The next time you are with a group of friends or colleagues,
ask them this piece of trivia: “What freedoms are all Americans guaranteed by
the First Amendment?” 

Some may even be surprised “freedoms” is plural. If your
friends and colleagues are like most Americans, they will likely correctly state
“free speech” as one such freedom. In 2019, the Freedom Forum’s <a href="https://www.freedomforuminstitute.org/first-amendment-center/state-of-the-first-amendment/">State
of the First Amendment Survey</a> found 64 percent of U.S. adults could name
freedom of speech as a guaranteed right of the First Amendment. The next most-often
named right was religious freedom at only 29 percent, followed by freedom of the
press (22 percent), assembly (12 percent) and petition (4 percent).

We should not be surprised. The last decade has seen several
“free speech” debates rise to national prominence. Notable examples include the
<a href="https://firstamendmentwatch.org/deep-dive/are-professional-sports-players-protected-by-the-first-amendment-when-they-engage-in-political-protest-on-the-field/#tab-history-legal-cases">many
athletes</a>, most famously Colin
Kaepernick, who have peacefully protested for the rights of people of color, concerns
about censorship on <a href="https://www.theatlantic.com/ideas/archive/2019/06/free-speech-crisis-campus-isnt-real/591394/">college campuses</a> like Middlebury and University of California,
Berkeley and disagreements about the role and impact <a href="https://www.freedomforum.org/2020/02/06/focus-on-when-the-first-amendment-protects-and-doesnt/">social media</a> sites play in our national discourse. In 2019, Mark
Zuckerberg, Facebook chief executive officer, found “free speech” a valuable
Trojan horse when he used a Georgetown University <a href="https://www.vox.com/2019/10/17/20919505/mark-zuckerberg-georgetown-free-speech-facebook">speaking
engagement</a> to rewrite his company’s origin as a dating site, claiming it
was instead founded to give voice to opponents of the Iraq War.

I use quotation marks for “free speech” above because many
such debates are not truly First Amendment or constitutional issues, however
the rhetoric and discussion around them is often framed by a guaranteed right
to free speech. While many believe freedom of speech is a natural right — not
one that can be given or taken away by a government — confusion about what is
and what is not protected by the constitution has produced a rise in free
speech absolutism, or the ideology that speech of any kind — hateful,
derogatory, or even violence inciting — should never be censored. Proponents
use compelling language like “marketplace of ideas” to imply that only the
“best” and “good” ideas will multiply and take root. Ignoring the obvious
question — “‘Good’ and ‘best’ for whom?” — any cursory look at your social
media feeds will quickly show that often divisive, angry voices win out over
calls for understanding and peace. 

In this race to protect free speech for all, we have
forgotten what history can teach us. Two hundred years ago, in the wake of the
Revolutionary War, Americans were in the process of conceptualizing and
codifying how their nation would be different from those that came before. This
process produced the U.S. Constitution in 1787, but debates continued about which
freedoms Americans possessed and from which governments (state or federal) or supernatural
entities they flowed. Originally against a “Bill of Rights,” James Madison fought
for a series of constitutional amendments to combat self “interest and passion”
that could lead to another constitutional convention. Madison proposed 12
amendments — two regarding the composition of congress that have interesting
histories for another time and 10 amendments that laid out rights every
American is guaranteed. Those 10 amendments became known as the “Bill of
Rights” and, while they went through several revisions, freedom of speech was
never the first right protected. 

What always came before free speech? Freedom of conscience. The
first congressional delegates thought that the right to believe our deepest
beliefs was chief among all others and originally separated what we think of as
the First Amendment in two: We would first be guaranteed the right to believe
and exercise our conscience, then a second amendment would cover speech, press,
assembly and petition. When the drafters thought it best to combine those
freedoms in one article, religious freedom retained its primacy, where it is
still the first right Americans are guaranteed by the Bill of Rights. That is a
lesson that seems lost on us today. 

The ardor to protect the act of free speech has entirely
skipped past the inherent value and dignity of the speaker. The religious
freedom clauses of the First Amendment served then, as today, as <a href="https://www.freedomforum.org/2020/07/29/a-first-amendment-framework-for-effective-dialogue-in-the-classroom/">a
civic framework for living together with our deepest differences</a>. They help
us find common ground and see each other as full Americans, deserving of every
protection that we enjoy ourselves. When we begin by acknowledging the humanity
of the speaker, differences of taste or politics or religion or sports team can
be tempered by mutual understanding and respect. This is especially important
when we consider the immediacy of speech in the digital age and its ability to
impact far more people at a far faster rate than in any other time in our
country’s history. That ability to spread our speech is inversely proportional
to our ability to understand how that speech impacts others, and thus, promoting
free speech without the context of freedom of conscience imbalances these
debates in favor of self-interest and passion James Madison feared. The First
Amendment does not require civility, however, when taken in full, it can be a
framework for living civilly in a diverse democracy.

