BARTON COUNTY —Law enforcement authorities are investigating a fatal arson fire and have a suspect in custody.

Just after 7 a.m. Friday, the Great Bend Fire Department and Great Bend Police Department responded to a residence located in the 2800 block of 29th Street in Great Bend, in reference to a structure fire.

Upon arrival at the residence, members of the Great Bend Fire Department located a 59-year-old woman inside of the residence and life saving measures were performed. The woman was pronounced dead at the scene and during a preliminary investigation of the incident, arson was determined to be the cause of the fire. Investigators also determined that the deceased victim's death was the result of foul play.

Around 7:19 a.m., the Great Bend Police Department responded to a residence in the 1500 block of Adams Street in reference to an aggravated burglary and battery related to the arson / homicide investigation.

The suspect left that area on foot and at approximately 8:12 a.m. was reported to be at Park Elementary School, 1801 Williams Street.&nbsp; Police officers located the suspect identified as Lyndsay George, in the 2000 Block of 19th Street.

After a physical altercation with police officers, George was arrested. After further investigation and interviews, George was booked into the Barton County jail on requested charges of murder in the 1st degree, aggravated arson, aggravated battery of a law enforcement officer, aggravated burglary, battery and criminal trespass.

During the course of the investigation, members of the Great Bend Police Department, Kansas Bureau of Investigation, Barton County Sheriff's Office, the Kansas Fire Marshal's Office and the A.T.F. obtained and executed search warrants in the 2800 block of 29th Street and at the Traveler's Budget Inn located at 4200 10th Street in Great Bend.

During the execution and thorough search of those locations, items of evidence were located and seized.&nbsp; Authorities have not released the name of the victim.

The victim's name is not being released at this time pending notification of family members.

Kansas woman jailed for fire that killed 59-year-old woman

The Supreme Court’s October 2021 term, which officially began on the&nbsp;<a href="https://constitutioncenter.org/blog/why-the-supreme-court-starts-on-the-first-monday-in-october" target="_blank">first Monday</a>&nbsp;of the month, promises to be an eventful one for those concerned about the First Amendment and its freedoms. The court will hear cases involving:

●A man on death row asserting a violation of his religious liberty rights;

 ●A dispute over whether a college system’s censure is a permissible exercise or a retaliatory act;

●Whether a Texas city can treat digital signs differently on the premises of businesses; and

●A school choice program that bars tuition assistance to parents who send their kids to religious schools.

These decisions will afford the justices an opportunity to explain the contours of religious liberty and to explore the reaches or limitations of important First Amendment free-speech principles, such as the&nbsp;<a href="https://www.freedomforuminstitute.org/2017/09/06/the-government-speech-doctrine-a-loophole-in-the-first-amendment/" target="_blank">government speech doctrine</a>&nbsp;and the&nbsp;<a href="https://www.freedomforuminstitute.org/2015/06/22/sign-ordinance-ruled-unconstitutional/" target="_blank">content discrimination principle</a>.

Let’s take a closer look at the First Amendment cases on the court’s docket.

RAMIREZ V. COLLIER: RELIGIOUS LIBERTY VIOLATED ON DEATH ROW?

On Nov. 1, the court will hear the case of&nbsp;John H. Ramirez, who was convicted of killing a convenience store clerk during a robbery. Ramirez is arguing that his religious liberty rights were violated when the state of Texas prohibited his pastor from laying his hands on him and from audibly praying and singing in the execution chamber. The state argues the restrictions are necessary for security.

Ramirez was set to be executed in early September, but the court granted a temporary stay to hear this appeal.

The appeal focuses on whether Ramirez adequately exhausted his remedies under the Prison Litigation Reform Act. But the court also specifically asked lawyers in the case to discuss whether Ramirez adequately showed that the actions of Texas officials in limiting his pastor substantially burdened Ramirez’s religious liberty rights under the&nbsp;<a href="https://www.justice.gov/crt/religious-land-use-and-institutionalized-persons-act-0" target="_blank">Religious Land Use and Institutionalized Persons Act</a>&nbsp;(RLUIPA).

