SEDGWICK COUNTY—Law enforcement authorities&nbsp; investigating a fatal weekend shooting&nbsp; have a suspect in custody.

According to Sedgwick County booking records, Derby Police arrested 22-year-old Demarc Maurice Burgess late Monday in the 200 Block of North Baltimore in connection with the alleged crime.

Just before 3 a.m. on Sunday, police responded to the report of a shooting at 1215 N. Westview in the city of Derby, according to a statement from the city.

Officers located several witnesses to the shooting and one adult male who was suffering from a gunshot wound. EMS transported the victim to a local hospital where he died.

Police asked the public for help to locate a&nbsp; suspect described as a Black male, approximately mid 20s, with a slender build and a street name of “D” or possibly “Dee”.&nbsp;&nbsp;

Burgess is<a href="https://ssc.sedgwickcounty.org/sheriffinmates/SheriffInmateDetail.aspx?nameId=20078401"> being held on requested </a>charges of 2nd degree murder, intentional, according to online jail records.

Police arrest suspect in weekend killing at Kan. home

SHAWNEE COUNTY —Law enforcement authorities are investigating two suspects who were captured after prompt action by a citizen to notify the sheriff's department that a crime had just occurred.

On August 26, a homeowners surveillance camera caught a package theft at a home in the 2300 Block of SW Indian Trail, according to Deputy Abigail Christian.

Detectives were quickly able to identify suspects seen on the video taking the packages.&nbsp; Deputies detained 35-year-old Chelsea Mullinix and 24-year-old Kelsey Sanstra both of Topeka for questioning.

Both were booked into the Shawnee County Department of Corrections on requested charges of theft, possession of stolen property and conspiracy to commit theft. Mullinix also faces multiple traffic violations.&nbsp;

WASHINGTON (AP) — As Republican-led states continue to&nbsp;<a href="https://apnews.com/article/abortion-us-supreme-court-health-nashville-idaho-3c1fa60987ad945b4935d2ac8c1f318f">ban nearly all abortions</a>, President Joe Biden said Friday that such restrictions were “beyond the pale.”

Biden and Democrats are trying to&nbsp;<a href="https://apnews.com/article/2022-midterm-elections-abortion-biden-us-supreme-court-health-dc870c873aec72e5c266133a01694aa3">harness outrage</a>&nbsp;over the Supreme Court's decision to overturn Roe v. Wade, which legalized abortion nationwide, in this year's midterm elections.

“You’re going to hear women roar on this issue, and it’s going to be consequential,” he said.

Biden made the comments at a White House meeting of state and local officials to talk about ways to expand access to abortion and to mark Women's Equality Day. Kansas State Senator Dinah&nbsp;<a href="http://www.kslegislature.org/li/b2021_22/members/sen_sykes_dinah_1/">Sykes of Lenexa&nbsp;</a>&nbsp;attended the meeting.

Biden reiterated his desire for Congress to codify Roe v. Wade into law, but "we're short a handful of votes," he said.

Democrats would need 10 Republican votes to overcome a filibuster and get a bill through the 50-50 Senate, but only two GOP senators have publicly backed abortion rights. And even though they narrowly control the Senate, Democrats don't have enough votes to sidestep the filibuster.

“The only way it's going to happen if the American people make it happen in November,” Biden said.

In the meantime, Biden has been looking for ways to protect abortion access. But his options are limited.

Idaho, Tennessee and Texas are the latest Republican-led states to tighten their restrictions. They've been implementing so-called “trigger laws" that were put on the books to severely limit abortions if Roe was overturned, which happened in June.

Lina Hidalgo, the county judge from Harris County, Texas, called her state's law a “slap in the face.”

"I think you speak for the majority of the American people," Biden responded.

Biden calls abortion restrictions 'beyond the pale'

BUTLER COUNTY —Law enforcement authorities are investigating a weekend murder at a rural Kansas home and have a suspect in custody.

Just before 7a.m. Saturday, Butler County deputies were dispatched to a third party report of a possible shooting in the 7900 block of SW 163rd Street, rural Augusta, an area commonly known as Gordon, according to&nbsp;Undersheriff Daimon Cundiff.

 A person called 911 and told dispatchers that a family member had contacted them stating they had shot another individual in the home. 

Upon arrival of patrol deputies a perimeter was established and deputies attempted to make contact without success. Based upon the nature of the report, the situation was treated as a barricaded subject and the Butler County Sheriff’s Office Tactical Team was deployed to the residence. 

