SEDGWICK COUNTY —A Kansas man accused of violent sex crimes made his first court appearance in the case this we.

Hunter Peach, 23 of Wichita, is charged with 3 counts of rape, 2 counts of aggravated domestic battery, and 2 counts of attempted aggravated criminal sodomy, according to the Sedgwick County District Attorney's office.

On October 17, a 23-year-old woman reported she was sexually&nbsp; assaulted by Peach, according to Officer Chad Ditch.&nbsp;

Police located Peach and arrested him in the 400 block of West Central in Wichita and booked him on requested sex crimes.

&nbsp;Peach and the woman know each other, according to police. He is in the Sedgwick County Jail on a bond of $300,000, according to the district attorney's office.&nbsp; His next court hearing is October 31.

Kansas man charged for violent sex crimes

A local man was booked into jail after he allegedly fled a traffic stop Friday night in west-central Salina.

A Saline County deputy stopped a 2012 Chrysler 300 in the 900 block of W. Prescott Avenue at approximately 10:50 p.m. Friday, Salina Police Captain Paul Forrester said this morning.

A Salina Police officer familiar with the driver also responded to the stop. As the officer arrived on the scene, the driver, who was identified as Camron Glover, 27, of Salina, was talking to the deputy. Glover allegedly walked toward his vehicle and then took off running to the northwest, Forrester said.

The deputy chased Glover on foot, while the officer, who was still in his patrol vehicle, followed in the vehicle.

Glover allegedly ran into a yard in the 500 block of Montrose Street and climbed a six-foot privacy fence, breaking four of the pickets in the fence, Forrester said. Glover then allegedly ran through the yard and climbed the back fence, where he broke two more pickets.

Total damage to the fence was estimated at $24.

Forrester said another officer in the area was able to apprehend Glover in the 500 block of S. Clark Street.

Glover was booked into the Saline County Jail on the following requested charges, according to the jail booking report.

While an officer was attempting to cite Mathews for theft of lost or misplaced property, Mathews allegedly attempted to slap the citation book out of the officer's hand.

Forrester said Mathews was then arrested on the following requested charges.

Dispute over dog ownership lands one man in jail

SHAWNEE COUNTY—Law enforcement authorities are investigating a burglary and have a suspect in custody.

Just after 1a.m. Sunday, police were dispatched to the 800 block of SE 15 Street on a report of a burglary alarm to a business, according to Lt. Ronnie Connell.

When officers arrived on scene, they observed a subject fleeing from the property. Officers took the suspect identified as a juvenile into custody.

Police also recovered items taken from the business from the juvenile and returned them to the business.

The juvenile was booked on requested charges of Burglary, Theft, Criminal Damage and Obstruction, according to Connell.

Police catch juvenile during Kansas business burglary 

BELLE PLAINE, Kan. (AP) — An undersheriff in rural Kansas faces a manslaughter trial Monday for fatally shooting an unarmed man with a homemade beanbag round out of his personal shotgun, a case that comes amid a national reckoning on police violence.

Jury selection will start in the trial of Virgil Brewer, who was with the Barber County Sheriff's Office at the time of&nbsp;<a href="https://apnews.com/article/48f367e57fc14cb39febf89f3d501feb">the deadly encounter with Steven Myers</a>&nbsp;in October 2017 outside a shed in Sun City, about 300 miles (555 kilometers) from the Kansas City, Kansas.

A civil lawsuit brought by Myers’ family against Brewer and then-Barber County Sheriff Lonnie Small was settled in 2020 after&nbsp;<a href="https://apnews.com/article/8480d5726b3275a28130abeeea1faae0">county officials agreed to pay $3.5 million</a>.

Brewer’s criminal trial is expected to focus on whether his&nbsp;<a href="https://apnews.com/article/03fbce83f90a495ba80be7f80a5ce4b2">lack of knowledge and training</a>&nbsp;with the less-lethal munitions amounted to reckless involuntary manslaughter.

Defense attorney David Harger did not respond to messages seeking comment on the case. Brewer has been on unpaid leave since his 2018 arrest. He has been free pending trial.

“The fact of the matter is that it is not going to be a good outcome for anybody, no matter whether or not he gets convicted," Steven Myers' widow, Kristina Myers, told The Associated Press on Thursday. "Yes, it will be over in that sense, but this one bad decision has ruined the lives of so many people.”

