but could mean that health and safety orders, even if left intact by counties, will expire at that point. The law says any extension of that disaster declaration must be approved by a majority of legislative Leaders on the State Finance Council.

It is also worth noting that local school boards cannot be less restrictive than state or local health mandates, but they can be more so. Therefore, if the Governor’s delay in starting school is rejected by either the State Board or county commission, local boards can choose to delay the start of school on their own. Likewise, if counties reject the Governor’s statewide school health requirements, local school boards can still adopt any part of the State Board’s guidance.

However, school boards cannot be&nbsp;less&nbsp;restrictive than local health requirements. In other words, if a city or county adopts masks or social distancing or limits on gatherings, school boards are required to follow those even if they are more restrictive than state policies or guidelines.

As a result, school boards will have to continue planning for the new school year without yet knowing clearly when they can open or what requirements will be in place, and they will have to balance multiple competing demands. There is the pressure to reopen schools as soon as possible to allow onsite learning and services, student socialization and activities and custodial care so parents can return to work. On the other hand, an unknown number of parents and staff are afraid it is still too dangerous to go back to school, especially if it is not yet clear what safety measures will actually be implemented, and COVID-19 cases are still rising. Students have the option to attend other schools (like home schooling or virtual programs), and staff can request different assignments, request accommodations, resign or retire. Some families and staff will only want to return if strict procedures like masks are in place; others may strongly oppose wearing masks. Changing classroom arrangements, student schedules and hybrid learning are designed to make buildings safer, but could put additional stresses on families and school budgets.

The Kansas education system was designed to spread out governing power, provide checks and balances (like a strong, independent, elected State Board of Education) and local control (cities, counties and school boards) to respond to different local circumstances, needs and values. We are part of a living lesson on how that works.

To answer the questions about when schools will open and what that will mean, local school boards will be influenced by decisions of the Governor, Legislature, State Board and local governments. But they will have to make most of the decisions based on how to deliver the best education to the most students in the safest possible ways for their community.

It also sets stronger accountability requirements for remote learning, including teacher check-in and daily student logs.Second, it provides recommendations or suggestions for how to reduce the risk for COVID-19 spread when students and teachers are physically in school buildings. The document was aimed at helping students and staff be safe if learning was taking place&nbsp;at&nbsp;school; and making learning more effective if taking place&nbsp;away&nbsp;from school.The guidelines were “accepted” by the State Board of Education last week, but it is important to stress that, with a few exceptions, such as remote learning requirements, everything in the document was recommendations or options for local school boards, not&nbsp;requirements. The State Board action does not require local districts to do, or not do, anything not already required by state or federal law, or by state or local health restrictions.However, on Wednesday, the same day the State Board accepted the plan, Governor Kelly, citing rising numbers of COVID cases in the state, said she would issue an executive order this Monday, July 20, that will require local districts to delay the opening of school until after Labor Day, likely Sept 9. She also said she would issue another order making parts of the Board’s guidelines mandatory, such as masks, social distancing, proper hygiene and daily temperature checks.The details of these orders – exactly what is required or prohibited – will not be known until they are published, presumably Monday, but that will not be the end of the story.First, due to changes in state law approved during the special session of the Legislature, any order by the Governor to close schools must be approved by the State Board of Education, so five of the 10 members could block the delay.Second, the Legislature also approved changes that allow each county’s board of commissioners to adopt less restrictive public health orders than statewide provisions adopted by the Governor. For example, most Kansas counties opted out of the Governor’s order requiring masks to be worn in public. These provisions are new and have not been tested in court, but it appears counties could “opt out” of the Governor’s order to delay schools until September, or the proposed order on health and safety requirements for schools.Third, if this isn’t complicated enough, the Governor’s authority to issue these orders is based on her COVID-19 disaster declaration last spring, which was approved by the Legislature only until September 15. That is past the proposed school start date, but could mean that health and safety orders, even if left intact by counties, will expire at that point. The law says any extension of that disaster declaration must be approved by a majority of legislative Leaders on the State Finance Council.It is also worth noting that local school boards cannot be less restrictive than state or local health mandates, but they can be more so. Therefore, if the Governor’s delay in starting school is rejected by either the State Board or county commission, local boards can choose to delay the start of school on their own. Likewise, if counties reject the Governor’s statewide school health requirements, local school boards can still adopt any part of the State Board’s guidance.However, school boards cannot be&nbsp;less&nbsp;restrictive than local health requirements. In other words, if a city or county adopts masks or social distancing or limits on gatherings, school boards are required to follow those even if they are more restrictive than state policies or guidelines.As a result, school boards will have to continue planning for the new school year without yet knowing clearly when they can open or what requirements will be in place, and they will have to balance multiple competing demands. There is the pressure to reopen schools as soon as possible to allow onsite learning and services, student socialization and activities and custodial care so parents can return to work. On the other hand, an unknown number of parents and staff are afraid it is still too dangerous to go back to school, especially if it is not yet clear what safety measures will actually be implemented, and COVID-19 cases are still rising. Students have the option to attend other schools (like home schooling or virtual programs), and staff can request different assignments, request accommodations, resign or retire. Some families and staff will only want to return if strict procedures like masks are in place; others may strongly oppose wearing masks. Changing classroom arrangements, student schedules and hybrid learning are designed to make buildings safer, but could put additional stresses on families and school budgets.The Kansas education system was designed to spread out governing power, provide checks and balances (like a strong, independent, elected State Board of Education) and local control (cities, counties and school boards) to respond to different local circumstances, needs and values. We are part of a living lesson on how that works.To answer the questions about when schools will open and what that will mean, local school boards will be influenced by decisions of the Governor, Legislature, State Board and local governments.