After numerous unsuccessful attempts to make contact with people inside the home the tactical team made entry and took a 56-year-old male resident into custody. Deputies found a deceased 51-year-old female in the residence who appeared to have a gunshot wound. The case is being investigated as a murder.

The 56-year-old has been booked into the Butler County Jail on requested charges of First Degree Murder. Names of the victim and suspect are being withheld until official identification of the deceased as well as notification of next-of-kin, according to Cundiff.

56-year-old jailed for deadly shooting at rural Kansas home

November 12, 1930 ~ August 26, 2022 (age 91)

Robert D. “Bob” Kopsa, the son of Charles Wilson Kopsa and Hattie Vaneta (Peterson) Kopsa, was born November 12, 1930 in Cuba, Kansas and passed away on August 26, 2022 at the Blue Valley Lutheran Courtyard Terrace, Hebron, NE at the age of 91 years, 9 months, and 14 days.

Bob grew up in the Cuba/Munden area, graduating from Whitelock Grade School.&nbsp;&nbsp; He attended high school in Belleville for one year, and then attended Narka High School, graduating in 1948.

Following his schooling, he worked for Verle Holloway on the farm.&nbsp;&nbsp; Bob then served with the U. S. Marine Corps from 1951 until 1953, serving in Korea during the Korean War.

He returned to the area after his discharge and began farm work, working for the Holloway and Welch farms. Bob later worked at the Flowers Dairy in Fairbury, NE. He also worked at Foote’s for several years and was a janitor at the Hubbell, NE grade school and was a school bus driver. He worked for Scott Mumm Farms also until the age of 85 and still would assist during harvest for many years.

He was united in marriage to Eilene Welch and to this union four children were born.&nbsp; They were later divorced.

He later was united in marriage to Phyllis (Edwards) Gertison and her three daughters joined the family.&nbsp; She preceded him in death

Bob was a member of the Lions Club, Hubbell, NE; a volunteer fireman for Chester Fire and Rescue for several years. He liked going to basketball games, going to races and dances, and enjoyed polka music.

He was preceded in death by his parents Charles and Hattie Kopsa; his wives Eilene and Phyllis; two brothers, Clair (Gail) Kopsa and Don (Elaine) Kopsa;&nbsp;one sister, Betty (Eldon) Evert; niece,Vicki Hallagin, and stepdaughter Peggy Iwert.

Bob is survived by his children&nbsp; Vaneta (Gerald) Moore of Munden, KS,&nbsp;Rebecca (Arlan) Benyshek of Cuba, KS, Kevin Kopsa of Chester, NE, Lana Kopsa of Lincoln, NE, and Becky (Mick) Gausman of Chester, NE;&nbsp; 11 grandchildren:&nbsp;Andy (Julinne) Moore of Sabetha, KS, Luke (Tracey) Moore of Munden, KS,&nbsp;Daniel Moore of Munden, KS, Amber (Jesse) Versch of Hornick, Iowa, A.J. (Abby) Gausman of Deshler, NE, Kyle (Patty) Joy of Sutton, NE, Laura Joy of Narka, KS,&nbsp;Tina Bramhall, Nikki Bays, Fred Iwert, and John Iwert; and 15 great-grandchildren, other relatives and friends.&nbsp;

Cremation was selected and graveside memorial services will be held at 2:00 p.m., Saturday, September 3, 2022 at the National Bohemian (Kopsa) Cemetery.

Military graveside rites will be conducted by the U. S. Marine Corps Honor Guard.

S. Marine Corps from 1951 until 1953, serving in Korea during the Korean War.He returned to the area after his discharge and began farm work, working for the Holloway and Welch farms. Bob later worked at the Flowers Dairy in Fairbury, NE. He also worked at Foote’s for several years and was a janitor at the Hubbell, NE grade school and was a school bus driver. He worked for Scott Mumm Farms also until the age of 85 and still would assist during harvest for many years.He was united in marriage to Eilene Welch and to this union four children were born.&nbsp; They were later divorced.He later was united in marriage to Phyllis (Edwards) Gertison and her three daughters joined the family.&nbsp; She preceded him in deathBob was a member of the Lions Club, Hubbell, NE; a volunteer fireman for Chester Fire and Rescue for several years. JEFFERSON CITY, Mo. (AP) — A new Missouri law outlawing books with sexually explicit images from school libraries is about to take effect.

Starting this week, it will be a misdemeanor punishable by up to a year in jail or a $2,000 fine for librarians and other educators to give students access to such material.

The law does not apply to written descriptions of sex or sexual acts; only photos, drawings, videos and other visual depictions are prohibited.