On the evening of Oct. 6, 2017, Brewer was carrying his personal weapon when he, along with the sheriff and a sheriff’s deputy, responded to a call about a man holding a rifle on a street after an altercation at a local bar.

About five minutes before the fatal shooting, Small said: “A little luck and he’ll just pass out and die,” a remark captured on the sheriff’s body camera as they searched for Myers. They eventually found him hiding in a shed.

Both Brewer and the deputy later told the Kansas Bureau of Investigation that they could clearly see that Myers was not armed when they confronted him outside the shed, according to the probable cause affidavit obtained by AP.

Body camera footage reviewed by investigators shows Brewer repeatedly told Myers to “get on the ground” before shooting him, while Deputy Mark Suchy gave conflicting commands to “put your hands up now.” Seconds later, Brewer shot Myers with one round.

Brewer told the Kansas Bureau of Investigation during an interview that he was in fear for his and the deputy’s lives when Myers continued to walk toward them, adding that he did not expect the beanbag round to penetrate Myers’ chest.

The deputy’s body camera video showed Myers was not making any aggressive movement at the time Brewer shot him, according to Bureau Agent Brian Carroll in an affidavit in support of the criminal charge against the undersheriff.

“Myers was never told he was under arrest, Myers was never warned that his failure to comply with commands would result in the use of the impending force,” Carroll wrote.

Brewer then discharged his personal weapon at too close of a distance and shot Myers in the chest, a lethal force zone.

Carroll’s affidavit contends that Brewer’s lack of knowledge and training regarding the proper use of less-lethal beanbag munitions recklessly caused Myer’s death. Proper training would have provided critical information about the proper distance to deploy the round and the proper target zone on a person.

Such training would have also informed Brewer about past problems with rectangular-shaped bean bags like the one he used, Carroll wrote. Those are known to penetrate subjects shot with them, and their use has been discontinued for years. The rounds used today are rounded, balloon-shaped bean bags, according to the affidavit.

Before coming to Kansas, Brewer worked in Texas where he was given the beanbag ammunition used the evening of Myers’ death. The affidavit revealed that the Kansas Bureau of Investigation interviewed Travis Martin, the deputy at the Freestone County Sheriff’s Office in Texas who gave Brewer the ammunition.

Martin, who is expected to testify, told the agency that after speaking with the beanbag maker, that type of ammunition would no longer be carried and should not be fired on a person.

Martin told investigators that he “thought he had talked with Brewer about not using the ammunition on a person,” according to the affidavit.

Medical Examiner Timothy Gorrill is also expected to take the witness stand. His autopsy found the cause of death to be a penetrating shotgun bag wound to the trunk with the manner of death ruled a homicide.

Kristina Myers said she has been subpoenaed, adding she hopes to be allowed to watch the trial after her testimony.

“It doesn’t bring him back, but it does give us a sense of justice,” she said. “Everyone, no matter their occupation, should be held responsible for their actions. All actions have consequences.”

They eventually found him hiding in a shed.Both Brewer and the deputy later told the Kansas Bureau of Investigation that they could clearly see that Myers was not armed when they confronted him outside the shed, according to the probable cause affidavit obtained by AP.Body camera footage reviewed by investigators shows Brewer repeatedly told Myers to “get on the ground” before shooting him, while Deputy Mark Suchy gave conflicting commands to “put your hands up now.” Seconds later, Brewer shot Myers with one round.Brewer told the Kansas Bureau of Investigation during an interview that he was in fear for his and the deputy’s lives when Myers continued to walk toward them, adding that he did not expect the beanbag round to penetrate Myers’ chest.The deputy’s body camera video showed Myers was not making any aggressive movement at the time Brewer shot him, according to Bureau Agent Brian Carroll in an affidavit in support of the criminal charge against the undersheriff.“Myers was never told he was under arrest, Myers was never warned that his failure to comply with commands would result in the use of the impending force,” Carroll wrote.Brewer then discharged his personal weapon at too close of a distance and shot Myers in the chest, a lethal force zone.Carroll’s affidavit contends that Brewer’s lack of knowledge and training regarding the proper use of less-lethal beanbag munitions recklessly caused Myer’s death. Proper training would have provided critical information about the proper distance to deploy the round and the proper target zone on a person.Such training would have also informed Brewer about past problems with rectangular-shaped bean bags like the one he used, Carroll wrote. Those are known to penetrate subjects shot with them, and their use has been discontinued for years. The rounds used today are rounded, balloon-shaped bean bags, according to the affidavit.Before coming to Kansas, Brewer worked in Texas where he was given the beanbag ammunition used the evening of Myers’ death. The affidavit revealed that the Kansas Bureau of Investigation interviewed Travis Martin, the deputy at the Freestone County Sheriff’s Office in Texas who gave Brewer the ammunition.Martin, who is expected to testify, told the agency that after speaking with the beanbag maker, that type of ammunition would no longer be carried and should not be fired on a person.Martin told investigators that he “thought he had talked with Brewer about not using the ammunition on a person,” according to the affidavit.Medical Examiner Timothy Gorrill is also expected to take the witness stand. His autopsy found the cause of death to be a penetrating shotgun bag wound to the trunk with the manner of death ruled a homicide.Kristina Myers said she has been subpoenaed, adding she hopes to be allowed to watch the trial after her testimony.“It doesn’t bring him back, but it does give us a sense of justice,” she said. “Everyone, no matter their occupation, should be held responsible for their actions. All actions have consequences.”