First Five: ‘What comes before freedom of speech?’

MANHATTAN — Kansas State University's Family Day will look different this year, but that's not stopping the 2020 Family of the Year from being honored for their Wildcat pride.

The Whitehair family has been selected as the Family of the Year by Chimes, the junior honorary, which sponsors the annual competition. 

The family will be honored during&nbsp;<a href="https://www.k-state.edu/familyday/events.html" target="_blank">Virtual Family Day</a>&nbsp;Saturday via the&nbsp;<a href="https://www.facebook.com/Chimes-Junior-Honorary-at-K-State-354386058080" target="_blank">Chimes Facebook page</a>&nbsp;and&nbsp;<a href="https://www.k-state.edu/chimes/" target="_blank">website</a>, and the&nbsp;<a href="https://www.k-state.edu/parentsandfamily/" target="_blank">K-State Parents and Family Program</a>&nbsp;social media pages.

"The members of Chimes select the Family of the Year based on their affiliation with K-State, what family means to them, and their demonstration of K-State pride," said Jayden Hanna, Chimes' co-director of events. "The Whitehair family, though large in number, is a close-knit family that represents what it means to be Wildcats&nbsp;through their support for each other and the university. After visiting with them via Zoom, it is clear to see they embody K-State values and demonstrate what it truly means to be a part of the K-State family."

According to the family's nomination application, Whitehair extended family members are descendants of John and Mary Neyer Whitehair, who settled in Dickinson County in 1875 and started their family when Kansas State University was a fledgling land-grant institution. Family members span four generations of K-State current students, alumni, former students, contributors to the KSU Foundation and Ahearn Fund, and Wildcat fans. More than 75 family members have earned bachelor's degrees from the university, 18 have earned master's degrees, four are Doctors of Veterinary Medicine graduates and one earned his Doctor of Philosophy.

"Members of the extended Whitehair family continue to take pride in their university roots," Janet Whitehair Cooper,&nbsp;Manhattan,&nbsp;said in her nomination application. "They are community leaders in many parts of the United States, giving credit to K-State for developing their characters and preparing them for the work world — and they continue to give back to the university."

The Whitehairs have been distinguishing themselves on and off the gridiron, thanks to their K-State degrees.&nbsp;

Cody Whitehair, '14, who was the Wildcats' team captain and All-Big 12 player, is in his fifth year in the NFL with the Chicago Bears. While on the K-State football team, 130 relatives and friends proudly wore "WHITEHAIR 55" jerseys on game days, which was organized by Cody's dad, Kevin Whitehair, '89,&nbsp;Abilene.

Another offensive tackle for the K-State football team was Norman Whitehair, '43 '52, a first-generation Whitehair K-Stater. He served on the K-State faculty for 35 years and was head of the agricultural economics department for 15 years.

Two family members are Alumni Fellows of the College of Veterinary Medicine, from two generations: Leo Whitehair, Doctor of Veterinary Medicine, '53, in 1995, and Michael Whitehair, Doctor of Veterinary Medicine, '74,&nbsp;Abilene, in 2018.&nbsp;

Other noted Whitehairs include Christine Lorson Downey Schmidt,&nbsp;Inman,&nbsp;who served in the Kansas Legislature and on the Kansas Board of Regents. She was on the K-State Presidential Search Committee that selected Kirk Schulz as the university's 13th president.

The Hintz family siblings — Greg, '74, Maureen Hintz Burson, '75 '83, Jim, '78, Alan, '80, and Jean Hintz Artz, '83 — who grew up in Salina, have invested through the KSU Foundation in the future of K-State by establishing the Bernie and Bill Hintz Family Scholarship in memory of their parents.

Family members are/were active as students, with membership in Spurs — now Silver Key — including the first president and two Spurs advisors; Chimes, including a chair of Parents' Day, the forerunner of Family Day; Mortar Board; Blue Key vice president; Phi Kappa Phi; Phi Upsilon Omicron; Alpha Lambda Delta; Phi Beta Kappa; Beta Alpha Psi; Kappa Omicron Nu president; Human Ecology Council president; Wheat State Agronomy Club officer and advisor; PRSSA secretary; and K-State Tennis Club co-founder. They have served as West Hall treasurer and scholarship chair, Smurthwaite freshman class president, Ag Ambassador, Ag Expo coordinator, and IFYE participant. Music activities have included Jazz Band, K-State Symphony Orchestra, Symphony Band, Woodwind Quintet and Clarinet Choir.