HOUSTON COMMUNITY COLLEGE SYSTEM V. WILSON: CAN GOVERNMENT BODIES FREELY CENSURE MEMBERS WITHOUT FIRST AMENDMENT CONSTRAINTS?

The next day, Nov. 2, the court will hear arguments in Houston Community College System v. Wilson, which examines whether the First Amendment is violated when an elected board censures one of its members for critical speech.&nbsp;David Wilson, who served on Houston Community College System’s board of trustees, alleged that his fellow board members censured him in retaliation for his protected speech.

The college contends that throughout American history, elected bodies have censured their own members. In First Amendment law, the government often is prohibited from discriminating against private speakers because of their speech — but the government can also speak and take its own positions. It often is difficult to determine when the government is discriminating against private speakers or engaging in so-called government speech. In this case, the court could further explain or limit the reach of the government speech doctrine.

<a href="https://www.freedomforuminstitute.org/2017/06/29/justice-alito-and-the-government-speech-doctrine/" target="_blank">Government speech doctrine</a>: If the government is considered the actual speaker, then the government can speak and regulate largely immune from First Amendment scrutiny.&nbsp;&nbsp;

CITY OF AUSTIN, TEXAS V. REAGAN NATIONAL ADVERTISING OF TEXAS, INC: ARE SIGN PLACEMENT RULES CONTENT DISCRIMINATION?

On Nov. 10, the court will hear arguments in City of Austin v. Reagan National Advertising of Texas, a case that deals with digital signs. The City of Austin allows digital signs on the premises of a business, but not off premise.

An advertising company argues that the city’s disparate treatment of on-premise and off-premise signs amounts to content discrimination impermissible under the First Amendment.

“But, above all else, the First Amendment means that the government has no power to restrict expression because of its message, its ideas, its content and its subject matter.” –&nbsp;<a href="https://www.freedomforuminstitute.org/2013/02/04/justice-marshall-eloquent-first-amendment-defender/" target="_blank">Justice Thurgood Marshall</a>&nbsp;in 1972 capturing the essence of the content discrimination doctrine&nbsp;&nbsp;

The court ruled in&nbsp;<a href="https://caselaw.findlaw.com/us-supreme-court/13-502.html" target="_blank">Reed v. Town of Gilbert</a>&nbsp;(2015) that an Arizona town’s sign ordinance violated the First Amendment when it imposed different restrictions on political signs, ideological signs and so-called temporary directional signs.&nbsp;Justice Clarence Thomas&nbsp;reasoned that because the sign ordinance treated signs differently, it was a content-based law subject to strict scrutiny — the highest form of judicial review.

Justice Elena Kagan&nbsp;agreed that the Arizona ordinance violated the First Amendment but warned that an overly strict application of the content discrimination principle could turn the court into “a veritable Supreme Board of Sign Review.”

The Texas case gives the justices an opportunity to determine&nbsp;<a href="https://scholarlycommons.law.case.edu/cgi/viewcontent.cgi?article=4850&amp;context=caselrev" target="_blank">the reach of its reasoning in Reed and the content discrimination principle.</a>

CARSON V. MAKIN: CAN STATES BAR FUNDS FOR PARENTS WHO SEND THEIR CHILDREN TO RELIGIOUS SCHOOLS?

On Dec. 8, the court will hear arguments in Carson v. Makin to determine the constitutionality of a tuition assistance program in Maine that prohibits the state from aiding students who attend secondary schools that are classified as sectarian. The Maine Department of Education examines schools to determine whether they are sectarian or not.

The problem is that many students in Maine live in districts that do not operate a public secondary school. The Carson family lives in such a district; the children attend a private religious school, the Bangor Christian School. However, the Carsons cannot receive any tuition reimbursement because Bangor is considered sectarian.