Back on July 11, 2021, I had written a column titled “Science, Not Spies, Will Determine COVID-19 Origin.” It was picked up worldwide by newspapers in Norway, Pakistan, India, Hong Kong and elsewhere. Our newly-elected President Biden had ordered a 90-day investigation by the U.S. intelligence community into the origins of the COVID-19 pandemic and that report’s conclusion, which Biden summarized on August 27, 2021, arrived at nothing. Spies are not scientists. I had clearly pointed out historical cases where the “intelligence” community got the reality wrong, especially our claim that Saddam Hussein’s Iraq had weapons of mass destruction.&nbsp;&nbsp; &nbsp;

Only scientists can solve a science problem. We have now seen tremendous strides in knowledge of virus genetics and evolution over this additional year. Scientists worldwide have developed more-refined technology to detect and trace viral strains. These results have come together in a series of solid reports linking the Wuhan markets with the original outbreak cases. In the August 26, 2022 issue of "Science," 18 Western scientists found that in late 2019, live SARS-CoV-2-susceptible mammals were sold and SARS-CoV-2-positive environmental samples were associated with venders selling live animals.&nbsp; They also found that by mapping the early cases, “...the Huanan market was the epicenter of the COVID-19 pandemic.”

Another study by 29 researchers focusing on the unique genome of early strains discovered that the early SARS-CoV-2 virus had already existed in two distinct viral lineages they label as “A” and “B” before February of 2020, indicating that there were “...at least two separate cross-species transmission events” where the virus was transmitted into humans. &nbsp;

Back in July of 2021, a Politico-Harvard poll found that 52 percent of U.S. adults believed Covid-19 leaked from a lab.&nbsp; A survey conducted by Morning Consult in mid-2021 found that 70 percent of Republicans and 32 percent of Democrats believed the virus spilled from a lab in Wuhan, China. Only 11 percent of Republicans and 40 percent of Democrats think the virus spread from animals.

Former Secretary of State Mike Pompeo stated on an ABC program that “there’s enormous evidence” the coronavirus came from the Wuhan virology lab, but he agreed with the intelligence report that there was no evidence the virus was man-made or genetically modified.

Today, the worldwide science community is still waiting for any solid evidence that the SARS-CoV-2 virus was in any way engineered in a lab. And as time advances, we gain more studies clarifying the genetic modifications this virus has undergone in its evolution from a bat virus origin to its wider range of hosts.

The only likely knowledge that our “intelligence” community could contribute is China’s history in our World War II battle with Japan. A Japanese Unit 731 grew typhoid and black plague disease agents on captive prisoners, and then released the infected lice and fleas from overhead “bombing,” resulting in hundreds of thousands of Chinese deaths from these biological warfare agents. The Japanese officers of Unit 731 never faced the Tokyo war crimes trials because the U.S. was interested in their hazmat technology and biowarfare techniques. Because this horrible history is known by all modern Chinese, any resort by their government to develop biological warfare would result in massive public opposition.&nbsp; &nbsp;

However, America’s extensive research developing biological warfare is not in our history books. It ended when President Nixon signed a convention to discontinue our biological weapons programs. This stopped any further research into biological warfare agents that had formerly been a major effort at Fort Detrick, the Pine Bluff Arsenal, the Dugway Proving Ground, and elsewhere. Indeed, during the time of the attack on 9/11, there was an unrelated set of deaths that occurred from envelopes of weaponized anthrax spores that the U.S. had developed earlier. Perhaps it is our guilt in having developed biological weapons that makes us suspect other countries.&nbsp; &nbsp;

Today in History - October 24

<a href="https://www.kwucoyotes.com/roster/24/5/13353">Matt Myers</a>&nbsp;and his Kansas Wesleyan football team couldn't have asked for a more complete performance and outcome in their Homecoming game Saturday night.

