Law Enforcement Officers Memorial Advisory Committee

The purpose of this Committee is to advise the director of architectural services and the secretary of state historical society with regard to memorials to law enforcement officers on the State Capitol ground; make recommendation to the Governor and legislature regarding activities commemorating the services of Kansas Law Enforcement officers; may solicit grants, gifts, contributions and bequests for the memorial(s).

This Board is charged with regulation of the profession of cosmetology and its educational institutions.&nbsp; The purpose of this regulation is to protect the health and safety of the general public as well as that of the licensees. This includes tanning and tattoo facilities.

KDWPT: Reselling campsite reservation may get you a ticket

ABILENE - A woman from Maryland was injured when the pickup she was driving overturned on Interstate 70 east of Abilene this morning.

According to the Kansas Highway Patrol, Sally R. Shapiro-Gould, 67, of Reisterstown, Md., was westbound on I-70 in a 2016 Dodge Ram that was pulling a camper trailer. The pickup attempted to pass a tractor-trailer rig, lost control and overturned. The accident occurred about 9:30 a.m. approximately 4.5 miles east of Abilene, KHP reported.

Shapiro-Gould was transported to Abilene Memorial Hospital with suspected serious injuries. A passenger in the pickup, Thomas D. Gould, 70, of Reisterstown, Md., was not injured. Both were properly restrained, KHP noted.

UPDATE 11:40 a.m. Tuesday: The Kansas Highway Patrol is asking westbound drivers to take the following detour to avoid the accident area.

"If possible, please avoid this area. WB I-70 detour is north to K-18, west on K-18 to K-15 and south on K-15 into Abilene. Please give workers room to work so everyone can go home safely.," Kansas Highway Patrol Troop C noted in a Facebook post.

UPDATE: Maryland woman injured in I-70 accident east of Abilene

DICKINSON COUNTY— The dream of seeing the Brookville Hotel reopen may never be realized. Unpaid taxes could prevent the Martins who own the hotel and the Munsons from opening Legacy Kansas.

The Martins have been delinquent on paying taxes for the past few years, according to&nbsp;Leah Hern, Dickinson County Treasurer.&nbsp;&nbsp;"I believe it is around $160,000 with tax and penalties as of Tuesday," she confirmed.

ABILENE -- The reopening of the Brookville Hotel in Abilene has hit a snag.

The Abilene Convention &amp; Visitors Bureau released the following&nbsp; statement from Charles and Deanna Munson early this afternoon.

We believed that we had an agreement in principle to purchase the Brookville Hotel assets and made every effort to expedite the opening of Legacy Kansas to accommodate summer travel demands.&nbsp;It is now apparent that we will be unable to arrive at a mutually agreeable contract with the Martins.&nbsp;This will unfortunately prevent us from opening on June 23rd as planned.

We are, however, committed to seeing this project completed and hope better news will be announced at a later time. We want to thank everyone for their support and understanding as we work through this difficult situation.

Update: Brookville Hotel won't reopen unless delinquent taxes paid

TOPEKA — State Treasurer candidate Steven Johnson said he was confident about the tone of responses if people in his hometown of Assaria were asked to describe the farmer and politician.

His advantage would be that many folks in the 400-person community south of Salina ought to have some idea where he stood on issues after 10 years in the Kansas Legislature. He also takes part in farming land settled by his great-great-grandparents. And, he was student body president at Kansas State University, worked in the financial services field and earned a master’s degree in finance at University of Chicago.

“They would generally say that I am very thoughtful and consider all of the information in coming to a decision about where to push a policy or how to vote,” Johnson said on the Kansas Reflector podcast. “In terms of the fiscal side, I am conservative on spending. I’m very conservative on saying we have to be fiscally responsible in meeting what liabilities we have taken on.”

Johnson was the first Republican and second candidate overall to let it be known a campaign for state treasurer was on the horizon.

In addition to incumbent Treasurer Lynn Rogers, a Wichita Democrat appointed to the job, the GOP primary could attract others with ties to the Kansas Legislature. State Sen. Caryn Tyson, from former Gov. Sam Brownback’s hometown of Parker, and former Kansas Policy Institute lobbyist Michael Austin, who worked in the Brownback administration, have explored a run for treasurer.

“I would imagine that there are other people looking at it,” Johnson said. “I’ve heard some names, and none have announced yet, but we’ll continue to watch that. I know that there is interest across the state in the party and returning the seat to Republican hands.”

