What can public school students say and do when it comes to expressing themselves in school this year?

And what can parents or administrators do if they don’t like what those students are saying and doing?

The very accurate, highly technical answer is: It depends. Primarily, it depends on how and when and where students speak, protest or assemble but also on what you say.

Specific legal advice is necessary to deal with both the details of any conflict and to consider local and state laws that vary across the nation (and this column should not be taken as legal advice). But here’s a general guide for students, administrators and parents:

You do not leave behind your First Amendment rights at the school doorway, to paraphrase&nbsp;<a href="https://www.freedomforuminstitute.org/2019/01/30/tinker-after-50-a-historic-ruling-still-relevant-after-all-these-years/" target="_blank">a landmark 1969 U.S. Supreme Court decision</a>. But your free speech rights have limits. First and foremost: The First Amendment does not provide you an excuse to skip classes to speak, write, assemble or petition for change.

Limits on expression increase as we move from speech that occurs off-campus but impacts the school community to on-campus speech and finally into the classroom or other school-sponsored educational activities.

That 1969 case — Tinker v. Des Moines Independent Community School District — held that students may be disciplined if their speech “materially disrupts classwork or involves substantial disorder or invasion of the rights of others.” &nbsp;These concerns are less likely to materialize when you speak off campus.

This is why, in the most recent case involving student speech, the U.S. Supreme Court&nbsp;<a href="https://www.freedomforum.org/2021/06/30/perspective-students-parents-and-free-speech-win-in-cheerleading-case/" target="_blank">upheld the speech rights of a student</a>&nbsp;who posted on social media vulgar criticisms of the school and its cheerleading squad when she failed to make the varsity team.

The court said the school offered no evidence that her comments had disrupted the educational work of the school and overturned her one-year suspension from the junior varsity cheer squad.

Noting the off-campus nature of the case, Justice&nbsp;Stephen G. Breyer&nbsp;wrote that since school officials already can regulate in-school student speech that otherwise would be protected for others, extending that wide range of authority to off-school hours “may mean the student cannot engage in that kind of speech at all.”

But don’t assume just being outside the school building or beyond the parking lot means you can speak as freely as non-students. Breyer notes exceptions such as field trips, athletic events, bullying that continues off-campus or when student speech targets an individual teacher or student.

And not all on-campus speech is treated equally. In the 1988 Hazelwood School District v. Kuhlmeier case, the court held that a different standard applies in the context of the classroom or school-sponsored activities and a school can restrain or regulate speech that is “reasonably related to legitimate pedagogical [educational] concerns.”

Taken together, you must observe certain limits on speech. You cannot speak out on behalf of a political candidate during a math or science class; you cannot use obscene language when speaking to a school assembly; and the school&nbsp;<a href="https://www.freedomforuminstitute.org/about/faq/can-a-public-school-official-legally-censor-a-school-sponsored-publication-like-a-newspaper-or-yearbook/" target="_blank">can outright censor what you write for student publications</a>&nbsp;done primarily as a class exercise.

You have great legal leeway to restrain or punish certain kinds of student speech that would have First Amendment protection virtually anywhere else, if your decision is rooted in protecting the educational process. That decision must be based in facts, not merely a general concern that disruption might occur.

You can act to protect the rights of students from being intruded upon by others. And while the&nbsp;<a href="https://www.freedomforum.org/2021/06/30/perspective-students-parents-and-free-speech-win-in-cheerleading-case/" target="_blank">cheerleader case</a>&nbsp;set limits on when you can reach out beyond the schoolhouse, those limits likely will remain in play. Breyer noted that circumstances vary and “given the advent of computer-based learning, we hesitate to determine precisely which of many school-related off-campus activities” might warrant future oversight.

Remember that Breyer called schools “the nurseries of democracy,” saying our democracy works only when it protects “the marketplace of ideas” in which&nbsp;“free exchange facilitates an informed public opinion.”