KWU's defense refused to bend or break, the offense broke free of its slump and placekicker&nbsp;<a href="https://www.kwucoyotes.com/roster/24/5/13398">Aaron Main</a>&nbsp;(SR/Tulsa, Okla.) added his name to the record book as the Coyotes rolled to a 62-0 Kansas Conference rout of Tabor before a sellout crowd of 2,134 – the fourth largest in school history – at JRI Stadium and Graves Family Sports Complex.

KWU limited Tabor to 76 total yards on 61 plays (1.2 yards per play) and piled up 430 yards led by quarterback&nbsp;<a href="https://www.kwucoyotes.com/roster/24/5/14106">Richard Lara</a>&nbsp;(SO/Bakersfield, Calif.), who was making his second career start.

And there was Main who kicked a 47-yard field goal and tied the school record with a 51-yarder, both in the second quarter.

"What we did tonight is what we're capable of," said Myers, whose team improved to 6-2 overall and in the KCAC. "If we continue to do that – eliminate mistakes on offense and defense and let our guys go play – that's the kind of a result that we expect."

The defense continued its dominant play. One week after limiting McPherson to 50 total yards in the second half, the Coyotes constructed a steel curtain around Tabor's offense. The Bluejays (5-3 overall, 4-3 KCAC) had a minus-33 total yards and no first downs at halftime. They finished with just five first downs – the first coming late in the third quarter.

Wesleyan also registered five sacks, all in the first half – end&nbsp;<a href="https://www.kwucoyotes.com/roster/24/5/13443">Scott Sanchez</a>&nbsp;(SR/Kelseyville, Calif.) accounting for 2.5.

"We switched up our fronts a little bit on how we were mixing matching the guys in the defensive line," Myers said. "It was good to see them produce like that in the first half. They calmed down in the second half but we still got the shutout and that's the most important thing."

Linebackers&nbsp;<a href="https://www.kwucoyotes.com/roster/24/5/13379">Ricco Moore</a>&nbsp;(JR/Ocean Springs, Miss.) and&nbsp;<a href="https://www.kwucoyotes.com/roster/24/5/13474">Taevin Brown</a>&nbsp;(FR/Austin, Texas) had eight tackles apiece and DeVante' Gabriel seven for KWU. Tabor quarterbacks Gustavo Villareal and William Green were a combined 9 of 22 passing for 78 yards and one interception.

"Coaches said apply pressure, all they do is inside zone (runs) so stop the run and they couldn't move the ball," Moore said. "Their tackles are young so we sent edge pressure (after the quarterback) and they couldn't stop it."

Moore said the defense is a cohesive unit that feeds off each other.

"It's just chemistry," he said. "We work hard every day. We're brothers and we just make each other better. Iron sharpens iron."

Lara was solid directing the offense completing 13 of 22 passes for 162 yards, two touchdowns and an interception. Backup&nbsp;<a href="https://www.kwucoyotes.com/roster/24/5/13380">Tony White</a>&nbsp;(SR/Cincinnati, Ohio) was 2 of 5 for 14 yards and ran two yards for KWU's final touchdown in the fourth quarter.

"He played a good game," Myers said of Lara, a transfer from Bakersfield College (Calif.). "He under threw a ball that could have had an easy touchdown so once we get some of that ironed out, we'll be able to really open (the offense) up and go."

