Sheriff: Alleged impaired Kansas driver struck patrol vehicle

SEDGWICK COUNTY, Kan. — A Sedgwick County Sheriff's deputy suffered minor injuries early Monday after a suspected impaired driver struck a patrol vehicle while the deputy was providing traffic control for an injury crash north of Derby.

Just after 3a.m. Monday, a Sedgwick County Sheriff's Deputy identified as 26-year-old Payton K. Lewis was positioned at the intersection of 47th Street South and K-15 Highway assisting with traffic control related to an earlier injury crash, according to sheriff's department spokesman Branden Stitt.

Preliminary investigation indicates Deputy Lewis was seated inside a marked patrol vehicle with emergency lights activated when a dark blue Ford Escape traveling northbound on K-15 struck the passenger side rear of the patrol vehicle.

The deputy sustained minor injuries and he was transported to a local hospital for treatment.

Investigators identified the driver of the Ford Escape as 24-year-old Kole Montgomery, of Wichita. Deputies suspected Montgomery was under the influence at the time of the crash.

Montgomery was transported to a local hospital and later booked into the Sedgwick County Adult Detention Facility on requested charges of driving under the influence and aggravated battery of a law enforcement officer.

A passenger in the Escape identified as 24-year-old Ashlyn S. Turner of Derby was not wearing a seat belt but not injured, according to the Kansas Highway Patrol. 

The Derby Police Department assisted the Sheriff's Office with the impaired driving investigation. The Kansas Highway Patrol investigated the deputy-involved crash.