So heed the words of Justice&nbsp;Abe Fortas&nbsp;in Tinker: “State-operated schools may not be enclaves of totalitarianism.” Respect the lines drawn in that case to ensure that speech is not restricted based on fears that classwork might be disrupted, the possibility of disorder or a fear of disrupting another student’s rights.

One option that is both First Amendment-friendly and a good educational approach is to&nbsp;<a href="https://www.youtube.com/watch?v=OcEVQKVHfRo" target="_blank">create teachable moments</a>.

When students are denied permission to skip or leave school to join a demonstration, why not encourage teachers to spend a class offering discussion or debate over the issue involved?

When you decide to restrain or punish student speech or protest, transparency about that decision can help others reconcile the balance between student rights and a school’s educational responsibilities and duty to protect other students’ rights.

You are the primary authority over your children. Unlike the government, you are not bound by the First Amendment’s rule that neither viewpoint nor content can be reasons to censor or punish — at least until your child reaches adulthood, age 18 in most states.

Be transparent and honest when they run afoul of the law or could otherwise do better.

Know, too, that you would likely be financially responsible for consequences of your child’s on or off-campus speech that is not protected by the First Amendment, such as defamation.

While most Americans value the core freedoms of the First Amendment, most are uncertain about exactly how they apply to their lives.

Could students, administrators and parents have a higher mission than to improve that knowledge and understanding, and in the process better prepare the next generation of citizens and public officials?

FIRST 5: Back-to-school advice for parents, students, administrators

In preparation for the forthcoming demolition of the Tri-Rivers Stadium and future development of Kenwood Park, the City of Salina has closed the former dog park area to the east of the stadium to ensure safety of all participants and pets.

The City of Salina maintains two public dog parks: Barkley Park and the Salina Animal Shelter Dog Park.

Barkley Park is a fully fenced, two-acre public dog park located south of Dean Evans Stadium on Markley Road. It is open to the public daily from 5 a.m. to midnight.

A second, smaller dog park is located at 329 N. Second Street directly behind the Salina Animal Shelter to the west. This park is also open from 5 a.m. to midnight with the exception of a daily closure from 9-11 a.m. Monday through Friday.

All dogs must be over four months of age and have a current rabies shot and city license (Salina residents only) to visit either park.

City closes former dog park area east of Tri-Rivers Stadium

Today is Saturday, Aug. 28, the 240th day of 2021. There are 125 days left in the year. 

On August 28, 1963, more than 200,000 people listened as the Rev. Martin Luther King Jr. delivered his "I Have a Dream" speech in front of the Lincoln Memorial in Washington, D.C. 

In 1609, English sea explorer Henry Hudson and his ship, the Half Moon, reached present-day Delaware Bay.

In 1941, Japan's ambassador to the U.S., Kichisaburo Nomura, presented a note to President Franklin D. Roosevelt from Japan's prime minister, Prince Fumimaro Konoye, expressing a desire for improved relations.

In 1955, Emmett Till, a Black teen from Chicago, was abducted from his uncle's home in Money, Mississippi, by two white men after he had supposedly whistled at a white woman; he was found brutally slain three days later. 

In 1964, two days of race-related rioting erupted in North Philadelphia over a false rumor that white police officers had beaten to death a pregnant Black woman. 

In 1968, police and anti-war demonstrators clashed in the streets of Chicago as the Democratic National Convention nominated Hubert H. Humphrey for president.

In 2017, floodwaters reached the rooflines of single-story homes as Hurricane Harvey poured rain on the Houston area for a fourth consecutive day; thousands of people had been rescued from the flooding. 

In 2018, a white former police officer, Roy Oliver, was convicted of murder for fatally shooting a Black 15-year-old boy, Jordan Edwards, while firing into a car packed with teenagers in suburban Dallas; Oliver was sentenced the following day to 15 years in prison. 

Ten years ago: A suicide bomber struck inside Baghdad's largest Sunni mosque, killing 29 people during prayers. California returned the Little League World Series title to the United States with a 2-1 victory over Hamamatsu City, Japan. Katy Perry won three MTV Video Music Awards, including video of the year for the inspirational clip "Firework."

