The FCC’s Robocall Response Team is warning consumers about a potential uptick in student loan debt robocalls in the wake of the recent announcement of nationwide federal student loan debt relief.  Scammers often use broadly publicized news to add an air of legitimacy and familiarity to their spoofed robocalls.  Scammers might use the calls to pressure consumers to make a payment or provide private information.  But consumers should be aware that there is no fee to apply for student loan debt relief and that applications are accepted only at StudentAid.gov/DebtRelief.  

The FCC also issued an Enforcement Advisory today to remind voice service providers of their role in protecting consumers by combatting the scourge of illegal robocalls aggressively, especially student loan robocalls, following recent announcements regarding student loan forgiveness and deferment.  

These calls typically state that the caller is informing the recipient that the payment suspension will end or that a petition can be filed on their behalf to get a certain amount of their loan “dismissed.”  Some common campaigns purport to be from the “student loan forgiveness center” or from a state forgiveness center.  Spoofing may be use to further confuse consumers by using seemingly legitimate caller ID information.

“We are calling on the phone companies to heighten their vigilance and take decisive measures to block student loan debt scam robocalls.  We are ready to take action in every way we can and throw the book at robocallers who illegally target consumers.”

The Chairwoman recently attended a meeting hosted by the National Economic Council to discuss this topic and prepare to combat scammers.  The FCC is working with its federal partners to combat such calls.

On August 24, 2022, President Biden announced student loan forgiveness for millions of Americans and an extension of the loan forbearance period through December 31, 2022.   The Department of Education has extended forbearance seven times since March 20, 2020, in response to the COVID-19 pandemic.   Each time the Department of Education has extended the forbearance, fraudsters and unscrupulous marketers have taken advantage of these changes to flood American consumers with robocalls about student loans.  While the FCC has not seen any increase in consumer complaints about these calls to date, other evidence, including a recent warning from the FTC, suggests that callers are starting to flood phones in the United States with student loan-related robocalls in the months preceding the end of loan forbearance or changes to student loan programs.  

Consumers should be aware that they are likely talking to a scammer if the robocaller:

· Pressures you to provide money or information.

· Says you need to pay any sort of fee to apply or appeal your application.

· Directs you to any website outside of StudentAid.gov

· Purports to be calling from somewhere like the “student loan forgiveness center” or from a state forgiveness center.

· Uses suspicious caller ID, such as a name that is inconsistent with the substance of the message, or the same area code and first three digits of your phone number.

· Asks for your FSA ID, bank account, or credit card information.  (The real application requires your name, birth date, Social Security number, phone number, and email address.)

If you have received a possible scam robocall:

· Do not share any personal or financial information.

· If you’re not sure, hang up and call the institution using their publicly available, legitimate phone number.

Ron D. Trower, 72, Dallas, Oregon, formerly of Chapman, Kansas, passed away October 15, 2022. Ron was born in&nbsp;Junction City, Kansas on June 15, 1950 to Georgia (Sheek) and Ray C. Trower. 

He graduated from Chapman High School&nbsp;in 1969. After high school, he attended Salina Area Technical College and subsequently served in the U.S. Marine Corps.

Ron was formerly married to Pam (Sanders). In 1991, Ron married Deb (Sheffield). 

Ron worked as a lineman for KCP&amp;L in&nbsp;Abilene, Kansas but moved to California and later Nevada where he worked for more than 30 years as a lineman for Los&nbsp;Angeles Power and Light, Transmission Division, Henderson, Nevada. After retirement from that position, he enjoyed working with his brothers Rodney and Terry at Transformer Disposal Specialists, Inc., in Tonkawa, Oklahoma. He also&nbsp;worked as a truck driver for Kenneth Livingston Trucking, and Everett's Inc., both of Abilene, Kansas for several years before&nbsp;moving to Oregon.

Ron was a beloved son, brother, husband, father, and grandfather. He loved spending time with his family and also enjoyed&nbsp;quiet time with a good book. Family and friends will remember Ron as someone who was quick with a smile and a story,&nbsp;particularly over coffee with his brother Terry. Ron loved traveling, and exploring new places. He enjoyed the beauty that can&nbsp;be found outdoors, especially in places like Utah where he traveled often.

He was preceded in death by his parents and his brothers Gary and Rodney Trower. 