The group suing on behalf of the Carsons and another family contends that this sectarian exclusion&nbsp;<a href="https://www.supremecourt.gov/DocketPDF/20/20-1088/168134/20210204140045165_Petition%20for%20Writ%20of%20Certiorari.pdf" target="_blank">violates both the Free Exercise and Establishment clauses</a>&nbsp;of the First Amendment: “There is a longstanding, entrenched split among the Courts of Appeals and state courts of last resort on whether government may bar participants in student aid programs from choosing to use their benefit to attend schools that provide religious instruction.”

“Congress shall make no law respecting an establishment of religion&nbsp;[<a href="https://www.freedomforuminstitute.org/first-amendment-center/topics/freedom-of-religion/establishment-clause-overview/" target="_blank">Establishment Clause</a>],&nbsp;or prohibiting the free exercise thereof&nbsp;[<a href="https://www.freedomforuminstitute.org/first-amendment-center/topics/freedom-of-religion/free-exercise-clause-overview/" target="_blank">Free Exercise Clause</a>] …”&nbsp;&nbsp;

The court in recent years seems to view such exclusions with suspicion. For example, in&nbsp;<a href="https://www.supremecourt.gov/opinions/19pdf/18-1195_g314.pdf" target="_blank">Espinoza v. Montana Department of Revenue</a>&nbsp;(2020) the court invalidated a Montana rule that barred scholarship funds from being used for students attending parochial schools. The court reasoned that the Montana rule unconstitutionally discriminates based on religious status.

This case provides the justices with an opportunity to clarify whether such differential treatment of religious schools violates the&nbsp;<a href="https://www.freedomforuminstitute.org/first-amendment-center/topics/freedom-of-religion/free-exercise-clause-overview/" target="_blank">Free Exercise Clause</a>&nbsp;rights of those who wish to attend such schools and still obtain the governmental benefits provided to those who attend secular schools.

TOPEKA —The suspect who walked away from from the Wichita Work Release Facility on Saturday is back in custody.

On Friday afternoon, 43-year-old Elvin Eugene Morris was taken into custody by officials from the Kansas Department of Corrections Enforcement Apprehensions &amp; Investigations (EAI) Unit and booked into Sedgwick County Jail.

Morris was placed on escape status Saturday, Oct. 2, 2021, after he failing to report back to correctional facility.

The Wichita Work Release Facility, a satellite unit of the Winfield Correctional Facility, is an all-male, minimum-custody state facility with a population of 250.

TOPEKA, Kansas –&nbsp;Minimum-custody resident Elvin Eugene Morris continues on escape status since 7:50 p.m. Saturday, October 2, after he walked away from the Wichita Work Release Facility, according to a media release from the Kansas Department of Corrections.

Morris, a 43-year-old black male, left for Walmart in the community at 4:05 p.m. and was reported missing when he did not report back to the facility following an approved community pass.

Morris is currently serving a sentence for a conviction in Sedgwick County for removing electronic monitoring equipment. Morris was last seen leaving the Wichita Work Release Facility at 400 South Emporia in Wichita, Kansas.

Morris is 5 feet 10 inches tall, 179 pounds with brown eyes and black hair. Morris was last seen wearing jeans and a long sleeved, button up, white shirt and gray sweatshirt.

Anyone with information on Morris can call the Kansas Department of Corrections at 316-265-5211, the Kansas Bureau of Investigation at (800) 572-7463 or local law enforcement at 911.

The&nbsp;escape&nbsp;is currently being investigated.&nbsp; New information will be released as it becomes available.

SHAWNEE COUNTY —Law enforcement authorities are investigating a series of business burglaries and have made an arrest.

On October 1 and October 4, police responded to A &amp; A Auto and Truck Parts Inc., 1440 SE Jefferson Street in Topeka, to take reports for two separate burglaries that occurred at the business, according to police department spokesperson Gretchen Spiker.

 In each burglary, the suspect took various items.

Throughout the course of the investigation, Curtis D. Callarman, 43 of Topeka was identified as the suspect in the burglaries.

On Tuesday, police arrested Callarman in the 3800 block of SW Topeka Blvd. and later booked him into the Shawnee County Department of Corrections on requested charge Burglary and Theft &lt;$1,500 From Building.