Rogers, the Democrat seeking election to the job in 2022, was serving as lieutenant governor when appointed treasurer by Gov. Laura Kelly. The position was suddenly vacant when Republican Jake LaTurner resigned in January to take a seat in the U.S. House.

When Johnson stepped into the state treasurer’s race nearly two weeks ago, Rogers responded by alleging Johnson sided with special interests over taxpayers as a legislator and was running for treasurer to create a stepping stone to “something else.”

“Kansans will now have a choice when they vote — a candidate who votes to help special-interest groups, lining their pockets with your dollars and ignoring the needs of Kansas families,” Rogers said. “Or, me, a candidate who believes in being responsible with public dollars and making sure Kansans are being taken care of.”

All three of the previous Republican state treasurers — Lynn Jenkins, Ron Estes and LaTurner — have been elected to the U.S. House.

The Kansas Republican Party and other GOP politicians objected to Kelly’s decision to award the treasurer’s job to a Democrat rather than honor preferences of Kansas voters who in 2018 elected a Republican — LaTurner — to represent them in Topeka. In 2017, Brownback appointed LaTurner as state treasurer once Estes resigned after winning a special congressional election.

However, Johnson said he was concentrating on who would be state treasurer following statewide elections next year.

“The rules are what you’re able to do, and that is the way that those non-constitutional offices are set up,” he said. “Treasurer Rogers is serving currently, and I’ll be focused on who will be the treasurer in ’22.”

In Kansas, state treasurers operate as chief custodian of Kansas’ cash deposits, bond sales and the investment of those assets. The office also has jurisdiction over the state’s $2.7 billion college savings program and the unclaimed property program. State treasurers sit on the board of the Kansas Public Employees Retirement System and the Pooled Money Investment Board.

Johnson, 55, said he decided to be a candidate for treasurer because the position was a good fit with his private industry and public service experience. In financial services, he built investment models to set portfolios and, he said, “work on getting the most return you could for a given level of risk.”

In the Legislature, he’s served on budget, tax, pension, insurance and commerce committees in the Kansas House.

“I think in each of those, the experience in the Legislature helps to inform what’s happening in that treasurer’s office,” Johnson said.

Weather History for Tuesday, May 25, 2021, from the National Weather Service in Wichita

In 1955, two violent F5 tornadoes struck North Central Oklahoma and extreme South Central Kansas. 

The first F5 tornado that had a track 25 miles long and around one half mile wide, barreled through Blackwell, Oklahoma where 20 were killed, 280 were injured, and around $8 million damage resulted. Around 400 homes were destroyed, many of which were swept from their foundations. Around 60 businesses were heavily damaged or destroyed. Prior to hitting Blackwell, the tornado caused $150,000 damage in Tonkawa. The lightning associated with the tornado was incredible. The vortex glowed and possessed arcs of glowing light. The tragic Udall tornado soon followed. With a track 30 miles long and averaging one half mile wide, the tornado leveled most of Udall, killed 75, injured 270, and caused $2.25 million damage. The tornado also killed five children three miles northeast of Oxford, bringing the total number of fatalities to 80. It is still the deadliest tornado in Kansas history. In 1917, an F5 tornado even larger than either the Blackwell or Udall tornadoes raced across south-central Kansas. It had a track 65 miles long and reached one mile wide. The tornado killed 23, injured 70, and caused around $600,000 damage from northwest Sedgwick to southeast Marion counties. The tornado started four miles northwest of Cheney and struck southeast Andale, where half of the town was damaged or destroyed and 12 were killed. A new downtown destination is scheduled to open his fall, bringing with it food, drink, and entertainment.

Billed as the unofficial front porch for downtown Salina, the Prickly Pear Grill &amp; Cantina, a Tex-Mex infused eating and entertainment venue, is scheduled to open in fall 2021. Created by Salina businessmen Tim Blake and Wes Blake of Wheat State Hospitality, Inc., this unique restaurant and bar concept will offer the perfect place to meet, eat and enjoy in all seasons, the company noted in a news release.

“The Prickly Pear Grill &amp; Cantina is a project we have been excited to develop for some time and we are incredibly proud to bring this new dining and entertainment concept to Salina,” said Tim Blake, co-founder. “We look forward to our customers enjoying a centerpiece of our revitalized downtown.”