Survivors include his brother Terry&nbsp;(Janet), Enterprise, Kansas; sister Joy Ferguson, Salina, Kansas; sister Gay (Michael) Tedder, Leawood, Kansas; and sister&nbsp;Merry (John) Whitham, Scranton, Kansas. He is also survived by his wife Deb, and sons Jeff Trower, Las Vegas, Nevada; Dallas Trower, Dallas, Oregon; four stepchildren, 22 grandchildren and three great-grandchildren. Ron also leaves behind many&nbsp;nieces and nephews. 

Family will receive friends Saturday, November 12, 2022 from 2-4 p.m. at Londeen-Overlease Funeral Chapel in Chapman.&nbsp;&nbsp;

ABILENE - Employees of Memorial Health System (MHS) in Abilene wore blue jeans at work for another Jeans Day fundraiser on Fridays throughout the month of October. 

Employees make a donation, of at least $5, and are allowed to wear blue jeans at work. A total donation of $715 was presented to the Abilene Area Toys 4 Tots organization. 

The monthly Jeans Day fundraiser is organized by the MHS Employer of Choice (EOC) committee.

Memorial Hospital is also an Abilene Area Toys 4 Tots drop off location for new toys, games, books, and monetary donations through Dec. 5.

KANSAS CITY, Kan. (AP) — A former Kansas undersheriff was acquitted Wednesday in the death of an unarmed man he shot with a defective beanbag round five years ago.

Virgil Brewer&nbsp;<a href="https://apnews.com/article/48f367e57fc14cb39febf89f3d501feb">was charged with involuntary manslaughter</a>&nbsp;after he shot Steven Myers using his personal shotgun on the evening of Oct. 6, 2017, in Sun City, a rural area about 300 miles (555 kilometers) from Kansas City, Kansas.

A Wyandotte County jury deliberated for four hours after a weeklong trial before returning the not-guilty verdict.

It was unclear if Brewer, who has been on unpaid leave from the Barber County Sheriff’s department since his 2018 arrest, would return to his former role.

Brewer and two other officers&nbsp;<a href="https://apnews.com/article/kansas-city-shootings-78351ed89adbf87f7b51d99e2568cd2e">responded to a call</a>&nbsp;about an armed man on a street after an altercation at a Sun City bar. Myers, who was drunk and had been told to leave the bar, was gone by the time officers arrived. They found him in a shed at a Sun City home. He came out of the shed and Brewer shot him at close range with a beanbag, which split open and emptied pellets into his chest, causing fatal injuries.

Medical Examiner Timothy Gorrill ruled Myers’ death a homicide.

During closing arguments Wednesday, assistant attorney general Melissa Johnson said the trial came down to whether Brewer acted recklessly when he shot Myers even though he had no training with beanbag ammunition and had been warned to test it before using it.

She said Brewer showed “willful ignorance” by not undergoing training, leading him to shoot a round too close toward the wrong part of the body and with no idea of the damage it would cause.

“(Brewer) argues that he was not trained so he’s not responsible for what happened,” Johnson said. “That’s not a reasonable argument for anyone to make.”

Defense attorney David Harger countered that prosecutors didn't meet their burden to prove beyond a reasonable doubt that Brewer's actions were reckless when he made a split-second decision in a tense and evolving confrontation.

An expert testified at trial that the beanbag round was defective and should never have been sold or distributed, Harger said.

“(Myers’ death) was not from a defective decision,” Harger said. “It resulted from a defective round of ammunition.”

Harger said Brewer was carrying his own weapon because the department couldn't afford to fully arm all its officers.

Harger said Myers left the shed and walked toward the officers, angrily swearing at them, and made a threatening gesture. Johnson said video from another deputy's body camera showed Myers was not moving toward the officers and that he complied with their demands before the fatal shot.

Brewer told the Kansas Bureau of Investigation in an interview that Myers was not armed when they confronted him and other officers testified they did not see a weapon. Brewer did not testify at trial.

According to the probable cause affidavit, Brewer told the KBI that he feared for his life and those of his fellow officers when Myers approached them. He also said he did not expect the beanbag round to penetrate Myers’ chest.

Brewer had previously worked as a deputy in Texas. Travis Martin, the deputy at the Freestone County Sheriff’s Office in Texas who gave Brewer the ammunition, testified that he told Brewer to test the ammunition before using it. But the first time Brewer tried it was when he shot Myers, Johnson said.