SEDGWICK COUNTY—A suspect identified as 31-year-old Danielle Robinson of Salina,&nbsp; wounded by police during an exchange of gunfire at a grocery store in Wichita, has been moved from the hospital to the Sedgwick County jail, according to online booking records.

Just after 8p.m. Monday, police responded to report of a suspicious person with a gun in the parking lot of the Whole Foods store, 1423 North Webb Road, in Wichita,&nbsp; according to Officer Trevor Macy.

&nbsp;Multiple 911 callers reported a woman at Whole Foods acting strangely, drinking, and brandishing a firearm. Witnesses reported the woman pointing a gun at windows of the store, and toward the parking lot.

At the scene, officers encountered the woman, later identified as Robinson, who pointed a gun in their direction. They gave verbal commands to the suspect to drop the gun but she did not comply and retreated into the store. There was an exchange of gunfire. The suspect fired one shot at officers that shattered a store window. Both officers returned fire, each firing six shots at the suspect.

After shots were fired, the officers rendered aid and placed Robinson in custody. EMS transported her to an area hospital for treatment of non-life-threatening injuries.&nbsp;

Police said there were more than a dozen shoppers and staff inside of the store when the shooting happened, but none were harmed.

Interviews with various witnesses on scene revealed that Robinson had been at the store consuming alcohol and attempted to rob a customer of their personal belongings.

Robinson was released from the hospital Tuesday afternoon booked into jail on various requested charges including aggravated assault, aggravated assault of a law enforcement officer and aggravated robbery.&nbsp; Both officers have been placed on administrative leave. They have worked for the Wichita Police Department for 8 and 19-years, according to Macy.

Following her arrest for the shooting in January in Salina, Robinson was arrested on requested charges of Aggravated assault, Aggravated burglary, Criminal use of a weapon and Interference with a law enforcement officer, according to online booking records.

 </figure>After shots were fired, the officers rendered aid and placed the female in custody. EMS transported her to an area hospital for treatment of non-life-threatening injuries. She has been identified as 31-year-old Danielle Robinson.Police said there were more than a dozen shoppers and staff inside of the store when the shooting happened, but none were harmed.Interviews with various witnesses on scene revealed that Robinson had been at the store consuming alcohol and attempted to rob a customer of their personal belongings.Upon release from the hospital, she will be booked into jail on various charges including aggravated assault, aggravated assault of a law enforcement officer and aggravated robbery.&nbsp; Both officers have been placed on administrative leave. They have worked for the Wichita Police Department for 8 and 19-years, according to Macy.---------

The Centers for Disease Control and Prevention said the coronavirus could spread more than 6 feet through the air, especially in poorly ventilated and enclosed spaces, but that such spread was uncommon and that current social distancing guidelines still made sense. As the Supreme Court began its new term, a statement from conservative justices Clarence Thomas and Samuel Alito suggested that the court needed to revisit its decision to affirm the right to gay marriage.

A Salina man learned that his camper had been stolen after a relative saw it in Junction City.

Kevin Keller, 52, of Salina, told police that his 2019 Jayco Feather camper, valued at $25,000, had been stolen from a storage lot in the 3400 block of Canterbury Drive, Salina Police Captain Paul Forrester said this morning. The storage lot owner, Carla Erlich, 52, reported that when she was at the lot at 2:30 p.m. Saturday, she found one of the gates open and the chain for the gate missing, Forrester said.

Keller was notified of the theft after a relative told Keller of seeing a pickup not driven by Keller pulling the camper in Junction City.

Junction City police stopped the pickup, which, as it turns out, was stolen out of Wichita, Forrester said. The driver, Brandon Cunningham, 38, of Wichita, was arrested by Junction City police and booked into the Geary County Detention Center Sunday afternoon on the following requested charges, according to booking information on the Geary County Detention Center website.

●Vehicle liability insurance; Knowingly drive uninsured vehicle

●Driving while license cancelled/suspended/revoked

When arrested, Cunningham was allegedly in possession of the lock for the gate at the storage lot. The lock was valued at $15.

Forrester said Salina police are requesting the following charges for Cunningham.