As alumni, family members have included a K-State Alumni Association board member, KSU Foundation trustees, Ahearn Club members, K-State Alumni Association lifetime members, members of college advisory boards, and a Friends of the Beach Museum of Art board president.

Several family members have chosen careers associated with K-State, working as extension agents, a professor and department head, a graduate class instructor, a librarian, an office specialist, a nurse, an assistant director of Lafene Health Center, and worker at the Swine Teaching and Research Center. Several also worked in campus labs during their undergraduate years.

Virtual Family Day to honor Whitehair family as KSU's Family of the Year

Today is Saturday, Sept. 12, the 256th day of 2020. There are 110 days left in the year. 

On Sept. 12, 1962, in a speech at Rice University in Houston, President John F. Kennedy reaffirmed his support for the manned space program, declaring: "We choose to go to the moon in this decade and do the other things, not because they are easy, but because they are hard."

In 1913, Olympic legend Jesse Owens was born in Oakville, Ala.

In 1942, during World War II, a German U-boat off West Africa torpedoed the RMS Laconia, which was carrying Italian prisoners of war, British soldiers and civilians; it's estimated more than 1,600 people died while some 1,100 survived after the ship sank. The German crew, joined by other U-boats, began rescue operations. (On September 16, the rescue effort came to an abrupt halt when the Germans were attacked by a U.S. Army bomber; as a result, U-boat commanders were ordered to no longer rescue civilian survivors of submarine attacks.) 

In 1958, the U.S. Supreme Court, in Cooper v. Aaron, unanimously ruled that Arkansas officials who were resisting public school desegregation orders could not disregard the high court's rulings.

In 1977, South African Black student leader and anti-apartheid activist Steve Biko, 30, died while in police custody, triggering an international outcry. 

In 1987, reports surfaced that Democratic presidential candidate Joseph Biden had borrowed, without attribution, passages of a speech by British Labour Party leader Neil Kinnock for one of his own campaign speeches. (The Kinnock report, along with other damaging revelations, prompted Biden to drop his White House bid.) 

In 1992, the space shuttle Endeavour blasted off, carrying with it Mark Lee and Jan Davis, the first married couple in space; Mae Jemison, the first Black woman in space; and Mamoru Mohri, the first Japanese national to fly on a U.S. spaceship. Police in Peru captured Shining Path founder Abimael Guzman. Actor Anthony Perkins died in Hollywood at age 60. 

In 1994, a stolen, single-engine Cessna crashed into the South Lawn of the White House, coming to rest against the executive mansion; the pilot, Frank Corder, was killed. 

In 2001, stunned rescue workers continued to search for bodies in the World Trade Center's smoking rubble a day after a terrorist attack that shut down the financial capital, badly damaged the Pentagon and left thousands dead. President Bush, branding the attacks in New York and Washington ``acts of war," said ``this will be a monumental struggle of good versus evil" and that ``good will prevail."

In 2003, in the Iraqi city of Fallujah, U.S. forces mistakenly opened fire on vehicles carrying police, killing eight of them. 

In 2005, at the start of his confirmation hearing, Supreme Court nominee John Roberts pledged to judge with humility and "without fear or favor" if approved as the nation's 17th chief justice.

In 2008, a Metrolink commuter train struck a freight train head-on in Los Angeles, killing 25 people. (Federal investigators said the Metrolink engineer, Robert Sanchez, who was among those who died, had been text-messaging on his cell phone and ran a red light shortly before the crash.) 

In 2012, the U.S. dispatched an elite group of Marines to Tripoli, Libya, after the mob attack in Benghazi that killed the U.S. ambassador and three other Americans. President Barack Obama strongly condemned the violence, and vowed to bring the killers to justice; Republican challenger Mitt Romney accused the administration of showing weakness in the face of tumultuous events in the Middle East. 

Ten years ago: The United States won its first world basketball championship since 1994, beating Turkey 81-64 in Istanbul behind a sensational performance from tournament MVP Kevin Durant, who scored 28 points. Lady Gaga swept the MTV Video Music Awards with eight wins, wearing a dress made of meat as she accepted the video of the year award for "Bad Romance." Another  small earthquake shook part of Saline County southeast of Saline Friday afternoon.