The Coyotes had 256 yards rushing led by&nbsp;<a href="https://www.kwucoyotes.com/roster/24/5/13408">Mark Benjamin</a>&nbsp;(SO/Houston, Texas) who had 86 yards on five carries – 73 coming on a touchdown jaunt on the first play of the fourth quarter.&nbsp;<a href="https://www.kwucoyotes.com/roster/24/5/13392">Nick Allsman</a>&nbsp;(SO/Belleville, Kan.) had 52 yards on nine carries and scored twice,&nbsp;<a href="https://www.kwucoyotes.com/roster/24/5/14131">Tyler Boston</a>&nbsp;(JR/Dixon, Calif.) 41 on 11 tries and a touchdown and&nbsp;<a href="https://www.kwucoyotes.com/roster/24/5/14102">D'Heaven Domena</a>&nbsp;(FR/Charlotte, N.C.) scored and had 18 yards on three carries.

The designated hero, though, was most Main. He made all eight of his extra point attempts in addition to the two field goals. He's 44 of 44 on extra points this season, three of four on field goal attempts and has scored 53 points.

The 51-yard field goal tied the record set by Terry Stecker on October 29, 2011 against Southwestern.

Main was thrilled to get two chances Saturday.

"I've got a lot of faith in Aaron," Myers said. "He probably would like more opportunities but we're going to continue to be aggressive and go for it on fourth downs. I'm happy that he banged those two in and I'm more than willing to send him back out there when the time calls for it."

Today in History - October 23

SEDGWICK COUNTY—Law enforcement authorities are investigating an armed robbery and have made an arrest.

Just after 6pm Monday, police responded to an armed robbery in the 1900 block of South Hydraulic in Wichita, according to a media release. 

Officers learned that&nbsp;31-year-old Joseph Rest-Isaac just robbed the DD Smoke Shop at gunpoint demanding money, watches, cigarettes and fled on foot.

During follow up WPD Officer Dustin Nail and K9 Nash went to the last known location of Rest-Isaac and began searching. 

They located him a short time later in the 1800 block of South Ellis where he was hiding in the rafters of a garage with a small caliber handgun and methamphetamines in his possession. 

He was taken into custody and booked on requested charges&nbsp;of Aggravated Robbery w/dangerous weapon, Criminal possession of a weapon by a felon, and possession of opiates.

At Monday's Salina City Commission meeting, Cottonwood fifth grade students presented a proclamation request for bullying prevention.&nbsp; 

They were accompanied by Vicki Price, education director for CAPS and Chris Field, a Cottonwood building substitute teacher.&nbsp;

The proclamation recognized October as Bullying Prevention Month and encouraged local&nbsp;schools,&nbsp;students,&nbsp;parents, recreational programs,&nbsp; religious institutions&nbsp;and&nbsp;community&nbsp;organizations&nbsp;to&nbsp;engage&nbsp;in awareness&nbsp;and&nbsp;prevention&nbsp;activities&nbsp;designed&nbsp;to&nbsp;make&nbsp;the community safer&nbsp;for&nbsp;all&nbsp;children&nbsp;and&nbsp;adolescents.&nbsp;

"The technical term for bullying is peer-to-peer child abuse because it comes from somebody your age, a peer," Price said. "Research tells us that bullying can best be stopped in the first 10 seconds. After it happens, there's this little window, where a bully will always look around at all the witnesses - they always watch their audience."&nbsp;

Providing education to counter bullying

CAPS - Child Advocacy and Parenting Services - is a nonprofit 501(c)(3) organization whose mission is to&nbsp;improve children’s lives and strengthen families through education, advocacy and support. A large part of that is educating families and connecting them with local resources.&nbsp;&nbsp;

The conversation regarding bullying prevention is not a new concept. Bullies Targets and Witnesses, a nationally acclaimed book written by Salinans SuEllen&nbsp;Fried and her daughter, Paula, provided an in-depth look at how young people become bullies, and how educators and community advocates can stop the cycle of peer abuse.&nbsp;&nbsp;

"The bullying crisis&nbsp;was bigger than we thought. It wasn't just something that kids have to go through, it had taken on a new kind of life of its own, and we needed to address it," said Price. "We were beginning to see kids committing suicide, like young kids&nbsp;11 or 12 years old, saying that the reason they were doing these things was because of the bullying."&nbsp;

&nbsp;In 1996, CAPS invited Paula and SueEllen to hold an in-service with educators within Salina USD 305 to share their research.&nbsp;&nbsp;

"Like a lot of good in-services that happen with teachers or with anybody in any profession, teachers said, 'Oh, this is great, This is wonderful!' Now, so what," Price said. "Somebody said, 'Well, somebody needs to do something,' So I just raised my hand and I said, 'Yeah, I'll be glad to.'"