●Two counts of criminal damage to property

Free museum virtural program to look at area ghost towns

This was a reference to the widespread belief that each of us got to where we are by our own singular hard work.&nbsp; Nobody else helped us. And getting assistance from others is a sign of weakness. It harkens back to the glorified “mountain man” image of living alone in pioneer times.

This was a reference to the widespread belief that each of us got to where we are by our own singular hard work.&nbsp; Nobody else helped us. And getting assistance from others is a sign of weakness. It harkens back to the glorified “mountain man” image of living alone in pioneer times. I refrain from replying because it would be impolite. I would like to tell them to put on clothes only they made, mount the horse they tamed, astride the saddle of leather they cured, ride back to the log cabin they constructed—and stay off of the public roads! They are clueless of the extent that our modern society is only possible through a vast network of cooperation: a community working together. &nbsp; The early prosperity of the United States rested on our huge supply of natural resources and our smaller population. In a simpler time, there was plenty of opportunity for a person to survive in relative isolation with “rugged individualism.” Today, this viewpoint mostly survives in our sparse rural West. In ranching country, you can still ride for miles without seeing another person. But today’s world has 7.8 billion people and is growing. Many other cultures, especially in Asia, grew up in intensely crowded conditions. Asian languages developed a completely different view of a world where they lived elbow-to-elbow even in earlier times. And “in Chinese there is no word for ‘individualism.’ The closest one can come is the word for ‘selfishness’.” &nbsp; This quote is one of many distinctions described by Richard E. Nisbett in “The Geography of Thought: How Asians and Westerners Think Differently...and Why” released in 2003. Nisbett is a Distinguished Professor of social psychology and co-directs the Culture and Cognition program at the University of Michigan at Ann Arbor. He provides many examples of how Asians and Westerners “...have maintained very different systems of thought for thousands of years.” Westerners focus on achieving control of the environment and of other people. Asian minds focus on self-control in order to minimize friction with others in their family and village. Western thought is based on Greek debate, where one argument wins out over the other. The Asian mind is based in a Confucian ideal of maintaining harmony—of finding the middle way.&nbsp; We think in terms of individual “rights”. Asians think in terms of an individual’s “responsibility” to a group. Our rights equals their responsibility.&nbsp;&nbsp; &nbsp;In English, my name is John Schrock. But in Asian languages, I would be Schrock John. Your family name and your family comes first. You are always part of your immediate and extended family. As a person becomes old, they are respected. This is reflected in addressing the elderly as “Laode.” The term for “respected” or “Lao” is also in the general term for teacher “Laoshi.” Today’s Asian cultures still contain the Confucian ethic of respect for the teacher. Thus the term for teacher has this word for respect always embedded in it. They respect and value teachers. Westerners do not. Western thought has a “certainty in consequences”—when an event occurs, we make an immediate judgement of whether it is good or bad. Nisbett relates an ancient Chinese story: An old farmer’s only horse runs away. Neighbors come to commiserate with him. But the farmer rejects their sympathy: “Who knows if it is good or bad?” he says. Later the horse returns, bringing along a wild horse. The man’s friends now congratulate him, but he replies again “Who knows what is bad or good?” A few days later, the man’s son attempts to ride the wild horse and is thrown and breaks his leg. Again, the farmer turns away his neighbors’ sympathy. Weeks later, the army comes to the village to conscript the able-bodied men to fight, but his crippled son is spared....and on and on the story goes. Asians can wait and see. When this pandemic began, I reached for the face masks that I brought back from a winter semester when I taught in China in 2012. Throughout Asia, from Seoul to Shanghai to Singapore, everyone walking the streets wore face masks to protect others. Today, they cannot understand what we mean by “rights” and “individualism.”&nbsp; Instead they speak and feel “responsibility.” They reject individualism as&nbsp; “selfishness” which it is. &nbsp; A review of Nisbett’s book concludes: “Understanding the thought processes of other cultures may very well turn out to be critical to the survival of Western civilization....”&nbsp;&nbsp;John Richard Schrock has trained biology teachers for more than 30 years in Kansas.