According to the Kansas Geological Survey, a magnitude 2.2 quake struck at 4:37 p.m. Friday west of South Holmes Road between Kansas Highway 4 and East Salemsborg Road.

The temblor was a few miles west of another small quake that struck the area Wednesday evening.

There are 23 new positive COVID-19 cases in Saline County that have been identified since the Wednesday, September 9 report. The total for the county is now 562, with 109 cases that are actively being monitored by the Health Department, 444 that have recovered, and a total of 9 deaths. Salina Regional Health Center reports that they have 5 hospitalized COVID-19 patients. Our dashboard has been updated with the latest information:

Saline County: 23 new cases of COVID-19; 444 of 562 recovered

The Kansas Department of Transportation will reduce a section of Interstate 70 (I-70) beginning Monday to begin constructing crossover lanes just east of the Chapman interchange, near Chapman Creek. 

The crossover construction is needed to allow I-70 traffic to use one set of lanes in spring 2021 for bridge replacements scheduled to begin at that time.

Work will begin approximately one mile west of the Chapman Creek bridge and extend east for approximately two miles with occasional shoulder closures and intermediate lane closures.

Reece Construction Co., Inc. of Salina is the primary contractor for this $5.8 million project. The bridge replacements are scheduled to be completed in Nov. 2022, weather permitting.

KDOT urges all motorists to be alert and obey the warning signs when approaching and driving through a work zone. Check <a href="http://kandrive.org">kandrive.org</a> for updates and more information.

Lane reduction on I-70 in Dickinson County begins Monday

Police are investigating the recent theft of a pickup in east Salina.

Christopher Burns, 47, and Melinda Kolzow, 41, both of Salina, told police that a gray 2014 Ford F150 valued at $30,000 was stolen from their driveway in the 600 block of Seitz Drive sometime between 10 a.m. on Wednesday and 6 a.m. Thursday, Salina Police Captain Paul Forrester reported this morning.

According to Forrester, the pickup was believed to be locked, but had a spare key under the console.

The pickup had a Kansas license tag of 647KEU, a Boston Redsox tag on the front, a black bed cover, and an Alabama "A" sticker on the back window, Forrester noted.

You don’t have to spend a lot of money to have a wonderful Christmas or make the season special for others—even when it comes to giving. Thoughtful handmade items, meaningful photographs set in a frame, or special baked goods are great ways to show the folks in your life you’re thinking about them and how much you care.

Now, let’s talk about next year. There’s absolutely nothing wrong with including a line just for Christmas in your budget each month. Christmas doesn’t sneak up on you. The webinar will be held online on Oct. 1.

Participants should expect to learn about export strategies as well as gain an understanding of export financing and regulatory requirements. “The agenda will include a variety of topics, including technical information needed to enter the export market. Producers will learn about tools they need to take advantage of global market opportunities,” explained KDA international trade director Suzanne Ryan-Numrich.

Exports are an important part of the Kansas economy. In 2019, over $3.8 billion dollars of agricultural goods were shipped around the globe to 96 different countries.

“This export webinar is a great way to expand opportunities for communities and small businesses as they focus on growth and we build upon rural prosperity across the state of Kansas,” said Kansas Secretary of Agriculture Mike Beam. “Agricultural growth plays a big role in rural revitalization and the health of the Kansas economy, as agriculture directly contributes $46 billion to the Kansas economy.” 

Beam added that information and education help Kansas’ small and rural agribusinesses serve as economic engines for their communities.

MCPHERSON -- The McPherson County Health Department on Thursday reported seven new confirmed cases of COVID-19, bringing the county total to 238.

Following is information about the latest cases, as provide by the health department.

●Positive case No. 232 is a symptomatic female in her 20s with unknown exposure and was identified late Wednesday.

●Positive case No. 233 is a symptomatic male in his 80s with unknown exposure, is hospitalized, and was identified late Wednesday.

●Positive case No. 234 is a symptomatic female in her 70s with unknown exposure, is hospitalized, and was identified late Wednesday.

●Positive case No. 235 is a symptomatic 18-year-old male with unknown exposure.

●Positive case No. 236 is a symptomatic male in his 60s with suspect travel exposure and family exposure (family of 226).

●Positive case No. 237 is an asymptomatic female in her 60s with suspect travel exposure.

●Positive case No. 238 is a symptomatic male in his 40s with known exposure.

According to the health department, 198 of the total 238 cases have met Kansas Department of Health and Environment recovery guidelines. Four of the active cases are hospitalized, the health department noted. There has been one COVID-19 related death in McPherson County, the health department reported.