Five years ago: Six scientists completed a yearlong Mars simulation in Hawaii, where they emerged after living in a dome in near isolation on a Mauna Loa mountain. Ryan Harlost led Endwell, New York, to the Little League World Series title, striking out eight and limiting South Korea to five hits in six innings in a 2-1 victory. Beyonce received eight honors at the MTV Video Music Awards in New York. Juan Gabriel, a superstar Mexican songwriter and singer who was an icon in the Latin music world, died at his home in California at age 66.

One year ago: Actor Chadwick Boseman, who played Black icons Jackie Robinson and James Brown as well as the regal Black Panther on screen, died at the age of 43 after a four-year battle with colon cancer. On Jackie Robinson Day across the major leagues, the Houston Astros and Oakland Athletics jointly walked off the field following a moment of silence, draping a Black Lives Matter T-shirt across home plate as they chose not to play. (Other major league clubs had joined teams in the NBA, WNBA and MLS earlier in the week in calling off games while protesting social injustice.) The University of Alabama reported that an additional 481 students had tested positive for COVID-19, bringing the total to more than 1,000 infections since students returned to campus for the fall. Nevada officials reported what may have been the first documented case of coronavirus reinfection in the United States. Japan's longest-serving prime minister, Shinzo Abe, said he was stepping down because a chronic illness had resurfaced. (Abe was succeeded by his right-hand man, Yoshihide Suga.)

MANHATTAN – Anyone wanting to learn more about all facets of agriculture is encouraged to apply for Kansas Farm Bureau’s Ag Academy. 

The year-long program focuses on advocacy, leadership and service, education, rural communities and farm families. “Ag Academy offers a first-hand view of all the issues and challenges those in agriculture face on a daily basis,” program leader Pam Dankenbring says. “The program will have virtual and in-person sessions, including tours across the state that will give participants a detailed look at the faces and methods of production agriculture in Kansas.” Sept. 10 is the deadline to apply for Ag Academy. Anyone is welcome to apply, but class size is limited to 20 and there is a $100 fee due before the first in-person session. Meals at in-person sessions are provided, but travel, lodging and other costs are the responsibility of participants. Ag Academy begins in October and consists of seven capsules, which each have two sessions, one virtual and the other in-person. Times and locations for tours and speakers will be confirmed after participants are selected.

Saline County COVID update for Friday; most hospitalized unvaccinated

TOPEKA – Two Salina organizations have been awarded nearly $97,000 in grants to provide services for victims of crime, Kansas Attorney General Derek Schmidt announced today.

The grants were awarded to support the following programs:

Child Advocacy &amp; Parenting Services, Inc. (CAPS),&nbsp;$32,500 to increase support of child abuse victims through increased advocacy.

CAPS,&nbsp;$9,000, to support the Court Appointed Special Advocate (CASA) program to ensure an increased number of children are able to benefit from volunteer advocacy through quality training and supervision.

CAPS,&nbsp;$5,400&nbsp;for operating expenditures for children’s advocacy centers.

Domestic Violence Association of Central Kansas (DVACK),&nbsp;$50,000 to provide temporary emergency shelter and trauma-informed support services to victims of domestic violence, sexual assault and stalking, as well as their dependent children, in order to meet their immediate health and safety needs. Educational services will also continue to be provided to reduce the incidence of domestic and sexual violence.&nbsp;&nbsp;&nbsp;

“Organizations across Kansas do great work every day to support victims of crime,” Schmidt said. “We are proud to support these organizations through the victim services grant programs.”

The awards were made from the Protection from Abuse Fund, the State Crime Victims’ Assistance Fund, the State Crime Victims’ Assistance Fund for Child Abuse and Neglect, and the Children’s Advocacy Centers Fund. The Protection from Abuse Fund is funded by State General Fund appropriations, marriage license fees, county court costs and municipal court assessments. The State Crime Victims’ Assistance Fund is funded though the remittance of applicable fines, penalties and forfeitures from clerks of the district courts. The State Crime Victims’ Assistance Fund for Child Abuse and Neglect Fund is funded through county court costs, municipal court assessments and State General Fund appropriations. The Children’s Advocacy Centers Fund is funded though the remittance of applicable fines, penalties and forfeitures from clerks of the district courts.