Fried and Price embarked on plan to create a curriculum for schools to use that focused on the witnesses to bullying.&nbsp;Price began visiting classrooms throughout Salina USD 305, sharing her resources and visiting with students about how they have the power to stop bullying in their classrooms.&nbsp;&nbsp;

"I think the strength of this curriculum that we created, is that it focuses on the power that witnesses have. Because some curriculum that I've seen, focuses on victims. You need to empower the victim and we teach them like, if you're going to ignore the bully, you have to use your two Cs, your chest and your chin, they have to be up, we give victims some skills," Price said.&nbsp; "But the way that bullying really will end is by getting those witnesses to use the power that is just built in the way bullying is."&nbsp;&nbsp;

In one year alone, Price visits more than 400 third, fourth, and fifth&nbsp;grade classrooms throughout north-central Kansas. Her curriculum provides bullying prevention exercises and reenactments in the classroom setting for elementary and middle school students. Conflict resolution and empathy-building exercises facilitated by CAPs help strengthen students who are either targets or witnesses of bullying.&nbsp;

&nbsp;"That's why our curriculum is so powerful because kids can end bullying," Price said. "I mean, they could end bullying at their school today, if everybody used their power as a witness."

"We were beginning to see kids committing suicide, like young kids&nbsp;11 or 12 years old, saying that the reason they were doing these things was because of the bullying."&nbsp;&nbsp;In 1996, CAPS invited Paula and SueEllen to hold an in-service with educators within Salina USD 305 to share their research.&nbsp;&nbsp;"Like a lot of good in-services that happen with teachers or with anybody in any profession, teachers said, 'Oh, this is great, This is wonderful!' Now, so what," Price said. "Somebody said, 'Well, somebody needs to do something,' So I just raised my hand and I said, 'Yeah, I'll be glad to.'"<figure>

 </figure>Fried and Price embarked on plan to create a curriculum for schools to use that focused on the witnesses to bullying.&nbsp;Price began visiting classrooms throughout Salina USD 305, sharing her resources and visiting with students about how they have the power to stop bullying in their classrooms.&nbsp;&nbsp;"I think the strength of this curriculum that we created, is that it focuses on the power that witnesses have. Because some curriculum that I've seen, focuses on victims. You need to empower the victim and we teach them like, if you're going to ignore the bully, you have to use your two Cs, your chest and your chin, they have to be up, we give victims some skills," Price said.&nbsp; "But the way that bullying really will end is by getting those witnesses to use the power that is just built in the way bullying is."&nbsp;&nbsp;In one year alone, Price visits more than 400 third, fourth, and fifth&nbsp;grade classrooms throughout north-central Kansas. Her curriculum provides bullying prevention exercises and reenactments in the classroom setting for elementary and middle school students. Conflict resolution and empathy-building exercises facilitated by CAPs help strengthen students who are either targets or witnesses of bullying.&nbsp;&nbsp;"That's why our curriculum is so powerful because kids can end bullying," Price said. "I mean, they could end bullying at their school today, if everybody used their power as a witness."

As recently as 50 years ago, the pit bull was America’s favorite dog.
 Pit bulls were everywhere. They were popular in advertising and used to
 promote the joys of pet-and-human friendship. <a href="https://www.akc.org/expert-advice/lifestyle/high-fidelity-nipper-the-rca-dog/">Nipper on the RCA Victor label</a>, <a href="https://www.kennel.com/our-gang-the-little-rascals-and-petey-the-pit-bull/">Pete the Pup</a> in the “Our Gang” comedy short films, and the flag-wrapped dog on a <a href="https://commons.wikimedia.org/wiki/File:WW1_poster_featuring_a_pit_bull.jpg">classic World War I poster</a> all were pit bulls.

With <a href="https://www.metlifepetinsurance.com/blog/breed-spotlights/national-pitbull-awareness-day/">National Pit Bull Awareness Day</a> celebrated on Oct. 26, it’s a fitting time to ask how these dogs came to be seen as a dangerous threat.

Starting around 1990, multiple features of American life converged to
 inspire widespread bans that made pit bulls outlaws, called “<a href="https://www.latimes.com/archives/la-xpm-1994-11-13-mn-62013-story.html">four-legged guns</a>” or “<a href="https://www.deseret.com/1995/12/26/19211866/pit-bulls-are-lethal-ban-them">lethal weapons</a>.”
 The drivers included some dog attacks, excessive parental caution, 
fearful insurance companies and a tie to the sport of dog fighting.