Proper training would have taught Brewer that rectangular-shaped beanbags can penetrate their targets and that their use has been discontinued for years, according to Bureau Agent Brian Carroll in an affidavit in support of the criminal charge against Brewer. The rounds used today are rounded, balloon-shaped bean bags.

Harger noted that Kansas does not require law enforcement to train to use beanbag ammunition and that training was not economically feasible at the small sheriff's department.

A civil lawsuit brought by Myers’ family against Brewer and then-Barber County Sheriff Lonnie Small&nbsp;<a href="https://apnews.com/article/8480d5726b3275a28130abeeea1faae0">was settled</a>&nbsp;in 2020 after county officials agreed to pay $3.5 million.

(AP) — Parkland school shooter&nbsp;<a href="https://apnews.com/hub/nikolas-cruz">Nikolas Cruz</a>&nbsp;formally received a sentence of life without parole Wednesday after families of his&nbsp;<a href="https://apnews.com/article/education-florida-gun-politics-school-boards-nikolas-cruz-44a0da3e406f0c487e5c0a6b0855ee2e">17 slain victims</a>&nbsp;spent two days berating him as evil, a coward, a monster and a subhuman.

Cruz, shackled and in a red jail jumpsuit, watched Judge Elizabeth Scherer but showed no emotion as she sentenced him to 17 consecutive life terms for the&nbsp;<a href="https://apnews.com/article/shootings-education-florida-fort-lauderdale-parkland-school-shooting-045455fc875b7a91800468995c18dcf5">Feb. 14, 2018, massacre</a>&nbsp;at Marjory Stoneman Douglas High School in suburban Fort Lauderdale, and an additional 17 terms for the attempted murders of those he wounded.

Scherer had no other choice; the jury in Cruz’s three-month penalty trial&nbsp;<a href="https://apnews.com/article/parkland-shooter-jury-recommendation-live-updates-15c5121be1b8b7a73b85607d602e6ba2">voted 9-3 on Oct. 13</a>&nbsp;to sentence him to death, but Florida law requires unanimity for that sentence to be imposed.

Cruz acknowledged under questioning by the judge before sentencing that he is on medication but could understand what was occurring.

The sentencing came after two days' worth of parents, wives, siblings and others of slain victims and some of the surviving wounded walking to a lectern 20 feet to address him face to face.

The judge commended the families and wounded who testified, calling them strong, graceful and patient.

“I know you are going to be OK, because you have each other,” Scherer said.

The judge’s voice broke as she read the first of the 34 life sentences, but she her voice gained strength and volume she moved down the list. Some parents and other family members wept as she read.

Families and the wounded spent two days verbally thrashing Cruz, wishing him a painful demise in prison and lamenting that he could not be sentenced to death.

“Real justice would be done if every family here were given a bullet and your AR-15 and we got to pick straws, and each one of us got to shoot one at a time at you, making sure that you felt every bit of it, and your fear continued to mount until the last family member who pulled that last straw had the privilege of making sure that they killed you," said Linda Beigel Schulman, mother of teacher Scott Beigel. “That’s real justice for you.”

Beigel Schulman said she takes some comfort in knowing that Cruz is headed to a maximum-security prison where he will have to worry constantly about his safety for the rest of his life.

“From what I hear, child killers are highly frowned upon and hated in prison,” Beigel Schulman said to Cruz. “I welcome the day that I’m told that you’ve been tortured and taken out for your cold-blooded, premediated, calculated, heinous murders, because you deserve no less.”

David Alhadeff, the uncle of Alyssa Alhadeff, told Cruz via Zoom from his classroom in Maryland that he deserves “the opportunity to rot away.”

“You deserve the opportunity to absorb the look of terror on your face once you leave this courtroom," Alhadeff said. "You deserve the opportunity of knowing that justice will prevail at some point, causing you great anguish, minute by minute, day by day.”

KANSAS CITY, Mo. (AP) — Former Kansas City Chiefs assistant coach Britt Reid was sentenced on Tuesday to three years in prison for driving drunk, speeding and hitting two parked cars last year, leaving a 5-year-old girl with a serious brain injury.