<a href="https://www.senate.mo.gov/22info/pdf-bill/tat/SB775.pdf">The law defined explicit sexual material</a>&nbsp;as images “showing human masturbation, deviate sexual intercourse," “sexual intercourse, direct physical stimulation of genitals, sadomasochistic abuse,” or showing human genitals.

There are exceptions for anatomy, biology, sex education, art and other images considered educational.

Melissa Corey, the president of the Missouri Association of School Librarians, said the law likely will only apply to certain comic books and graphic novels, which are longer comic books.

Republican state Sen. Rick Brattin spearheaded the legislation by&nbsp;<a href="https://apnews.com/article/missouri-sexual-assault-74c89557a67cc8819f1dcc599f33b03c">tacking it on to another bill</a>&nbsp;aimed at protecting sexual assault victims’ rights. He initially proposed a more expansive ban that would have prohibited written descriptions of sexual acts, but that was scaled back during closed-door negotiations.

“When you go read the definition of what is outlawed — literal sex acts, graphic human masturbation — these are things that are within the definition, and people are finding this controversial that it should be before kids,” Brattin said. “I'm really blown away by how controversial this has turned.”

Democratic state Sen. Barbara Washington said Democrats tried to limit the scope of the law to save books such as Nobel laureate Toni Morrison’s debut novel “The Bluest Eye," which is not banned under the new law.

“We have works of art and books of literature that may have things that may be offensive to some, but taken as a whole would not necessarily be offensive,” Washington said.

Brattin cited “Fun Home: A Family Tragicomic” as a book he wants to see removed from schools under the new law. The graphic memoir is about author Alison Bechdel’s fraught relationship with her late father and includes drawn depictions of masturbation and oral sex.

Corey said it's unclear which books, if any, will be pulled from Missouri school libraries. Those decisions are made at the school district level, and she said schools have policies that outline the formal process for reviewing which books students can access.

Corey said the association advised librarians to work with local school boards to best follow the law, particularly the exceptions for art and biology.

“It ultimately is up to how the school board is going to interpret the bill upon legal counsel,” she said.

Librarians follow district-specific policies in deciding which books to offer Missouri students, Corey said. She said books are approved for different grade levels based on what educators deem is age-appropriate, meaning high school students and kindergarteners do not have access to the same literature.

Corey said Missouri librarians want representation in literature and for students "to see themselves reflected in books."

She cautioned against going too far in limiting what material students can access.

“When you are looking at challenging or reviewing a book it really becomes a very slippery slope,” Corey said. “That is something that we really need to think about.”

The issue likely will resurface in the upcoming legislative session, which begins in January. Brattin said written descriptions of sexual acts are some Republicans' next target.

“School districts definitely need to be on notice that that’s going to be the next attempt," Brattin said. "A lot of this material is literary.”

JACKSON COUNTY —Law enforcement authorities are investigating two suspects on drug charges after a traffic stop.

Just after 1a.m. Friday, a sheriff's deputy stopped a 2009 Jeep Compass near 150th and Q. Road for an alleged traffic infraction, according to Sheriff Tim Morse.

An occupant of the vehicle, allegedly attempted to discard a meth pipe in the ditch during the stop.

 A  search of the Jeep led to the discovery of more contraband.&nbsp; Deputies arrested and booked Barbara Michelle Morris, 39, of Olathe into the Jackson County Jail for distribution of methamphetamine, possession of a hallucinogenic drug, possession of drug paraphernalia, and interference with law enforcement.

 Jason Wayne Alexander, 41, of Ottawa, was arrested booked into the Jackson County Jail on requested charges of possession of Tramadol and drug paraphernalia.

Sheriff: Kan. suspect tried to discard meth pipe during traffic stop

SHAWNEE COUNTY—Law enforcement authorities are investigating a suspect on multiple charges after a an arrest.

Just after 5a.m. Friday, a citizen called the Shawnee County Emergency Communications Center regarding a suspicious vehicle parked in her driveway with a male driver, according to Deputy Abigail Christian.

A Drug Recognition Expert (DRE) deputy observed a 2003 Chevrolet Silverado pickup truck near SE Croco Road and SE 53rd Street that matched the description of the suspicious vehicle. 

The DRE deputy conducted a traffic stop when the Chevrolet failed to signal a right turn. During the investigation, it was determined that the driver was too impaired to drive and illegal narcotics were located.

The deputy arrested Tyler E. Schrock, 35, of Topeka and booked him into the Shawnee County Department of Corrections on requested charges of driving under the influence, possession of methamphetamine, possession of drug paraphernalia, transporting an open container of liquor and making an improper turn.