As a professor of <a href="http://colindayan.com/">humanities and law</a>,
 I have studied the legal history of slaves, vagrants, criminals, terror
 suspects and others deemed threats to civilized society. For my books “<a href="https://press.princeton.edu/books/paperback/9780691157870/the-law-is-a-white-dog">The Law is a White Dog</a>” and “<a href="http://cup.columbia.edu/book/with-dogs-at-the-edge-of-life/9780231167123">With Dogs at the Edge of Life</a>,” I explored human-dog relationships and how laws and regulations can deny equal protection to entire classes of beings.

In my experience with these dogs – including nearly 12 years living 
with Stella, the daughter of champion fighting dogs – I have learned 
that pit bulls are not inherently dangerous. Like other dogs, they can 
become dangerous in certain situations, and at the hands of certain 
owners. But in my view, there is no defensible rationale for condemning 
not only all pit bulls, but any dog with a single pit bull gene, as <a href="https://www.forallanimals.org/pit-bull-terriers-breed-discriminatory-legislation-faqs/">some laws do</a>.

I see such action as canine profiling, which recalls another legal fiction: the <a href="https://www.amacad.org/publication/one-drop-one-hate">taint or stain of blood</a> that ordained human degradation and race hatred in the United States.

The pit bull is strong. Its jaw grip is almost impossible to break. Bred over centuries to <a href="https://www.tuftsyourdog.com/dogtrainingandbehavior/dear-doctor-pit-bulls-and-locking-jaws/">bite and hold large animals</a> like bears and bulls around the face and head, it’s known as a “game dog.” Its bravery and strength <a href="https://pets.webmd.com/dogs/features/pit-bulls-safety">won’t allow it to give up</a>, no matter how long the struggle. It loves with the same strength; its loyalty remains <a href="https://www.aspca.org/about-us/aspca-policy-and-position-statements/position-statement-pit-bulls">the stuff of legend</a>.

For decades pit bulls’ tenacity encouraged the sport of dogfighting, 
with the dogs “pitted” against each other. Fights often went to the 
death, and winning animals earned huge sums for those who bet on them.  

But betting on dogs is not a high-class sport. Dogs are not horses; 
they cost little to acquire and maintain. Pit bulls easily and quickly 
became associated with the poor, and <a href="https://law.lclark.edu/live/files/32171-25-1-third-articlepdf">especially with Black men</a>, in a narrative that connected pit bulls with gang violence and crime.

That’s how prejudice works: The one-on-one <a href="https://drexel.edu/%7E/media/Files/law/law%20review/v10-3/Saucier%2010%20Drexel%20L%20Rev%20673.ashx">lamination of the pit bull onto the African American male</a> reduced people to their accessories.

Dogfighting was <a href="https://www.animallaw.info/article/detailed-discussion-dog-fighting">outlawed in all 50 states by 1976</a>, although illegal businesses persisted. Coverage of the practice spawned <a href="https://www.nationalgeographic.com/adventure/article/pit-bull-ban-aggressive-dog-breed-bronwen-dickey">broad assertions</a>
 about the dogs that did the fighting. As breed bans proliferated, legal
 rulings proclaimed these dogs “dangerous to the safety or health of the
 community” and judged that “<a href="https://supreme.justia.com/cases/federal/us/166/698/">public interests demand that the worthless shall be exterminated</a>.”

In 1987 Sports Illustrated put a pit bull, teeth bared, on its cover,
 with the headline “Beware of this Dog,” which it characterized as <a href="https://vault.si.com/vault/1987/07/27/the-pit-bull-friend-and-killer-is-the-pit-bull-a-fine-animal-as-its-admirers-claim-or-is-it-a-vicious-dog-unfit-for-society">born with “a will to kill</a>.”
 Time magazine published “Time Bombs on Legs” featuring this “vicious 
hound of the Baskervilles” that “seized small children like rag dolls 
and mauled them to death in <a href="https://content.time.com/time/subscriber/article/0,33009,965065,00.html">a frenzy of bloodletting</a>.”

If a dog has “vicious propensities,” the owner is assumed to share in
 this projected violence, both legally and generally in public 
perception. And once deemed “contraband,” both property and people are 
at risk.  