The Salina City Commission on May 17 paved the way for the Prickly Pear to open in its current concept when the commission authorized the city manager to execute a licensing agreement and a transferee agreement with Wheat State Hospitality, Inc., for the use of Campbell Plaza, which adjoins the Prickly Pear building.

Offering a Tex-Mex inspired menu, the Prickly Pear Grill &amp; Cantina will provide a comfortable, family friendly environment that will include indoor and outdoor seating in addition to frequent live music performed by popular regional acts.

“The revitalization of the area has been incredible and we wanted to support its continued growth,” said Wes Blake, co-founder. “This concept is a first-of-its-kind for Salina and we’re thrilled to bring it to the community in our hometown.”

Salina Police Department introduces its newest officer

MISSION, Kan. (AP) — A Kansas woman who alleges consensual sex with a friend in his college dorm room turned into a terrifying assault took matters into her own hands when prosecutors declined to bring rape charges. She called a citizen grand jury, relying on a 134-year-old state law.

Madison Smith, 22, collected the hundreds of signatures necessary to empanel the grand jury after the county prosecutor resolved the case by allowing Jared Stolzenburg to plead guilty to aggravated battery and receive two years’ probation.

Smith, who graduated earlier this month from Bethany College in Lindsborg, about 70 miles north of Wichita, is part of a generation of women emboldened to go public with their stories due to the #MeToo movement.

“This happens nationwide, worldwide that victims and survivors are minimized by the prosecutors who don’t believe them,” she said, “And that is not OK because rape culture is so prevalent, and we need to get rid of it, and one of the ways to do that is to get our stories out there.”

Kansas is one of six states that allow citizens to petition for grand juries. The 1887 law was rarely used until anti-abortion activists began using it to force grand jury investigations of abortion clinics. It has since been used to go after adult bookstores and to challenge former Kansas Secretary of State Kris Kobach’s right to appear as the Republican nominee for governor.

But Smith’s case, which will be considered in September, is believed to be the first time that someone claiming sexual assault has used it, said Kathy Ray of the Kansas Coalition Against Sexual and Domestic Violence.

“This case has a lot of issues within the criminal justice system, and sometimes victims feel they have no other choice but to go public,” she said.

The process of seeking a grand jury wasn’t easy. Smith had to stand in a parking lot telling her story over and over again to strangers to collect hundreds of signatures, and then do it again when the first petition was rejected on a technicality.

Some of the strangers she approached snatched the pen from her hands just a few minutes after she began speaking, hugging her and whispering into her ear so others nearby couldn’t hear that they had been sexually assaulted in the past themselves.

“They were very thankful that I was fighting, just fighting the justice system and trying to make a change in the world because they were too scared to fight back,” she recalled.

But Smith said she felt it was the only way she could get justice for the February 2018 attack.

McPherson County Attorney Gregory Benefiel told Smith’s mother in a recorded conversation that the case was challenging because Smith didn’t verbally withdraw consent during the encounter. Smith said that’s because he was choking her.

“I think anybody could realize that if you can’t breathe, you can’t speak,” she said.

Smith said the attack happened after she ran into Stolzenburg while doing laundry and went back to his room at Bethany College, where they had sex. It initially was consensual, but then he began slapping and strangling her, leaving her gasping for air, Smith said during Stolzenburg’s sentencing hearing in August 2020.

“I really thought that he was going to kill me, and the only way I was going to leave that room was in a body bag,” said Smith, who is working at a nursing home before she begins to study nursing in the fall.

“He would strangle me for 20 or 30 seconds at a time, and I would begin to lose consciousness,” she said.

Stolzenburg’s Bethany College transcript shows that he was administratively withdrawn in March 2018, said Amie Bauer, the school’s general counsel. She wrote that the college had no further comment.

Defense attorney Brent Boyer said during the sentencing hearing that Stolzenburg and his family had been threatened and that Stolzenburg wanted to “move forward.” A woman who answered the phone in Boyer’s office said that Boyer didn’t participate in media interviews and hung up. Stolzenburg doesn’t have a listed phone number and didn’t immediately respond to a message on Facebook.

Benefiel said in an interview with The Associated Press that sex crimes cases are “extremely challenging to prosecute” because jurors are looking “for that CSI type of evidence.” He said he couldn’t comment on the specifics of the case but added that he believed that he and Smith both wanted the same thing — “truth and justice.”

“There is a disagreement on what it looks like in this case, but I think everyone has the same goals,” he said.