Reid&nbsp;<a href="https://apnews.com/article/kansas-city-chiefs-philadelphia-eagles-nfl-sports-andy-reid-f9ec365b3e367f15ea95e9d94a122f0b">pleaded guilty in September</a>&nbsp;to driving while intoxicated causing serious bodily injury. The charge carries a maximum penalty of seven years in prison, but prosecutors had agreed to ask for a maximum sentence of four years in prison. Reid sought probation.

Circuit Judge Charles H. McKenzie sentenced Reid Tuesday and ordered that he  be taken into custody immediately. 

Prosecutors said Reid, the son of Chiefs Coach Andy Reid,&nbsp;<a href="https://apnews.com/article/nfl-kansas-football-kansas-city-kansas-city-chiefs-d43b085c56ac1d0ec8445f30faa6a4d0">was intoxicated and driving about 84 mph</a>&nbsp;in a 65 mph zone when his Dodge truck hit the cars on an entrance ramp to Interstate 435 near Arrowhead Stadium on Feb. 4, 2021.

A girl inside one of the cars, Ariel Young, suffered a traumatic brain injury. A total of six people, including Reid, were injured. One of the vehicles he hit had stalled because of a dead battery, and the second was owned by Ariel’s mother, who had arrived to help.

Reid had a blood-alcohol level of 0.113% two hours after the crash, police said. The legal limit is 0.08%.

Before sentencing, a victim impact statement from Ariel’s mother, Felicia Miller, was read into the record. She said the five victims of the crash were offended that Reid sought probation and they did not accept his apologies for his actions. The family opposed the plea deal.

Miller said her daughter, who was in court Tuesday, has improved but still drags one of her feet when she walks, has terrible balance and must wear thick eyeglasses.

“Ariel’s life forever changed because of Britt Reid,” Miller’s statement said. “She will deal with this for the rest of her life.”

Reid apologized before sentencing, turning to look at Ariel and her family as he spoke. He said he has a daughter the same age as Ariel and his family prays for her every night.

“I understand where Ms. Miller is coming from. I think I would feel the same way,” he said.

Reid’s attorney, J.R. Hobbs, asked in a sentencing memorandum that Reid be placed on probation, noting he had publicly apologized and was remorseful.

Reid underwent emergency surgery for a groin injury after the crash. The Chiefs placed him on administrative leave, and his job with the team ended after his contract was allowed to expire.

This is not the first legal issue for Reid, who graduated from a drug treatment program in Pennsylvania in 2009 after a series of run-ins with law enforcement. His father was coach of the Philadelphia Eagles at the time.

The Chiefs&nbsp;<a href="https://apnews.com/article/nfl-sports-health-business-football-b79b53869eb2a017e1e41623ac5abb58">reached a confidential agreement</a>&nbsp;with Ariel’s family in November to pay for her ongoing medical treatment and other expenses.

Ex-Chiefs coach sentenced, taken immediately to jail for DWI crash 

George V. Dinkel, age 73, formerly of Brownell, Kansas, passed away Thursday, October 27, 2022, at his home in Victoria, Kansas.

He was born September 7, 1949, in Hays, Kansas to Victor J. and Juliana
 M. (Rajewski).&nbsp; He married Velma (Unrein) on January 8, 1972, in Hays, 
Kansas.

He was a truck driver for National Carriers for over 20 years, and also
 was a farmer.&nbsp; He was a 1967 graduate of Ellis High School and was a 
member of Christ The King Catholic Church of WaKeeney, Kansas.&nbsp; He was a
 veteran of the US Army and moved to Victoria in the spring of this year
 from Brownell, Kansas.

Survivors include his wife Velma Dinkel, of the home; his children, 
John Dinkel and Chris Dixon, St. John’s, FL; Erin Rupp and husband 
Eugene, Victoria, KS; James Dinkel and wife, Annetta, Brownell, KS; his 
sisters, Judy Augustine and husband, Jeff, Hays, KS; Denice Fuller and 
husband, Mike, Concordia, KS; his grandchildren, Jacob Dinkel; Tyler 
Dinkel; Ethan Rupp; Emma Rae Rupp; his step grandchildren, Morgan Dixon;
 Bailee Dixon; Jacob Dixon; Andrew Rupp; Hillary Rupp; Amanda (Rex) 
Rhorer; Rondi Dysinger; Richie (Ashley) Dysinger; his step great