SEDGWICK COUNTY—Authorities investigating another inmate death in Wichita have release the name of the man who died.

Just before 1p.m. Wednesday, staff at the Sedgwick County Detention facility found a 38-year-old&nbsp;Joseph Brueggeman of Wichita unresponsive in a housing unit, according to Lt. Benjamin Blick.

Detention staff immediately started cardiopulmonary resuscitation (C.P.R.). Medical Staff responded to the housing until and continued C.P.R. on the inmate.

Emergency Medical Services (E.M.S.) was called. E.M.S. declared the Brueggeman deceased and C.P.R. was ceased at approximately 1:15 p.m. The Sedgwick County Sheriff’s Office Investigation’s Unit and the Kansas Bureau of Investigations (K.B.I.) were notified of the in-custody death.

The Investigation’s Unit and K.B.I. processed the scene. A preliminary investigation indicates the death appears to be from natural causes. An autopsy is pending at the Forensic Science Center. Brueggeman's immediate family members were notified. This is the fourth in-custody death in 2022.

Brueggeman was a pretrial detainee on a municipal misdemeanor charge of violating a protection order. He was in custody since August 11, 2022.&nbsp;

Zito, a Manhattan resident challenging Republican Rep. Mike Dodson in
 November, said the three-pronged package unveiled Thursday by House 
Democratic representatives and candidates would benefit students, 
parents and employers interested in making Kansas higher education more 
affordable.

“I have a five-year-old son,” she said. “I’m still paying my student loans and I have to save for his education.”

Under the proposal from Democrats to be filed prior to the 2023 
legislative session in January, a $150 tax rebate would be available to 
parents of college-age children to help pay for college fees, books and 
supplies.

The annual deadline for contributing to a Kansas Learning Quest 529 
college savings account would be extended to April 15. This&nbsp; change 
would enable individuals to make contributions to the college savings 
account retroactively to the previous tax year. The adjustment would be 
in line with federal law on backdating IRA contributions.

The plan also would create a tax credit for Kansas businesses 
voluntarily contributing to student loan payments on behalf of 
employees. The credit modeled on Connecticut law would allow companies 
to claim a refundable 50% state tax credit for subsidizing loan 
repayments. The maximum credit would be $5,250 per student per year. No 
single employer could claim more than $500,000 in credits in a single 
tax year. The measure would cap cost of the program to the state at $5 
million annually.

Each provision of the plan from Democrats would be applicable to 
students attending a university, community college or technical college 
in Kansas.

“I hear from Kansans on a weekly basis about their financial 
concerns,” said House Minority Leader Tom Sawyer of Wichita. “More often
 than not, student loans are one of the pain points. Parents worry about
 paying their own student loans while taking on the burden of a child’s 
student loans, too.”

The Kansas Department of Revenue estimated the annual cost of the 
package would be $44 million. The bulk of the total, potentially $39 
million per year, would be tied to the $150 individual income tax credit
 on college expenditures.

State Treasurer Lynn Rogers, who administers the Learning Quest 
saving program, said the reform bill would extend from Dec. 31 to April 
15 the deadine for people to qualify for state income tax deductions on 
the prior tax year’s income. The maximum annual deduction through the 
program is $6,000 for joint filers.

“A well-educated Kansas workforce remains one of the most critical components to the economic growth of our state,” Rogers said.

Chris Courtright, who served on the tax reform council assembled by 
Gov. Laura Kelly, said elements of the plan were considered by the 
council before the decision to focus on eliminating the state’s sales 
tax on groceries by July 1.

The Legislature adopted a three-year phase out of the 6.5% sales tax 
on groceries, but the governor recommended the 2023 Legislature adopt an
 immediate end to the state’s portion of that tax.

“A lot of us anticipate a robust debate on tax policy in the upcoming
 2023 session,” said Courtright, who indicated the $44 million package 
would be a modest component of the next round of state tax reforms.

State Rep. Jerry Stogsdill, a Prairie Village Democrat, said lifting 
the weight of college cost and debt ought to be a bipartisan issue at 
the Capitol.

“We want to make sure that any post-secondary student has the means 
to gain the education to become a productive, skilled and 
well-compensated employee or business owner,” he said.

U.S. Rep. Ron Estes, a Republican from Wichita, said he opposed 
Biden’s student loan forgiveness program because the program would cost 
as much as $300 billion over the next decade. He linked the Biden 
strategy to legislation adopted by Congress that conservatives believe 
contributed to rising inflation.