But Julie Germann, a former Minnesota prosecutor who reviewed the Kansas law for the Smiths and determined that the attack qualified for a rape charge, said prosecutors need to “look at the totality of the circumstances.”

“This idea that because she consented then anything that follows is acceptable, that is a very dangerous precedent to set,” said Germann, who consults and teaches about sexual assault.

Justin Boardman, who trains police and prosecutors to investigate sex crimes, said defense attorneys often try to argue that the victim had consented not just to sex but to rough sex. However, in that lifestyle, there are typically a lot of check-ins and discussions before sex starts, he said.

“If it is just a surprise, it is assault,” he said.

A court services worker said during the sentencing hearing that Stolzenburg told her he should have communicated better and “does feel sorry for the victim.”

Kansas woman alleging dorm rape convenes own grand jury 

Here is a look at the severe storm chances for Wednesday evening and Wednesday night, according to the National Weather Service in Wichita. 

The greatest threat will be north of Interstate 70, where a complex of severe storms may produce damaging winds. A more isolated threat of severe storms exists over south-central Kansas, with large hail and damaging winds the main concern.

The rows of cookies and muffins, rockets and cabinets and photographs and more may seem like interesting displays to passers-by at the county and state fairs. 

But for thousands of Kansas 4-H members who will put their efforts on display this summer, they represent nearly a year’s worth of work and trial-and-error learning. 

“The 4-H year begins in October with young people selecting the projects that they want to learn about the rest of the year,” said Amy Sollock, a 4-H youth development specialist in the southwest region. “So the exhibit that is brought to the fair is reflective of a year’s worth of work.” 

Sollock said once county fair season hits – typically July and August– youth have had several chances to master their new skills and knowledge; some of those attempts are successful and some not-so-successful. 

“We would expect that they would have a lot of practice rounds,” she said. “Of course nobody complains about having too many muffins around the house, or cookies. If it’s a craft or trade such as sewing or woodworking, what they choose to exhibit at the fair is a sample of their best work.” 

For Saline County 4-Hers, the Tri-Rivers Fair is scheduled for Aug. 4-8 and is packed with activities. As the schedule stands now, the parade through downtown Salina will kick things off the night before. The parade is scheduled to begin at 7 p.m. Aug. 3 at the intersection of Elm Street and N. Santa Fe Avenue. It will travel south on Santa Fe Avenue to Prescott Avenue.

Loren Johnson is the scheduled grand marshal for the parade, which has the theme of "Barn to be Wild."

Organizations and businesses wanting to participate in the parade are asked to submit their entry forms by July 25. Entries received after July 25 will be placed at the end of the parade. Entry fees are as follows.

●Postmarked by July 25, $20 per business or $10 per non-profit organization

●Postmarked between July 26-31, $30 per business or $20 per non-profit organization

●Anything after July 31 (bring with you the day of the parade), $45 per business and $35 per non-profit organization.

There are no fees for 4-H club entries. There will be no refunds.

Sollock said one of the traditions of 4-H projects is that youth are mentored by adults. Sometimes that’s a club leader or project leader, or maybe a parent who happens to have knowledge in a given area. 

“4-H programs are designed to have a lot of adult volunteers in place to make sure that our kids are learning appropriately for their age and skill level and that they get some guidance and coaching throughout the year,” Sollock said. 

K-State Research and Extension agents can provide a fair book that includes the criteria for entering projects in the county fair, where the projects are displayed and judged by experts in the given area. 

“That’s the part I love the most about any county fair: Kids sit down with an adult who has expertise in a given project area and they have a conversation about what the exhibit is,” Sollock said. “If it’s an art or photography project, for example, youth will sit down and have a conversation with the adult about why they chose to take the photo, and maybe the lighting and the settings they used on their camera. The judges provides feedback about what worked well, what the 4-H member could have done differently… and encourage them to continue their learning experience.”

WICHITA – AAA expects a significant rebound in travel this summer, as evidenced by the results of an exclusive survey of Kansans that reveals 61% of respondents are considering or planning to take a trip this summer.* 

AAA Travel is already seeing an increase in bookings that reflects the renewed enthusiasm.