This was evident in the much-publicized 2007 <a href="https://www.penguinrandomhouse.com/books/306009/the-lost-dogs-by-jim-gorant/">indictment of Atlanta Falcons quarterback Michael Vick</a> for running a dogfighting business called Bad Newz Kennels in Virginia. Even the <a href="https://www.humanesociety.org/">Humane Society of the United States</a> and <a href="https://www.peta.org/">People for the Ethical Treatment of Animals</a>
 – two of the nation’s leading animal welfare advocacy groups – argued 
that the 47 pit bulls recovered from the facility should be killed 
because they <a href="https://www.dailypress.com/news/dp-95941sy0aug03-story.html">posed a threat to people and other animals</a>.

If not for the intervention of <a href="https://bestfriends.org/">Best Friends Animal Society</a>, Vick’s dogs would have been euthanized. As the film “<a href="http://www.championsdocumentary.com/the-dogs">Champions</a>” recounts, a <a href="https://www.animallaw.info/article/lessons-learned-acting-guardianspecial-master-bad-newz-kennels-case">court-appointed special master</a> determined each dog’s fate. Ultimately, nearly all of the dogs were successfully placed in <a href="https://www.washingtonpost.com/sports/2021/12/21/michael-vick-dog-survivor-frodo-dies/">sanctuaries or adoptive homes</a>.

Pit bulls still suffer more than any other dogs from the fact that 
they are a type of dog, not a distinct breed. Once recognized by the 
American Kennel Club as an <a href="https://www.akc.org/dog-breeds/american-staffordshire-terrier/">American Staffordshire terrier</a>, popularly known as an Amstaff, and registered with the United Kennel Club and the American Dog Breeders Association as an <a href="https://www.ukcdogs.com/american-pit-bull-terrier">American pit bull terrier</a>, now any dog characterized as a “pit bull type” can be <a href="https://www.bostonreview.net/articles/dayan-dead-dogs/">considered an outlaw</a> in many communities.

For example, in its 2012 <a href="https://caselaw.findlaw.com/md-court-of-appeals/1599539.html">Tracey v. Solesky ruling</a>,
 the Maryland Court of Appeals modified the state’s common law in cases 
involving dog injuries. Any dog containing pit bull genes was 
“inherently dangerous” as a matter of law.

This subjected owners and landlords to what the courts call “<a href="https://legal-dictionary.thefreedictionary.com/strict+liability">strict liability</a>.”
 As the court declared: “When an attack involves pit bulls, it is no 
longer necessary to prove that the particular pit bull or pit bulls are 
dangerous.”

Dissenting from the ruling, Judge Clayton Greene recognized the 
absurdity of the majority opinion’s “unworkable rule”: “How much ‘pit 
bull,’” he asked, “must there be in a dog to bring it within the strict 
liability edict?”

It’s equally unanswerable how to tell when a dog is a pit bull mix. 
From the shape of its head? Its stance? The way it looks at you?

Conundrums like these call into question statistics that show pit bulls to be <a href="https://www.coloradoinjurylaw.com/dog-bite-statistics/">more dangerous than other breeds</a>. These figures vary a great deal depending on their sources.

Any statistics about pit bull attacks depend on the definition of a 
pit bull – yet it’s really hard to get good dog bite data that <a href="https://www.avma.org/javma-news/2017-11-15/dangerous-dog-debate">accurately IDs the breed</a>.

 </figure>Over the past decade, awareness has grown that breed-specific legislation <a href="https://www.avma.org/resources/pet-owners/why-breed-specific-legislation-not-answer">does not make the public safer</a> but does <a href="https://www.washingtonpost.com/dc-md-va/2022/09/01/pitbull-ban-lawsuit-prince-georges/">penalize responsible owners and their dogs</a>. Currently 21 states prohibit local government from enforcing breed-specific legislation or <a href="https://wagwalking.com/daily/what-states-allow-pit-bulls">naming specific breeds in dangerous dog laws</a>. Maryland passed a law reversing the Tracey ruling in 2014. Yet 15 states still <a href="https://dogsandclogs.com/states-with-pitbull-bans/#15_states_with_Pit_Bull_bans">allow local communities to enact breed-specific bans</a>. Pit bulls demand a great deal more from humans than some dogs, but 
alongside their bracing way of being in the world, we humans learn 
another way of thinking and loving. Compared with many other breeds,