This year, the attorney general’s office awarded nearly $2.3 million in grants to local and state crime victim assistance organizations. TOPEKA – Two Salina organizations have been awarded nearly $97,000 in grants to provide services for victims of crime, Kansas Attorney General Derek Schmidt announced today.The grants were awarded to support the following programs:Child Advocacy &amp; Parenting Services, Inc. (CAPS),&nbsp;$32,500 to increase support of child abuse victims through increased advocacy.CAPS,&nbsp;$9,000, to support the Court Appointed Special Advocate (CASA) program to ensure an increased number of children are able to benefit from volunteer advocacy through quality training and supervision.CAPS,&nbsp;$5,400&nbsp;for operating expenditures for children’s advocacy centers.Domestic Violence Association of Central Kansas (DVACK),&nbsp;$50,000 to provide temporary emergency shelter and trauma-informed support services to victims of domestic violence, sexual assault and stalking, as well as their dependent children, in order to meet their immediate health and safety needs. Educational services will also continue to be provided to reduce the incidence of domestic and sexual violence.&nbsp;&nbsp;&nbsp;“Organizations across Kansas do great work every day to support victims of crime,” Schmidt said. “We are proud to support these organizations through the victim services grant programs.”The awards were made from the Protection from Abuse Fund, the State Crime Victims’ Assistance Fund, the State Crime Victims’ Assistance Fund for Child Abuse and Neglect, and the Children’s Advocacy Centers Fund. The Protection from Abuse Fund is funded by State General Fund appropriations, marriage license fees, county court costs and municipal court assessments. The State Crime Victims’ Assistance Fund is funded though the remittance of applicable fines, penalties and forfeitures from clerks of the district courts. The State Crime Victims’ Assistance Fund for Child Abuse and Neglect Fund is funded through county court costs, municipal court assessments and State General Fund appropriations. The Children’s Advocacy Centers Fund is funded though the remittance of applicable fines, penalties and forfeitures from clerks of the district courts.This year, the attorney general’s office awarded nearly $2.3 million in grants to local and state crime victim assistance organizations. On Thursday, President Joe Biden ordered that flags be flown at half-staff until sunset on Monday to honor United States service members and other victims killed in Kabul, Afghanistan.

As a mark of respect for the U.S. service members and other victims killed in the terrorist attack on August 26, 2021, in Kabul, Afghanistan, by the authority vested in me as President of the United States by the Constitution and the laws of the United States of America, I hereby order that the flag of the United States shall be flown at half-staff at the White House and upon all public buildings and grounds, at all military posts and naval stations, and on all naval vessels of the Federal Government in the District of Columbia and throughout the United States and its Territories and possessions until sunset, August 30, 2021. I also direct that the flag shall be flown at half-staff for the same length of time at all United States embassies, legations, consular offices, and other facilities abroad, including all military facilities and naval vessels and stations.

Durham School Services in Salina wants you to help them stuff the bus.

The local school bus service plans to conduct a Stuff the Bus school supply collection event at the Salina Speedway, 2841 S. Burma Road, on Saturday. Gates at the Salina Speedway open at 5 p.m. Saturday.

Donated supplies will be given to USD 305 for use by students and staff who need them. Items Durham hopes to collect include backpacks, pencils, glue, folders, and crayons. Monetary donations also will be accepted and will be used to purchase school supplies.

A Salina man has been arrested in connection with a stabbing incident Thursday night.

There they found a 32-year-old Salina man who had sustained non-life-threatening injuries as a result of a disturbance with another male at 831 Charles Street. Officers then went to 831 Charles Street, where they arrested Maximilian Allen Raymond Wilson, 34, of Salina, on the requested charge of aggravated battery, Hanus said