“Optimism coinciding with the COVID-19 vaccine rollout and growing consumer confidence are fueling a strong desire to travel this summer as the United States takes steps toward putting the pandemic behind us,” said Shawn Steward, spokesman for AAA Kansas. “The AAA poll shows that Kansans have a pent-up demand for quick getaways and even longer, more extravagant trips – so called ‘Revenge Travel.’”&nbsp;

AAA’s poll asked Kansans about the sentiment that best reflects their feelings about traveling this summer:

•30%&nbsp;feel that their travel will be driven by their need for a “quick getaway”

•24%&nbsp;are planning a longer or more extravagant trip – so called “Revenge Travel”

•21%&nbsp;are choosing to stay at home this summer

•25%&nbsp;are undecided, but say they could make a last minute decision to travel.

COVID Remains a Factor in Some Summer Travel Planning

Summer travel trends are also indicative that people are feeling more comfortable traveling as COVID rates are decreasing. Adding to that, state restrictions are lessening and Centers for Disease Control and Prevention’s (CDC) guidance says that fully vaccinated people can resume activities that they did prior to the pandemic, including domestic travel at low risk to themselves, while taking proper precautions.

AAA’s poll also revealed COVID remains a factor influencing Kansans’ summer travel plans:

•23%&nbsp;say they still have COVID-related travel concerns. 

•26%&nbsp;have a strong desire to travel due to pandemic restrictions from the last year. 

•22%&nbsp;feel that their ability to be fully vaccinated is the driving force behind travel plans. 

•29%&nbsp;say that uncertainty about activities and attractions at their destinations is a consideration as part of the planning process.

According to the same poll, in Kansas,64% of respondents said that when thinking about their next trip, they plan to travel with only those in their household or those in their established COVID “bubble.”

“COVID-related safety is still a factor for many travelers, some of whom may be venturing out for the first time in over a year,” Steward added.

As the AAA poll shows, American views about traveling as we emerge from the COVID pandemic are complex. Knowledge of the latest COVID-related restrictions and protocols will be a critical component in all planning.

“Being informed and planning in advance can make the difference between a great vacation and a travel nightmare,” said Matt Bert, travel advisor with AAA Kansas. “AAA is encouraging travelers to check and re-check requirements at all stop off points and destinations as they can change up to the last minute.”

Memorial Day – the Unofficial Start to Summer Travel

With the unofficial start to summer, the Memorial Day weekend, it’s clear that people are feeling more comfortable traveling as COVID rates are decreasing and pandemic restrictions are loosened throughout the U.S.

The West North Central Region, of which Kansas is a part, will see more than 2.98 million people taking Memorial Day week trips, a 56% percent increase over the 1.92 million travelers in 2020, when much of the country and the world&nbsp;was under COVID travel restrictions, if not locked down**, but still less than the region’s 3.63 million Memorial Day travelers in 2019, according to AAA.

&nbsp;The West North Central Region includes Iowa, Kansas, Minnesota, Missouri, North Dakota, Nebraska, South Dakota.

AAA expects the&nbsp;number of people in the region traveling over the Memorial Day holiday this year to return to 82% of those who traveled pre-pandemic, in 2019, when a record number of traveled for the holiday weekend.



According to the AAA poll, most Kansans who are staying home for Memorial Day say COVID is not the reason, as they don’t usually travel for this holiday.

The 37 million Americans and nearly 3 million in the West North Central region, however, are predicted to once again kick-off the official start of the summer holiday travel season by celebrating Memorial Day with a trip.

•Auto: The&nbsp;Great American Road Trip&nbsp;has been the most popular type of travel during the pandemic and has historically been the number one choice for the Memorial Day Holiday and that still holds true. The majority of travelers in the West North Central region – 2.83 million – are forecast to travel by vehicle this Memorial Day, an increase of 52% over 2020.

•Air:&nbsp;The number of people in the region flying in 2021 is expected to be almost six times what it was in 2020 when multiple factors kept most people from traveling via airline. About 105,000 residents will travel by air, a 567% increase from 2020.Travelers are reminded that some inflight amenities may be limited or not offered and that some airlines are still limiting capacity with blocked middle seats. The Transportation Security Administration (TSA) is also now allowing one oversized liquid container of hand sanitizer of up to 12 ounces.&nbsp; Masks are required at all airports and all aircraft. International travelers, including US citizens, must have a negative test result or proof of recovery from COVID before boarding flight to US. &nbsp;COVID testing is not required domestically, except for travel to and from Hawaii, and from island to island in Hawaii.

According to the Kansas Geological Survey, the 2.0 magnitude quake struck at 12:47 a.m. Tuesday, northwest of Carlton. It was centered just east of the Saline County line and just north of 800 Avenue.
